सा.का.नि. 59 (अ). चूंकि वायुयान नियम , 1937 का और संशोधन करने के लिए वायुयान ( संशोधन ) नियम, 2010 का प्रारूप वायुयान अधिनियम, 1934 ( 1934 का 22 ) की धारा 14 की अपेक्षानुसार भारत सरकार , नागर विमानन मंत्रालय की दिनांक 23 दिसम्बर , 2010 की अधिसूचना संख्या सा.का.नि. 1006 ( अ ) के द्वारा प्रकाशित किए गए , जिसे ऐसे सभी व्यक्तियों जिनके उससे प्रभावित होने की संभावना है, से राजपत्र में इस अधिसूचना के प्रकाशित होने के तीस दिन की अवधि की समाप्ति से पूर्व आक्षेप और सुझाव आमंत्रित करते हुए इसकी प्रतियां सार्वजनिक रूप से उपलब्ध करायी गईं;
और चूंकि उक्त अधिसूचना की प्रतियां, दिनांक 24 दिसम्बर, 2010 को सार्वजनिक रूप से उपलब्ध करा दी गई थीं;
और चूंकि प्रारूप नियमों पर उक्त अधिसूचना में विनिर्दिष्ट अवधि में किसी भी व्यक्ति से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुए हैं;

अतः , अब , केन्द्रीय सरकार , उक्त अधिनियम की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए वायुयान नियम, 1937 में और आगे संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. (1) इन नियमों का संक्षित नाम वायुयान ( तीसरा संशोधन ) नियम , 2011 है ।
(2) ये सरकारी राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. वायुयान नियम , 1937 में ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) में नियम 3 में, खंड ( 48 ) के पश्चात्, निम्नलिखित खंड अंतःस्थापित किए जाएंगे अर्थात्:-
"(48क ) " सुरक्षा " से ऐसी स्थिति जिसमें व्यक्तियों को हानि या संपत्ति को नुकसान होने के जोखिम को, जोखिम पहचान और जोखिम प्रबंधन की निरंतर प्रक्रिया द्वारा सुरक्षा के स्वीकार्य स्तर से कम करना तथा बनाए रखना या नीचे रखना अभिप्रेत है ।
स्पष्टीकरण : इस खंड के प्रयोजन के लिए, " सुरक्षा का स्वीकार्य स्तर " सुरक्षा की ऐसी न्यूनतम डिग्री है जिसे प्रणाली द्वारा वास्तविक प्रयोग में सुनिश्चित किया जाना आवश्यक है ।

(48ख) सुरक्षा सिरीक्षण कार्य " से ऐसा कार्य अभिप्रेत है जिसके माध्यम से अभिसमय के अनुबद्धों में अंतर्विष्ट सुरक्षा संबंधी मानकों तथा सिफारिश की गई पद्धतियों तथा सहबद्ध प्रक्रियाओं को कार्यान्वित किया जाता है । "
3. उक्त नियमों को नियम 29ग को उसके उप-नियम ( 1 ) के रूप में संख्यांकित किया जाएगा और इस प्रकार संख्यांकित किए गए उप-नियम ( 1 ) के पश्चात् मिम्नलिखित उप- नियम अंतःस्थापित किया जाएगा अर्थात्: -
" (2 ) महानिदेशक राज्य सुरक्षा कार्यक्रम बनाएंगे और इसके कार्यान्वयन का निरीक्षण करेंगे ।
स्पष्टीकरणः-इस उप तिथम के प्रयोजन के लिए " राज्य सुरक्षा कार्यक्रम " से सुरक्षा सुधारने के उद्देश्यार्थ अपेक्षाओं और 'क्रियाकलापों का समाकलित समूह अभिप्रेत है । "
4. उक्त नियमों के नियम 29ग के पश्चात् निम्नलिखित नियम को अंतःस्थापित किया जाएगा अर्थात् :-
"29घ. सुस्क्षा प्रबंध प्रणालियां ( 1 ) वायुयान और विमानक्षेत्रों के प्रचालन , हवाई यातायात सेवाओं के उपबंध , कार्मिकों के प्रशिक्षण तथा वैर्मानिक उत्पादों के रख -रखाव , डिजाइन और निर्माण में संलग्न प्रत्येक संगठन, -
* (क) सुरक्षा प्रबंध प्रमणालियों की स्थापना और अनुरक्षण करेगा; तथा
(ख) महात्तिदेशक द्वारा यथा विनिर्दिष्ट प्ररूप और रीति से सुरक्षा प्रबंध प्रणालियों की निर्देशिका को तैयार करेगा और उसको महानिदेशक के अनुमोदनार्थ प्रस्तुत करेगा ।
2. महानिदेशक़ अथवा इस निमित्त उसके द्वारा सामान्य या विशेष लिखित आदेश द्वारा , प्राधिकृत कोई अन्य अधिकारी , किसी युक्तियुक्त सम्मय पर , सुरक्षा प्रबंध प्रणालियों का निरीक्षण कर सकेगा और संबंधित संगठन महानिदेशक अथवा इस प्रकार प्राधिकृत व्यक्ति के साथ निरीक्षण करने में सहयोग प्रदान करेगा ।
स्पष्टीकरण: इस नियम के प्रयोजन के लिए,-
( क) " सुरक्षा प्रबंध प्रणालियों " से सुरक्षा प्रबंध के लिए व्यवस्थित पद्धति है जिसमें आवश्यक संगठनात्मक ढांचा, जवाबदेही , नीतियां और प्रक्रियाएं सम्मिलित हैं ;
(ख) " सुरक्षा प्रबंध प्रणाली निर्देशिका " से ऐसा दस्तावेज़ अभिप्रेत है जिसमें सुरक्षा प्रबंध प्रणालियों से संबंधित सूचना अन्तर्विष्ट है । " [फा. सं. ए.वी. 11012/ 08/2010 --ए ]

NOTIFICATION

GS.R. 59(E) .- Whereas the Draft ofAircraft ( Amendment) Rules , 2010 further to amend the Aircraft Rules , 1937, was published, as required by Section 14 of the Aircraft Act , 1934 (22 of 1934 ) , vide notification of the Government of India in the Ministry of Civil Aviation number G.S.R. 1006 (E ) , dated 23rd December, 2010 , for inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette of India in which the said notification was published , were made available to public ;
Andwhereas copies of the said notification were made available to the public on the 24th December, 2010 ;
And whereas no objections or suggestions have been received from any person in respect of the draft rules within the period specified in the said notification;
Now, therefore, in exercise of the powers conferred by Section 5 of the said Aircraft Act , the Central Government hereby makes the following rules further to amend the Aircraft Rules , 1937 , namely: --
1. (1) These rules may be called the Aircraft (3rd Amendment ) Rules , 2011 .
(2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Aircraft Rules , 1937 ( hereinafter referred to as the said rules ) , in rule 3 , after clause (48 ) , the following clauses shall be inserted, namely :----
" (48A) " Safety " means the state in which the risk of harm to persons or of property damage is reduced to and maintained at or below an acceptable level of safety through a continuing process of hazard identification and risk management.

Explanation . For the purposes of this clause , " acceptable level of safety " is the minimum degree of safety that must be assured by a system in actual practice.
(48B) " Safety oversight function " means a function by means of which the safety- related standards and recommended practices and associated procedures contained in the Annexes to the Convention are implemented."
3. Rule 29C of the said rules shall be numbered as sub - rule ( 1 ) thereof and after sub - rule ( 1 ) so numbered, the following sub - rule shall be inserted , namely :--
"(2) The Director-General shall formulate the State Safety Programme and oversee its implementation.
Explanation. - For the purposes of this sub- rule, "State Safety Programme " means an integrated set ofrequirements and activities aimed at improving safety. "
4. After rule 29C of the said rules, the following rule shall be inserted , namely: -
"29D . Safety Management Systems . ( 1 ) Every organisation engaged in the operation of aircraft and aerodromes , provision of air traffic services , training of personnel , maintenance , design and manufacture of aeronautical products shall ,-
(a) establish and maintain Safety Management Systems ; and
(b) prepare a Safety Management Systems Manual in such form and manner as may be specified by the Director-General and submit the same to the Director-General for approval .
(2) The Director- General or any other officer authorised by him in this behalf by general or special order in writing, may, at any reasonable time, inspect the Safety Management Systems and the concerned organisation shall co -operate with the Director-General or the person so authorised to carry out the inspection.
Explanation . For the purposes ofthis rule ,--
(a) "Safety Management Systems " means a systematic approach to managing safety, including the necessary organisational structure , accountabilities , policies and procedures ;
(b) " Safety Management Systems Manual " means a document containing the information relating to the Safety Management Systems . "
