नई दिल्ली, 31 जनवरी , 2011
का.आ. 195(अ),-केन्द्रीय सरकार , पौधा किस्म और कृषक अधिकार संरक्षण अधिनियम , 2001 ( 2001 का 53 ) की धारा 3 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) की अधिसूचना सं. का.आ. 1589 ( अ ) , तारीख 11 नवम्बर , 2005 जो भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप- खंड ( ii ) में प्रकाशित की गई थी, में निम्नलिखित और संशोधन करती है , अर्थात् :-
उक्त अधिसूचना में , " डॉ. एस . नागराजन " प्रविष्टि के स्थान पर , निम्नलिखित रखा जाएगा , अर्थात् :-
"डॉ. पी. एल . गौतम "
उक्त अधिसूचना के पैरा 2 में , " प्राधिकरण के अध्यक्ष की पदावधि इस अधिसूचना के जारी होने की तारीख से पांच वर्ष के लिए या 65 वर्ष की आयु प्राप्त करने तक, इनमें से जो भी पूर्वत्तर हो , होगी " शब्दों और अंकों के स्थान पर निम्नलिखित शब्द रखे जाएंगे , अर्थात्:-
" प्राधिकरण के अध्यक्ष की पदावधि उनकी नियुक्ति की तारीख से पांच वर्ष के लिए या पैंसठ वर्ष की आयु प्राप्त करने तक, इनमें से जो भी पूर्वत्तर हो , होगी "

टिप्पण :-मूल अधिसूचना भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप- खण्ड ( ii ) , तारीख 11 नवम्बर, 2005 में सं. का.आ. 1589 ( अ ) , तारीख 11 नवम्बर , 2005 द्वारा प्रकाशित की गई थी और पश्चात्वर्ती संशोधन सं. का.आ. 1883 (अ ) , तारीख 1 नवम्बर, 2006 , सं. का.आ. 1316 ( अ ) , तारीख 11 मई , 2009 और सं. का.आ. 3064 ( अ ) , तारीख 30 नवम्बर , 2009 द्वारा किया गया है ।

NOTIFICATION
New Delhi , the 31st January, 2011
S.O. 195 (E ). In exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the Protection of Plant Varieties and Farmers ' Rights Act, 2001 (53 of 2001 ) , the Central Government hereby makes the following further amendments in the notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and Co - operation ) , published in the Gazette of India, Extraordinary, Part II , Section 3 , Sub - section ( ii ) , vide No. S.O. 1589 (E) , dated the 11th November, 2005 , namely::-
In the said notification, for the entry " Dr. S. Nagarajan " , following shall be substituted , namely :---
"Dr. P. L. Gautam "
Inparagraph 2 of the said notification, for the words and figures " The term of the Chairperson of the Authority shall be for a period of five years or up to the age of 65 years , whichever is earlier from the date of issue of this notification " , the following words shall be substituted , namely :-
"The term of the Chairperson of the Authority shall be for a period of five years from the date of his/her appointment or up to the age of sixty - five years , whichever is earlier "

Note : The principal notification was published in the Gazette of India, Extraordinary, Part II , Section 3, Sub - section(ii ), dated the 11th November, 2005 , vide No. S.O. 1589 (E) , dated the 11th November , 2005 and subsequently amended vide No. S.O. 1883 ( E) , dated 1st November , 2006 , No. S.O. 1316 ( E) , dated 11th May, 2009 and No. S.O. 3064 (F ) , dated 30thNovember, 2009 .
