सा.का.नि. 28(अ). वायुयान अधिनियम , 1934 ( 1934 का 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार वायुयान नियम 1937 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. (1 ) इन नियमों का संक्षिप्त नाम वायुयान (दूसरा संशोधन ) नियम , 2011 है ।
होंगे । (2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त
2. वायुयान नियम , 1937 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) , के नियम 30 में , उप- नियम (2 ) उप- खण्ड ( ii ) में " तथा जिसका अध्यक्ष और कम से कम दो तिहाई निदेशक भारत के नागरिक हैं " शब्दों का लोप किया जाता है ।
3. उक्त नियम के नियम 41 में पहले परंतुक के स्थान पर निम्नलिखित परंतुक को प्रतिस्थापित किया जाता है , अर्थात्:-
" परंतु यह कि उस व्यक्ति को जो भारतीय वायु सेना , नौ सेना या भारतीय सेना का अर्हित पायलट है और जो यह दर्शित करने के लिए संतोषजनक साक्ष्य पेश करता है कि उसे उस स्तर का आवश्यक उड्डयन अनुभव , सक्षमता और शारीरिक योग्यता है जो इन नियमों द्वारा अपेक्षित है तो महानिदेशक द्वारा लिखित सामान्य या विशेष आदेश तथा ऐसी शर्तों के अधीन , यदि कोई है , जिन्हें ऐसे आदेश में विनिर्दिष्ट किया जाए, इन नियमों के अधीन लाइसेंस जारी करने के लिए , उसे सभी या किसी उड्डयन परीक्षणों सेऔर चिकित्सीय या अन्य तकनीकी परीक्षाओं से छूट दी जासकेगीं : "

टिप्पण 1. मूल नियम अधिसूचना संख्या वी-26 , तारीख 23 मार्च , 1937 द्वारा प्रकाशित किए गए थे और तारीख 22 दिसम्बर , 2010 को भारत के राजपत्र , भाग II , खंड 3 , उप -खंड ( i ) में प्रकाशित संख्या सा.का.नि. 1001 ( अ ) तारीख 22 दिसम्बर , 2010 द्वारा प्रकाशित किया गया ।
2. केन्द्रीय सरकार ने वायुयान अधिनियम, 1934 (1934 का 22 ) की धारा 14 के परंतुक द्वारा प्रदत्त शक्तियोंका प्रयोग करते हुए , नागर विमानन मंत्रालय द्वारा जारी तारीख 12 जनवरी , 2011 के अपने आदेश संख्या ए.वी. 11012/12/ 2010 - क द्वारा इस अधिसूचना के मामले में छूट दी है ।
MINISTRY OF CIVIL AVIATION NOTIFICATION New Delhi , the 17th January, 2011
GS.R. 28(E) . In exercise of the powers conferred by Section 5 of the Aircraft Act, 1934 (22 of 1934) , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937 , namely :-

1. ( 1 ) These rules may be called the Aircraft (2ndAmendment) Rules , 2011 .
(2) They shall come into force on the date oftheir publication in the Official Gazette.
2. Inthe Aircraft Rules , 1937 (hereinafter referred to as the said rules), in rule 30 , in sub-rule (2) , in clause (a), in sub - clause ( ii ) , the words " and the Chairman and at least two-third of the Directors of which are citizens of India " shall be omitted .
3. In the said rules , in rule 41 , for the first proviso , the following proviso shall be substituted , namely:-
"Provided that a person who is a qualified pilot from Indian Air Force , Indian Navy or Air Operational Wing of the Indian Army and who produces satisfactory evidence to show that he possesses the necessary flying experience , competency and standards of physical fitness as required under these rules , may be exempted by the Director- General , by general or special order in writing , and subject to such conditions,

ifany, as may be specified in such order, from all or any of the flying tests and from medical or other technical examinations required for the issue ofthe licences under these rules : ""

Notes 1. The principal rules were published in the Official Gazette vide notification number V-26 , dated the 23rd March , 1937 and last amended by G.S.R. 1001 (E) dated 22nd December, 2010 published in Part II , Section (3 ), Sub -section ( i ) ofthe Gazette of India on 22nd December, 2010 .
2. The Central Government in exercise of the powers conferred by proviso to section 14 of the Aircraft Act, 1934 (22 of 1934 ) has in the public interest dispensed with the condition of previous publication in case of this notification vide its order No. AV. 11012 / 12/2010 -A dated 12th January, 2011 issued in the Ministry of Civil Aviation .
