सा.का.नि. 45(अ). औषध और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए कतिपय नियमों का प्रारूप औषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 कीअपेक्षानुसार भारत के राजपत्र , असाधारण, भाग II , खंड 3 , उप- खंड (i) , तारीख 20 अप्रैल , 2009 में भारत सरकार के स्वास्थ्यऔर परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना संख्यांक सा.का.नि. 262 ( अ ) , तारीख 20 अप्रैल, 2009 द्वारा प्रकाशित की गई थी जिससे ऐसे व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी उस तारीख से जिसको उस राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं से 45 दिन की अवधि समाप्त होने के पूर्व आक्षेप और सुझाव मांगे गए थे;
और उक्त राजपत्र की प्रतियां जनता को 22-4-2009 को उपलब्ध करा दी गई थीं;
और केन्द्रीय सरकार द्वारा उक्त प्रारूप नियम पर जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर दिया गया है ;
अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए औषधि तकनीकी सलाहकार बोर्ड के परामर्श के पश्चात्, औषधि और प्रसाधन सामग्री नियम , 1945 का और संशाधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( पहला संशोधन ) नियम , 2011 है । 254 G1/2011
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 के नियम 122ड के मद सं. (i ) , के लिए स्पष्टीकरण के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्:-
" (i) सभी वैक्सिनऔर पुनर्योगज डीएनए ( आर- डीएनए) से व्युत्पन्न औषधियां नई औषधियां होंगी जब तक कि वह नियम 21 के अधीन अनुज्ञप्ति अधिकारी द्वारा अन्यथा प्रमाणित नहो;" ।

पाद टिप्पण. मूल अधिसूचना भारत के राजपत्र में अधिसूचना संख्यांक एफ-28-10/45- एच( 1 ) , तारीख 21 दिसम्बर, 1945 में प्रकाशित की गई थी और अंतिम संशोधन अधिसूचना संख्या सा.का.नि. 683 ( अ ) , तारीख 19-8-2010 द्वारा किया गया ।

New Delhi , the 24th January , 2011
G.S.R. 45 ( E ) . Whereas a draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 , was published, as required by Sections 12 and 33 of the Drugsand Cosmetics Act, 1940 ( 23 of 1940) , in the Gazette of India , Extraordinary, Part II , Section 3 , Sub- section ( i) , dated the 20th April , 2009 under the notification of the Government of India , Ministry of Health and Family Welfare

(Department of Health) , number G.S.R. 262 (E ) , dated 20th April, 2009 , inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of forty- five days from the date on which the copies ofthe Official Gazette containing the said notification were made available to the public;
And whereas copies of the Gazette were made available to the public on 22-4-2009;
And whereas , objections and suggestions received from the public on the said rules have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by Sections 12 and 33 of the said Act, the Central Government, after consultation with the Drugs Technical Advisory Board , hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945 , namely :-
[PART II SEC. 3 (i) ]
1. ( 1 ) These rules may be called the Drugs and Cosmetics (Ist Amendment ) Rules , 2011 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945, in rule 122E, in the Explanation for item (i) , the following shall be substituted , namely :-
"(i) all vaccines and Recombinant DNA ( r - DNA) derived drugs shall be new drugs unless certified otherwise by the Licensing Authority under rule 21 ; " .
