का.आ. 199(अ).-यतः , मै. लेनको सोलर प्राईवेट लिमिटेड, जो एक निजी संगठन है , ने छत्तीसगढ़ राज्य में ग्राम महरूमकुर्द एवं चवरढ़ाल , जिला राजनन्दगांव में एक क्षेत्र विशिष्ट सोलर विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम, 2005 (2005 का 28 ) ( जिसे एतपश्चात् उक्त अधिनियम कहा गया है) की धारा 3 के अंतर्गत प्रस्ताव किया है;
और यतः केन्द्र सरकार इस बात से संतुष्ट है कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अंतर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशेष आर्थिक जोन के विकास , प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप - धारा ( 10 ) के अंतर्गत दिनांक 10 मई, 2010 को अनुमोदन पत्र प्रदान कर दिया है ;
अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 की धारा 4 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियम , 2006 के नियम 8 के अनुसरण में , केन्द्र सरकार एतद्वारा निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्या और क्षेत्र को उपर्युक्त स्थान पर विशेष आर्थिक जोन के रूप में अधिसूचित करती है , अर्थात्ः-

और यतः , विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) की धारा 13 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्द्वारा उक्त अधिनियम की धारा 14 के प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति जिसे अनुमोदन समिति कहा जाएगा , गठित करती है , जिसके अध्यक्ष और सदस्य निम्नानुसार हैं , अर्थात्
--अध्यक्ष , पदेन 1. विशेष आर्थिक जोन का विकास आयुक्त
सदस्य , पदेन 2. निदेशक अथवा उप-सचिव , भारत सरकार , वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव , भारत सरकार से कम नहीं होगा
-सदस्य, पदेन 3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक
-सदस्य, पदेन 4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमा- शुल्क आयुक्त या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा
-सदस्य, पदेन 5. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले आयकर आयुक्त अथवा उसका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा

सदस्य, पदेन 6. निदेशक ( बैंकिंग ) , वित्त मंत्रालय , बैंकिंग प्रभाग , भारत सरकार
-सदस्य, पदेन 7. छत्तीसगढ़ सरकार द्वारा नामित किए जाने वाले दो अधिकारी जिनका स्तर संयुक्त सचिव से कम नहीं होगा
विशेष 8. मै . लेनको सोलर प्राईवेट लिमिटेड (जोन के विकासकर्ता ) का प्रतिनिधि आमंत्रिती और यतः , विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) की धारा 53 की उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा दिनांक 31 जनवरी , 2011 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उपर्युक्त विशेष आर्थिक जोन को सीमा शुल्क अधिनियम, 1962 (1962का 52) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

New Delhi , the 31st January, 2011
S.O. 199 (E) . Whereas , M/ s . Lanco Solar Private Limited, a private organization , has proposed under Section 3 of the Special Economic Zones Act, 2005 (28 of 2005) , (hereinafter referred to as the said Act) , to set up a sector specific Solar Special Economic Zone at Villages Mahroomkurd and Chawardhal , District Rajnandgaon in the State of Chhattisgarh;
And whereas , the Central Government is satisfied thatrequirements under sub - section ( 8 ) of Section 3 of the said Act, and other related requirements are fulfilled and it has granted letter of approval under sub - secion ( 10) of Section 3 of the said Act for development , operation and maintenance of the above sector specific Special Economic Zone on 10th May, 2010;
Now, therefore, the Central Government, in exercise ofthe powers conferred by sub -section ( 1 ) of Sectrion 4 of the Special Economic Zones Act, 2005 and in pursuance of rule 8 of the Special Economic Zones Act , 2006, hereby notifies the following area at above location with survey numbers given below in the table , as a Special Economic Zone , namely :-

Total 101.282 And, therefore, the Central Government , in exercise ofthe powers conferred by sub - secion ( 1 ) of Section 13 of the Special Economic Zones Act , 2005 (28 of 2005 ), hereby constitutes a Committee tobe called the Approval Committee for the above Special Economic Zone for the purposes of Section 14 of the said Act consisting of the following Chairperson and Members , namely :---
-Chairperson ex-officio 1. Development Commissioner ofthe Special Economic Zone
----Member , ex -officio 2. Director or Deputy Secretary to the Government of India , Ministry of Commerce and Industry, Department of Commerce or his nominee not below the rank of Under Secretary to the Government of India
-Member, ex-officio 3. Zonal Joint Director General of Foreign Trade having territorial jurisdiction over the Special Economic Zone
---Member, ex-officio 4. Commissioner of Customs or Central Excise having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank of Joint Commissioner
Member, ex-officio 5. Commissioner of Income Tax having territorial jurisdiction over the Special Economic Zone or his nominee not below the rank ofJointCommissioner
----Member, ex- officio 6. Director (Banking ) in the Ministry of Finance, Banking Division , Government of India
-Members , ex-officio 7. Two Officers , not below the rank ofJoint Secretary, to be nominated by the Government of Chhattisgarh
-Special Invitee 8. Representative of M/ s . Lanco Solar Private Ltd. ( Developer of the zone )
And , therefore , the Central Government , in exercise of the powers conferred by sub- section (2 ) of Section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ) , hereby appoints the 31st day of January, 2011 as the date from which the above Special Economic Zone shall be deemed to be Inland Container Depot under Section 7 of the Customs Act , 1962 (52 of 1962) .
