का.आ. 104(अ).-केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय (सड़क खंड ) की अधिसूचना संख्यांक का.आ. 78 (अ) तारीख 4 फरवरी, 1.999 द्वारा उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग सं . 2 के 18.800 कि.मी. से 93.000 कि.मी. (दिल्ली । हरियाणा सीमा हरियाणा / उत्तर प्रदेश सीमा सेक्शन) और उत्तर प्रदेश राज्य में 93.000 कि.मी. से 479.000 कि.मी. (हरियाणा / उत्तर प्रदेश सीमा कानपुर सेक्शन) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है ) को सौंपा था ;

और प्राधिकरण ने उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में , हरियाणा और उत्तरप्रदेश राज्यों में राष्ट्रीय राजमार्ग संख्या 2 के 20.500 कि.मी. से 200.000 कि.मी. (दिल्ली आगरा सेक्शन) ( जिसे इसमें इसके पश्चात् उक्त सेक्शन कहा गया है) तक के विद्यमान चार लेन वाले सेक्शन को छः लेन का बनाने, प्रचालन और अनुरक्षण के लिए मैसर्स डी.ए टोल रोड प्राइवेट लिमिटेड, जिसका रजिस्ट्रीकृत कार्यालय एच ब्लाक, पहला तल, धीरूभाई अम्बानी नॉलेज सिटी, नवी मुम्बई 400710 महाराष्ट्र ( जिसे इसमें इसके पश्चात् "रियायतग्राहीँ कहा गया है) के साथ डिजाईन, निर्माण, वित्त और प्रचालन के आधार पर एक करार किया है;
अतः अब, केंद्रीय सरकार, राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संग्रहण) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के तत्कालीन पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्यांक का.आ. 58 (अ) और अधिसूचना संख्यांक का.आ. 59 (अ) , तारीख 8 जनवरी , 2008, को, उन बातों के सिवाय अधिक्रांत करते हुये जिन्हें ऐसे अधिक्रमण से पहले 177 G1/2010 (1) 2

किया गया है, या करने का लोप किया गया है, यह अधिसूचित करती है कि उक्त सेक्शन के उपयोग के लिए, फीस, नीचे दी गई सारणी I और सारणी II में विनिर्दिष्ट यांत्रिक यानों के प्रवर्ग पर उसमें विनिर्दिष्ट आधार दर पर उदगृहीत और संगृहीत की जायेगी और उक्त रियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, इनमें से जो भी पश्चात्वर्ती हो , समाप्ति की तारीख तक, उक्त फीस को संगृहीत और प्रतिधारित करने के लिए प्राधिकृत करती है, अर्थात्:--

विस्तार: - इस अधिसूचना के प्रयोजन के लिए,-
वास्तविक फीस से उक्त सेक्शन के सड़क उपयोक्ताओं से निम्नलिखित आधार पर प्रभारित वास्तविक फीस अभिप्रेत है ; (i)
( क) प्रत्येक फीस प्लाजा के लिए समनुदेशित परियोजना राजमार्ग की लम्बाई :
(ख) उपर्युक्त सारणी में दी गई आधार फीस सम्यक् रूप से सूचीबद्ध और पांच रूपये के निकटतम पूर्णांक में होगी ।
(ii) ' वाणिज्यिक प्रचालन की तारीख ' से वह तारीख अभिप्रेत है जब उक्त सेक्शन के संबंध में उक्त करार के अनुसार सभी पूर्ववर्ती शर्तों का समाधान करने के पश्चात् वाणिज्यिक प्रचालन प्रारंभ होता है ।
(iii) ' समाप्ति की तारीख ' से वह तारीख अभिप्रेत है जब उपर्युक्त करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति की सूचना द्वारा समाप्त किया जाता है ।
(iv) उन शब्दों और पदों के जो इस अधिसूचना में प्रयुक्त है और इसमें परिभाषित नहीं है किन्तु जो कि प्राधिकरण और रियायतग्राही के बीच में उक्त सेक्शन की बाबत हुए करार में परिभाषित हैं, क्रमशः वही अर्थ होंगे जो उक्त करार में हैं ।
2. फीस का संग्रहण निम्नलिखित अवस्थानों के पथकर प्लाजाओं पर प्रत्येक पथकर प्लाजा के सामने विनिर्दिष्ट दूरी के लिए किया जायेगा ।

3. फीस के संदाय से छूट, अतिभारी वाहनों के लिए फीस की दर, दरों में छूटें उक्त नियमों के अनुसार की जाएंगीं ।
4. पचास या अधिक एक तरफा टिकटों को जारी करने के लिए किसी व्यक्ति के अनुरोध पर, रियायतग्राही एक मास के लिए वैध ऐसे टिकट , उस प्रवर्ग के यानों के लिए संदेय फीस के दो तिहाई के बराबर रियायती दर पर जारी करेगा ।

NOTIFICATION
New Delhi , the 18th January, 2010
S.O. 104 ( E ) . Whereas , the Central Government by notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing) number S.O. 78 ( E ) , dated the 4th February, 1999 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988) , hereinafter referred to as said Act , entrusted the stretches from Km 18.800 Km 93.000 ( Delhi / Haryana Border - Haryana/ Uttar Pradesh Border section) in the State of Haryana and Km 93.000 Km 479.000 ( Haryana/ Uttar Pradesh Border - Kanpur section) in the State of Uttar Pradesh) of National Highway No 2 to the National Highways Authority of India ( hereinafter referred to as the Authority);
And whereas , pursuant to the powers conferred by section 14 of the said Act , the Authority has entered into an agreement with M/ s DA Toll Road Private Limited , having its registered office at H Block , 1st Floor , Dhirubhai Ambani Knowledge City Navi Mumbai 400710 Maharashtra , India (hereinafter referred to as the Concessionaire) for the development , operation and maintenance of the existing four lane section from Km 20.500 to Km 200.000 ( Delhi - Agra section) of the National Highway No. 2 in the State of Haryana and Uttar Pradesh ( hereinafter referred to as the said section) to six lane divided carriageway on Design , Build , Finance , Operate ( DBFO) basis ;
Now , therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 ( 48 of 1956) , read with the National Highways Fee (Determination of Rates and Collection) Rules , 2008 , and in supersession of the notifications of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways ) number S.O. 58 ( E) and S.O. 59 ( E) , both dated the 8th January , 2008 except as respects things done or omitted to be done before such suppression , the Central Government , hereby notifies that there shall be levied and collected fees on category of mechanical vehicles specified in Table I and Table II , for the use of said section at the base rate specified therein and authorizes the said Concessionaire to collect and retain the fee subject to and भारत का राजपत्र असाधारण

in accordance with the said rules and the provisions of the said Concession Agreement on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date , namely: --

Explanation . For the purpose of this notification , -
(i) " actual fee" means the fees actually charged from the road users of the said section on the basis of-
(a) length of the project highway assigned to each fee plaza;
(b) base fee rates provided in the above Table duly indexed , and shall be rounded off to nearest Five rupee ;
(ii) "date of commercial operation " means the date on which commercial operation of the said section begins after satisfying all conditions precedent in accordance with the said agreement ;
(iii) "termination date " means the date on which the agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice ;
(iv) words and expressions used in this notification and not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section shall have the same meaning as assigned to them respectively in the said agreement.
2. The fee shall be collected at the following location of Toll Plazas for the distance specified against each Toll Plaza:

3. Exemption from payment of fee , rates of fee for overloaded vehicles , discounts in rates etc shall be in accordance with the said rules .
4. Upon request from any person for issue of fifty or more one way tickets , the concessionaire shall issue such tickets valid for a period of one month , at a discounted rate equivalent to two third of the fee payable for that category of vehicles .
5. The revision of fee shall not be effected until a period of six months has elapsed from the date of Commercial Operation .
