सं. टीएएमपी/69 /2005- केपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 49 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , महापत्तन प्रशुल्क प्राधिकरण एतद्द्वारा संलग्न आदेशानुसार कांडला पत्तन न्यास ( केपीटी ) द्वारा पट्टे पर दी गई नमक भूमि से संबंधित दर ढाँचे की वैधता विस्तारित करता है ।

कांडला पत्तन न्यास ( केपीटी ) द्वारा पट्टे पर दी गई नमक भूमि से संबंधित दर ढाँचा इस प्राधिकरण द्वारा 17 जनवरी , 2006 को संशोधित किया गया था । इस प्राधिकरण द्वारा अनुमोदित पट्टा किराये 5 जुलाई , 1999 से पूर्वव्यापी प्रभाव से लागू किए गए थे । निर्धारित आधार दरें 5 जुलाई , 2005 से पाँच वर्षों की अवधि के लिए वैध थीं ।
2. आदेश दिनांक 17 जनवरी, 2006 द्वारा अनुमोदित दरों की वैधता 4 जुलाई , 2010 को समाप्त हो गई थी । केपीटी के अनुरोध के आधार पर, इस प्राधिकरण ने आदेश दिनांक 3 नवम्बर , 2010 द्वारा वैधता को छह माह अर्थात् 4 जनवरी , 2011 तक विस्तारित कर दिया था ।
3. केपीटी ने अपने पत्र दिनांक 3 जनवरी , 2011 द्वारा सूचित किया है कि उसने नमक भूमि के लिए दर ढाँचे के संशोधन के लिए प्रक्रिया शुरू कर दी है । इसने यह अनुरोध भी किया है कि यह प्राधिकरण नमक भूमि दरों की वैधता को 31 मार्च , 2011 तक और विस्तारित करे परन्तु इस शर्त के अधीन कि संशोधित दरें पूर्वव्यापी प्रभाव से लागू होंगी ।
4. नहापत्तन न्यासों की भूमि नीति पर फरवरी/ मार्च 2004 में सरकार द्वारा जारी किए गए दिशानिर्देशों में विनिर्दिष्ट किया गया है कि पट्टा किरायों में तब तक 2 प्रतिशत वार्षिक की दर से वृद्धि की जाए जब तक वे सक्षम प्राधिकारी द्वारा संशोधित नहीं की जाती हैं । इस प्राधिकरण द्वारा जनवरी 2006 में अनुमोदित आदेश भी सरकारी दिशानिर्देशों के अनुसार यह शर्त निर्धारित करता है । पट्टा किरायों की वर्तमान अनुसूची में पहले से ही पट्टा किरायों में तब तक 2 प्रतिशत की वार्षिक वृद्धि प्रदान की गई है तब तक दरें इस प्राधिकरण द्वारा संशोधित नहीं की जाती हैं ।

5. परिणामस्वरूप , और उपर्युक्त कारणों से , और समग्र विचार- विमर्श के आधार पर, यह प्राधिकरण कांडला पत्तन न्यास द्वारा आबंटित भूमि के लिए वर्तमान पट्टा किरायों की वैधता 4 जनवरी , 2011 से 31 मार्च , 2011 तक विस्तारित करता है , परन्तु इस शर्त के अधीन कि संशोधित दरें पूर्वव्यापी प्रभाव से लागू होंगी ।

NOTIFICATION
Mumbai , the 7th February, 2011
No. TAMP / 69/2005 - KPT . In exercise of the powers conferred by Section 49 of the Major Port Trusts Act . 1963 (38 of 1963 ) , the Tariff Authority for Major Ports hereby extends the validity of rate structure pertaining to salt land leased out by the Kandla Port Trust ( KPT ) as in the Order appended hereto .

The rate structure pertaining to salt land leased out the Kandla Port Trust ( KPT ) was revised by this Authority on 17th January, 2006. The lease rentals approved by this Authority were implementable with retrospective effect from 5th July . 1999. The base rates prescribed were valid for a period of five years with effect from 5th July, 2005 .
2. The validity of the rates approved vide Order dated 17th January, 2006 expired on 4th July, 2010. Based on the request of KPT the Authority extended the validity by six months i.e. up to 4th January , 2011 vide Order dated 3rd November . 2010 .
3. KPT by its letter dated 3rd January, 2011 has informed that it has started the procedure for revision of rate structure for the salt land . It has further requested this Authority to extend the validity of salt land rates for a further period upto 31st March , 2011 , subject to the condition that the revised rates will be made applicable with retrospective effect .
4. The guidelines issued by the Government in February /March 2004 on land policy of major ports stipulates that the lease rentals shall be escalated by 2 % per annum till they are revised by the Competent Authority. The Order approvedby this Authority in January 2006 also prescribes this condition in terms with the Government guidelines . The existing Schedule of lease rentals already provides for an annual escalation of 2 % in the lease rentals till the rates are revised by this Authority.
5. In the result, and for the reasons given above , and based on a collective application of mind , this Authority extends the validity of the existing lease rentals for land allotted by the Kandla Port Trust from 4th January, 2011 up to 31st March , 2011 , subject to the condition that the revised rates will be made applicable with retrospective effect .
