सा.का.नि. 104(अ). केन्द्रीय सरकार लागत और संकर्म लेखापाल अधिनियम , 1959 ( 1959 का 23 ) की धारा 9 की उप - धारा ( 2 ) के खण्ड ( क ) के साथ पठित धारा 38क की उप- धारा (2 ) के खण्ड ( क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए लागत और संकर्म लेखापाल ( परिषद् का निर्वाचन ) नियम , 2006 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों को लागत और संकर्म लेखापाल ( परिषद् का निर्वाचन ) संशोधन नियम, 2011 कहा जाएगा ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. लागत और संकर्म लेखापाल ( परिषद् का निर्वाचन ) नियम , 2006 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) के नियम 5 में " जिसका नाम उस वित्तीय वर्ष में । अक्तूबर को जिसमें परिषद् का निर्वाचन किया जाना हो, रजिस्टर पर उपलब्ध है " शब्द, अंक के पश्चात् " और उसकी प्रवेश फीस , वार्षिक सदस्यता फीस और अन्य देयताएं बकाये में नहीं है " शब्द अंतःस्थापित किए जाएंगे ।
3. मूल नियम के नियम 7 में " ऐसा सदस्य जो उस वित्तीय वर्ष में जिसमें निर्वाचन किए जाने हैं, 1 अक्तूबर को फैलो सदस्य है । " शब्दों के पश्चात् " और प्रवेश फीस , वार्षिक सदस्यता फीस और अन्य देयताएं बकाये में नहीं हैं " शब्द अंतःस्थापित किए जाएंगे ।
4. मूल नियम में नियम 7 के परंतुक के खण्ड ( ङ ) के पश्चात् निम्नलिखित खण्ड अंतःस्थापित किया जाएगा , अर्थात्:-
" ( च ) वह संस्थान द्वारा या उसके अधीन नियोजित है । " ।

NOTIFICATION
New Delhi , the 21st February, 2011
G.S.R. 104(E) . In exercise of the powers conferred by clause ( a) of sub - section (2) of Section 38A read with clause ( a) of sub- section (2) of Section 9 of the Cost and Works Accountants Act, 1959 (23 of 1959 ) , the Central Government hereby makes the following rules further to amend to the Cost and Works Accountants (Election to the Council ) Rules , 2006 , namely :-
1. (1 ) These rules may be called the Cost and Works Accountants (Election to the Council) Amend- mentRules , 2011 .
(2) They shall come into force with effect from the date of their publication in the Official Gazette .
2. In the Cost and Works Accountants ( Election to the Council ) Rules , 2006 ( hereinafter referred to as the principal rules ) , in rule 5, after the words " whose name is borne on the Register " , the words " and his entrance fees , annual membership fees and other dues are not in arrears , " shall be inserted.
3. In the principal rules , in rule 7, after the words " a member who is a fellow " , the words " and his entrance fees , annual membership fees and other dues are not in arrears , " shall be inserted .
4. In the principal rules , in rule 7 in the proviso , after clause (e) , the following clause shall be inserted, namely
" (f) he is employed by or under the Institute . " .

Note : The Principal rules were published in the Gazette of India , Extraordinary, Part II , Section 3 , Sub- section ( i) vide number G.S.R. 712 (E) , dated the 17th November, 2006 and subsequently amended vide G.S.R. 554 (E) , dated the 23rd July, 2008 .
