फा. सं. 305-17/ 2010 -क्यूओएस.-भारतीय दूरसंचार विनियामक प्राधिकरण , 1997 ( 1997 का 24 ) की धारा 11 की उप- धारा ( 1 ) के खंड ( ख ) के उप-खंड ( v ) तथा खंड ( ग ) के साथ पठित धारा 36 के अंतर्गत प्राधिकरण को प्राप्त शक्तियों का प्रयोग करते हुए भारतीय दूरसंचार विनियामक प्राधिकरण " दूरसंचार वाणिज्यिक संप्रेषण उपभोक्ता अधिमान वाणिज्यिक संप्रेषण उपभोक्ता अधिमान विनियम , 2010 " में आगे संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-
जाएगा । 1. ( 1 ) इन विनियमों को दूरसंचार वाणिज्यिक संप्रेषण उपभोक्ता अधिमान ( तीसरा संशोधन ) विनियम, 2011 कहा (2) ये इनके राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. दूरसंचार वाणिज्यिक संप्रेषण उपभोक्ता अधिमान विनियम , 2010 ( जिसे इसमें इसके पश्चात् प्रधान विनियम कहा गया है ) के विनियम 1 के उप - विनियम ( 2 ) में,
(क) खंड ( ग ) के स्थान पर , निम्नलिखित खंड प्रतिस्थापित किया जाएगा , अर्थात्
" (ग ) इन विनियमों के विनियम 3 , 4 , 5 , 6 , 7, 8 , 9 ,10 और 11 , 10 फरवरी , 2011 को प्रवृत्त होंगे; " ;
(ख) इस प्रकार प्रतिस्थापित खंड ( ग ) के पश्चात् निम्नलिखित खंड प्रतिस्थापित किया जाएगा , अर्थात्:- " (घ ) इन विनियमों के विनियम 12 , 18 ,19 , 20 , 21 और 22 , 1 मार्च, 2011 को प्रवृत्त होंगे । "।

3. प्रधान विनियमों के विनियम 17 में, -
(क) विनियम (11 ) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थातः-
" (11 ) प्रत्येक एक्सेस प्रदाता, टेलीमार्केटर को पहले से आवंटित किए गए दूरसंचार संसाधनों को 28 फरवरी, 2011 से वापस ले लेगा । "
4. प्रधान विनियमों के विनियम 25 में,-
(क) खंड (ग) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थातः-
"(ग) दूरसंचार अवांछनीय वाणिज्यिक संप्रेषण विनियम , 2007 (2007 का 4) के विनियम 3 , 4, 5 , 6, 7, 8, 9, 10 और 11 में अंतर्विष्ट उपबंध 9 फरवरी , 2011 तक प्रवृत्त रहेंगे;" ;
(ख) इस प्रकार प्रतिस्थापित खंड (ग ) के पश्चात, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थातः-
" (घ) दूरसंचार अवांछनीय वाणिज्यिक संप्रेषण विनियम, 2007 (2007 का 4) के विनियम 12, 16 , 17 और 18 में अंतर्विष्ट उपबंध 28 फरवरी , 2011 तक प्रवृत्त रहेंगे ; ";

भारतीय दूरसंचार विनियामक प्राधिकरण ने अवांछनीय वाणिज्यिक संप्रेषणों के नियंत्रण के लिए एक प्रभावी तंत्र का उपबंध करने के लिए दूरसंचार वाणिज्यिक संप्रेषण उपभोक्ता अधिमान विनियम, 2010 (2010 का 6) दिनांक 1 दिसम्बर, 2010 जारी किए थे । विनियमों के विनियम 13, 14, 15, 16 और 17, 15 दिसम्बर, 2010 से क्रियान्वित किए जाने अपेक्षित थे, जबकि विनियम 3 , 4, 5, 6, 7, 8 , 9, 10 , 11 , 12, 18, 19, 20, 21 और 22, 1 जनवरी , 2011 से क्रियान्वित किए जाने अपेक्षित थे ।
2. इन विनियमों के प्रयोजन के लिए सृजित की जाने वाली वेबसाइट के सुरक्षा लेखापरीक्षा पहलुओं तथा इसमें अंतर्निहित अन्य प्रक्रियाओं को ध्यान में रखते हुए भारतीय दूरसंचार विनियामक प्राधिकरण ने यह आवश्यक पाया है कि उपर्युक्त विनियमों के क्रियान्वयन के लिए तारीखों को पुनःनिर्धारित किया जाए । तदनुसार, दूरसंचार वाणिज्यिक संप्रेषण उपभोक्ता अधिमान विनियम, 2010 (2010 का 6) दिनांक 1 दिसम्बर, 2010 के विनियम 1 के उप - विनियम (2) के खंड (ख) और खंड (ग) तथा विनियम 25 के खंड (ख ) और (ग) में 14 दिसम्बर, 2010 को तथा 28 दिसम्बर, 2010 को संशोधित किया गया है । इन संशोधनों के पश्चात, विनियमों के विनियमः 13 , 14, 15, 16 और 17 15 जनवरी , 2011 से क्रियान्वित किए जाने अपेक्षित थे, जबकि विनियम 3 , 4, 5, 6, 7 , 8 , 9, 10, 11 , 12, 18, 19, 20, 21 और 22 , 1 फरवरी , 2011 से क्रियान्वित किए जाने अपेक्षित थे ।
3. दूरसंचार विभाग के पत्र सं0 16-5/ 2009- एएस. III / (पार्ट) / (3)/1124 दिनांक 18.10.2011 के अनुसार, टेलीमार्केटिंग प्रयोजनों के लिए '70 ' लेवल से आरंभ होने वाली एक पृथक नम्बर श्रंखला आवंटित की गई है । इस श्रृंखला को प्रयोग मोबाइल तथा बुनियादी सेवा, दोनों ही के लिए किया जाना था । तदनुसार, विनियमों में उपबंध किए गए हैं । तथापि, दूरसंचार विभाग ने सं० 16-5 / 2009- एएस. III / (खंड IV) दिनांक 31 जनवरी , 2011 द्वारा एक पत्र जारी किया है जिसमें कहा गया है कि ' 70 ' से आरंभ होने वाली नम्बर श्रृंखला का बेहतर उपयोग करने के उद्देश्य से टेलीमार्केटरों के लिए मोबाइल नेटवर्क हेतु अब ' 140 ' अंकों से आरंभ होने वाला एक नया लेवल आवंटित किया गया है । आवंटित किए गए लेवल केवल लाइसेंसों की मोबाइल सेवाओं के लिए हैं । दूरसंचार विभाग की अधिसूचना के अनुसार समान नम्बरिंग स्कीम का प्रयोग बुनियादी तथा मोबाइल सेवाओं, दोनों के लिए नहीं किया जा सकता है । बुनियादी सेवाओं के लिए लेवल बुनियादी सेवाओं को प्रयोग करते हुए टेलीमार्केटिंग प्रचालनों के लिए सीएलआई के मुद्दे का समाधान कर दिए जाने के पश्चात आवंटित किए जाएंगे । यह नई श्रृंखला सभी एक्सेस सेवा प्रदाताओं द्वारा टेलीमार्केटर को संसाधनों के आवंटन से पूर्व क्रियान्वित की जानी अपेक्षित है । इस उद्देश्य के लिए सेवा प्रदाताओं द्वारा उनकी प्रणाली में विन्यास में परिवर्तन करने तथा नई श्रृंखला का परीक्षण के लिए उन्हें समय प्रदान किए जाने की आवश्यकता होगी ।

4. विनियम 17 के उप- वित्नियम 1.1 के अधीन विद्यमान उपबंधों के अनुसार, एक्सेस प्रदाताओं को किसी टेलीमार्केटर को पहले ही आवंटित किए गए दूरसंचार संसाधनों को 15 फरवरी , 2011 तक वापस ले लेता है । विनियम 17, 15 जनवरी , 2011 से प्रवृत्त हो चुका है तथा सेवा प्रदाताओं ने इन विनियमों के अनुसार नए संसाधन आवंटित कर दिए होंगे । तथापि, इन विनियमों के अधीन दूरसंचार अवांछनीय वाणिज्यिक संप्रेषण विनियम, 2007 (2007 का 4) के अनेक उपबंध 1 मार्च, 2011 तक जारी रहेंगे , जिनके लिए टेलीमार्केटरों के लिए अपेक्षित होगा कि विद्यमान संसाधन इनका अनुपालन करें । अतः विनियम 17 के उप- विनियम (11 ) में तदनुसार संशोधन किया गया है ।

The Telecom Commercial Communications Customer Preference (Third Amendment) Regulations , 2011

F. No. 305-17/2010- Qos. In exercise of powers conferred by section 36, read with sub - clause (v ) of clause (b ) and clause (c ) of sub - section ( 1 ) of section 11 of the Telecom Regulatory Authority of India Act , 1997 (24 of 1997) , the Telecom Regulatory Authority of India hereby makes the following regulations further to amend " The Telecom Commercial Communications Customer Preference Regulations , 2010 , namely: -
1. ( 1 ) These regulations may be called the Telecom Commercial
Communications Customer Preference (Third Amendment ) Regulations , 2011 .
(2) They shall come into force from the date of their publication in the official Gazette .
2. In sub - regulation (2) of regulation 1 of the Telecom Commercial Communications Customer Preference Regulations , 2010 (hereinafter referred to as the principal regulations ) , ---
(a) for clause (c) , the following clause shall be substituted , namely: -
" (c) Regulations 3 , 4 , 5 , 6, 7 , 8 , 9 , 10 and 11 of these regulations shall come into force on 10th day of the February , 2011 ; "
(b) after clause ( c) , so substituted , the following clause shall be inserted , namely: - 5

" (d) Regulations 12, 18, 19, 20, 21 and 22 of these regulations shall come into force on the 1st day of March , 2011. "
3. In regulation 17 of the principal regulations ,
(a) for sub - regulation ( 11 ) , the following sub- regulation shall be substituted, namely: -
"( 11) Every Access provider shall withdraw the telecom resources already allotted to a telemarketer from 28th February 2011. "
4. In regulation 25 of the principal regulations ,
(a) for clause ( c) , the following clause shall be substituted , namely: -
"(c) the provisions contained in regulations 3, 4 , 5 , 6 , 7 , 8 , 9, 10 and 11 of the Telecom Unsolicited Commercial Communications Regulations , 2007 (4 of 2007) shall remain in effect till the 9th day of February , 2011 ; "
(b) after clause (c) , so substituted, the following clause shall be inserted, namely:-
"(d) the provisions contained in regulations 12, 16 , 17 and 18 of the Telecom Unsolicited Commercial Communications Regulations , 2007 (4 of 2007) shall remain in effect till the 28th day of Feburary, 2011. "

Note 4 : The Explanatory Memorandum explains the objects and reasons of Telecom Commercial Communications Customer Preference (Third Amendment) Regulations , 2011 ( 1 of 2011 ) .
Explanatory Memorandum
The Telecom Regulatory Authority of India issued the Telecom Commercial Communications Customer Preference Regulation , 2010 ( 6 of 2010) dated the 1st December, 2010 to provide an effective mechanism for curbing unsolicited commercial communications . Regulation 13 , 14, 15, 16 and 17 of the regulations were required to be implemented with effect from the 15th day of December , 2010, while regulation 3 , 4 , 5 , 6 , 7 , 8 , 9 , 10 , 11 , 12, 18 , 19, 20 , 21 and 22 were required to be implemented with effect from the 1st day of January , 2011 .
2. Having regard to the aspect of security audit of the website to be created for the purpose of these regulations and the other processes involved , the Telecom Regulatory Authority of India has found it necessary to re- determine the dates for implementation of the aforesaid regulations . Accordingly , clause (b) and clause ( c) of sub - regulation (2) of regulation 1 and clause (b ) and clause (c) of regulation 25 of the Telecom Commercial Communications Customer Preference Regulations , 2010 (6 of 2010 ) dated the 1st December , 2010 have been amended on 14th December , 2010 and on 28th December , 2010. After these amendments , Regulation 13 , 14, 15 , 16 and 17 of the regulations were required to be implemented with effect from the 15th day of January , 2011 , while regulation 3 , 4 , 5 , 6 , 7 , 8 , 9 , 10 , 11 , 12 , 18 , 19 , 20 , 21 and 22 were required to be implemented with effect from the 1st day of February , 2011 .
3. As per the DoT letter No. 16-5 / 2009 - AS.III/ (pt . )/(3 )/ 1124 dated 18.10.2010 , a separate number series starting with ' 70 ' level has been allocated for telemarketing purpose . This series was to be used for both mobile as well as basic service . Accordingly provisions has been made in the regulations . However , DoT has issued a letter vide No. 16-5 /2009- AS.III / ( Vol . IV) dated 31st January , 2011 stating that in order to have better utilization of number series starting with ' 70 ' , new level starting with digits ' 140 ' has been allocated now for mobile network for telemarkters . The levels allocated are only for mobile services of the licenses . Same numbering scheme can not be used for both for basic and mobile services as per the notification of DoT . Levels for basic services will be allocated after resolving the issue of CLI for telemarketing operations using basic services . This new series will be required to be implemented by all access service providers before allocation of resources to telemarketer . For this purpose 7

time will be required by access providers to change the configuration in their system and testing of new series .
4. As per the existing provisions under sub- regulation 11 of regulation 17 , Access providers have to withdraw the telecom resources already allotted to a telemarketer by 15th February , 2011. Regulation 17 has come into force from 15th January, 2011 and service providers may have allotted the new resources as per the provisions of these regulation . However , various provisions of Telecom Unsolicited Commercial Communications Regulations , 2007 (4 of 2007) have been continued upto 1st March 2011 under these regulations , for which , telemarketer may required the existing resources to comply with it. Therefore , sub - regulation 11 of regulation 17 has been amended accordingly .
