सा.का.नि. 61 (अ).- केन्द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए कतिपय नियमों का निम्नलिखित प्रारूप जिसे केन्द्रीय सरकार, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बनाने का प्रस्ताव करती है, उक्त अधिनियम की धारा 212 की उपधारा ( 1 ) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है ; और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको भारत के राजपत्र में यथाप्रकाशित इस अधिसूचना की प्रतियां जनता को उपलब्ध करा दी जाती हैं, साठ दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;
2. ऐसे आक्षेपों या सुझावों पर जो पूर्वोक्त अवधि की समाप्ति से पूर्व उक्त प्रारूप नियमों के संबंध में किसी व्यक्ति से प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ;
3. आक्षेप या सुझाव, यदि कोई हों, संयुक्त सचिव ( परिवहन) , सड़क परिवहन और राजमार्ग विभाग , परिवहन भवन , संसद् मार्ग, नई दिल्ली- 110001 को भेजे जा सकेंगे ।
प्रारूप नियम
1.
संशोधन) नियम, 2010 है ।
(1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान (
(2) जैसा अन्यथा उपबंधित है उसके सिवाय , ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

[PART II-SEC. 3 (i ) ] 2. केन्द्रीय मोटर यान्न नियम 1989 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 93 के उपनियम (6) में,-
(अ) स्पष्टीकरण 1 में खंड (ग) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :-
"(ग) तीन धुरी से अधिक धुरी वाले और आकुंचनशील धुरी वाले या उसके रहित यानों की दशा में चक्के का आधार, अगली धुरी के मध्यबिंदु और अपरिचारित धुरी के पिछले संयोजन के मध्य बिंदु की नापित दूरी होगी ।
टिप्पण-
(1) ' अकुंचनशील धुरी ' से ऐसी धुरी अभिप्रेत है जिसे प्रथम इंडेन्ट के अनुसार धुरी उत्थापक युक्ति द्वारा उठाया या गिराया जा सकता है ;
(ii) ' धुरी उत्थापक युक्ति' से यान की भरण शर्तों के अनुसार जब यान पूर्णरूप से भरा हुआ नहीं है तो टायरों की रगड़ को कम करने के अनुक्रम में या फिसलन वाले तल छट पर मोटरयान या संयोजनों वाले यानों के लिए सहजता से हटाने (खिसकाने) के अनुक्रम में चालन धुरी पर भार की वृद्धि करके या तो पहियों को उठाकर तलछट से अलग करने या पहियों को उठाए बिना तलछट से अलग करने ( अर्थात् ऐयर सस्पेंसन प्रणालियों या अन्य प्रणालियों की दशा में) धुरी (धुरियों) पर भार कम करने या बढाने के प्रयोजन के लिए यान में स्थायीरूप से फिट की गई युक्ति अभिप्रेत है ।
(आ) स्पष्टीकरण- II ( ख) में, -
) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :-
(क) खंड ( ii
" ( ii ) ऐसे यान की दशा में जिसमें सिर्फ तीन धुरी है और अगली धुरी ही केवल स्टीयरिंग धुरी है ' स्थायी ' या अंकुचनशील (उत्थापक धुरी) वाले पिछली धुरी (धुरियों) पर ध्यान दिए बिना वहां पृष्ठतम धुरी का मध्य बिंदु ।" ;
(ख ) खंड (4) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात् : -
" (4) केवल तीन धुरियों वाले किसी ऐसे यान की दशा में जिसके सामने की दो धुरी स्टीयरिंग धुरी है वहां ' स्थायी' या अंकुचनशील ( उत्थापक धुरी) वाली पिछली धुरी ( धुरियों) पर ध्यान दिए बिना पृष्ठतम धुरी का मध्य बिंदु ।" ;
(ग) खंड (5) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
"(4) चार या चार से अधिक धुरियों वाले किसी यान की दशा में, ' स्थायी' या अंकुचनशील (उत्थापक धुरी) वाली पिछली धुरी ( धुरियों) पर ध्यान दिए बिना वहां पृष्ठतम धुरी का मध्य बिंदु ।";
3. उक्त नियमों के नियम 95 के उपनियम (6) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात् : -
"(7) प्रवर्ग एम 1 , और एन 1 के यानों के लिए अस्थायी रूप से प्रयुक्त अतिरिक्त पहिया/ टायर और रन फ्लैट टायर, यदि वे यानों में प्रयुक्त सामान्य टायर से भिन्न हैं, भारतीय मानक ब्यूरो अधिनियम, भारत का राजपत्र असाधारण

1986 (1986 का 63) के अधीन अधिसूचित तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक, समय - समय पर यथासंशोधित एआईएस: 2009 के अनुरूप होंगे ।" ।
4. उक्त नियमों के नियम 124 क के उपनियम (7) के पश्चात् निम्नलिखित अंतःस्थापित किया
जाएगा, अर्थात् : -
" (8) 1 जनवरी , 2011 को और उसके पश्चात् भार पुंज, जहां कहीं भी यह कृषि ट्रैक्टर में प्रयुक्त होता है, भारतीय मानक ब्यूरो अधिनियम, 1986 ( 1986 का 63) के अधिसूचित किए जाने तक, समय- समय पर यथासंशोधित एआईएस 105: 2008 के अनुरूप होंगे ।" ।
(9) 1 जनवरी, 2011 को और उसके पश्चात् संरक्षी ढांचे, जहां कहीं भी यह कृषि ट्रैक्टर में प्रयुक्त होता है, यथास्थिति, आईएसः 11821 (भाग 1) 1992 या आईएस: 11821 (भाग 2)- 1992 के अनुरूप होगा ।
(10) 1 अप्रैल, 2011 को और उसके पश्चात् भार प्लेटफार्म, जहां कहीं यह कृषि ट्रैक्टर में प्रयुक्त होता है, भारतीय मानक ब्यूरो अधिनियम, 1986 ( 1986 का 63) के अधीन तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक, समय- समय पर यथासंशोधित एआईएसः 106-2009 के अनुरूप होगा ।
(11 ) 1 अप्रैल, 2011 को और उसके पश्चात् परिचारक सीट, जहां कहीं इसका उपयोग कृषि ट्रैक्टर में होता है, भारतीय मानक ब्यूरो अधिनियम, 1986 ( 1986 का 63) के अधीन तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक, समय - समय पर यथासंशोधित एआईएस: 111- 2009 के अनुरूप होगा ।
(12) 1 अप्रैल, 2011 को और उसके पश्चात् कृषि ट्रैक्टरों के लिए चालक क्षेत्र की दृष्टि सीमा भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63) के अधीन तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक, समय- समय पर यथासंशोधित एआईएस: 107-2009 के अनुरूप होगा ।
5. उक्त नियमों के नियम 125 के उपनियम (2) में, और पहले परंतुक के पश्चात् निम्नलिखित परंतुक जोड़ा जाएगा, अर्थात् : -
"परंतु यह और कि 1 अप्रैल, 2011 को और उसके पश्चात् कृषि ट्रैक्टरों के लिए रियर व्यू मिरर विनिर्देश और स्थापन अपेक्षाएं भारतीय मानक ब्यूरो अधिनियम, 1986 ( 1986 का 63 ) के अधीन तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक, समय - समय पर यथासंशोधित क्रमशः एआईएस: 001--2001 और एआईएस: 114--2009 के अनुरूप होंगे । " ।
6. उक्त नियमों के नियम 125ख के उपनियम (1 ) में, " डिफॉगिंग " शब्द के स्थान पर, "डीफ्रास्टिंग" शब्द रख जाएगा ।
7. उक्त नियमों के नियम 125ग में,
(क) उपनियम (1 ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्: - 4

" (1 ) 1 अप्रैल, 2011 को और उसके पश्चात् नए माडल के बसों की बाडी के निर्माण का परीक्षण और अनुमोदन भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63 ) के अधीन तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक उसमें उल्लिखित यानों के लिए , समय - समय पर यथासंशोधित एआईएसः 052 (पुनर्विलोकन 1 ) -2008 के अनुसार होगा :
परंतु इस नियम के उपबंध 1 अक्तूबर, 2011 को और उसके पश्चात् विद्यमान माडलों के लिए लागू होंगे ।";
(ख) उपनियम (2) के पश्चात्, निम्नलिखित उपनियम जोड़ा जाएगा , अर्थात् :-
" (3) अधिसूचित की जाने वाली तारीख को , प्रवर्ग एन 2 और एन 3 के माल यानों का, उसके केबिन, बाडी, कंटेनर, टैंकर और ब्यौरो की बाबत बाडी निर्माण के लिए परीक्षण और अनुमोदन भारतीय मानक ब्यूरो अधिनियम , 1986 ( 1986 का 63) के अधीन तत्स्थानी बीआईएस विनिर्देशों के अधिसूचित किए जाने तक उसमें उल्लिखित यानों के लिए , समय - समय पर यथासंशोधित एआईएस: 093-2008 के अनुसार होगा ।"
8. उक्त नियमों के नियम 138 के उपनियम (4) में --
(अ) खंड (क) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् : -
" (क) मोटरसाइकिल से भिन्न यानों की दशा में हैड लैंप के लिए अतिरिक्त बल्ब और फ्यूज का सैट और उपयोग के लिए तैयार एक अतिरिक्त पहिया :
परंतु एम 1 और एन 1 प्रवर्गों के यानों की दशा में अस्थायी प्रयुक्त अतिरिक्त पहियों के उपयोग को अनुज्ञात किया जाएगा और यदि ऐसे यानों में मानक फिटमैंट के अनुसार टन फ्लैट टायर फिट किए गए हैं तो उपयोग के लिए तैयार अतिरिक्त पहिए की सुविधा अनिवार्य नहीं होगी ।"
9. उक्त नियमों के प्ररूप 22- क में-
(i) [नियम 47 (छ) , नियम 115, नियम 124 (2) , नियम 126 क और नियम 127 (1 ), नियम 127 (2) देखिए ] " कोष्ठक, शब्द और अंकों के स्थान पर निम्नलिखित रखें, अर्थात् : -
[नियम 47 (छ) , नियम 115, नियम 124 (2) , नियम 125 ग, नियम 126 क , नियम 127 (1) , और नियम 127 (2) देखिए] "
( ii ) भाग-2 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् : -

(बाडी विनिर्माता द्वारा जारी किया जाएगा)
प्रमाणित किया जाता है कि निम्नलिखित यान की बाडी हमारे द्वारा बनाई गई है और उसमें मोटरयान अधिनियम, 1988 और उसके अधीन बनाए गए नियमों के उपबंधों का अनुपालन किया गया है :

2. चैसिस संख्या.
3. इंजन सं. /मोटर सं.
4. बस बाडी विनिर्माता एसेडीटेशन प्रमाणपत्र संख्यांक. तारीख .... .तारीख ... .तक विधिमान्य है ।
5. अनुमोदित परीक्षण अभिकरण द्वारा जारी बस बाडी प्रकार अनुमोदन प्रमाणपत्र संख्यांक. तारीख.....
(बाडी विनिर्माता के हस्ताक्षर)
[प्ररूप 22 क भाग 2 में ही सम्यक रूप से मुद्रित बाडी विनिर्माता के हस्ताक्षर से उसके स्याही प्रतिरूप हस्ताक्षर और बाडी विनिर्माता की मुहर लगा कर विनिर्माता द्वारा जारी किया जाएगा । ]
टिप्पण : - भाग 2 बसों के नए माडल पर 1 अप्रैल, 2011 को या उसके पश्चात लागू होगा और बसों के विद्यमान माडल पर 1 अक्तूबर, 2011 को या उसके पश्चात् लागू होगा । "

GS.R. 61 (E) . The following draft of certain rules further to amend the Central Motor Vehicles Rules , 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act , 1988 (59 of 1988), is hereby published as required by sub - section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of sixty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public;
2. Any objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be considered by the Central Government;
3. Objection or suggestion, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways , Transport Bhawan , Parliament Street , New Delhi - 110 001.

Draft Rules
1. (1) These rules may be called the Central Motor Vehicles ( Amendment) Rules, 2010.
(2) Save as otherwise provided, they shall come into force on the date of their publication in the Official Gazette .
2 In the Central Motor Vehicles Rules , 1989 (hereinafter referred as the said rules), in rule 93, in sub- rule (6) ,
(A) in the Explanation- I, for clause (c) , the following shall be substituted, namely:-
"(c) in case of vehicles having more than three axles , and fitted with or without retractable axle , wheelbase shall be the distance measured between the centre of the front- most axle and the centre point of rear combination of non- steered axles .
Note:-
(i) ' Retractable axle' means an axle which can be raised or lowered by the axle- lift device in accordance with first indent;
( ii ) 'Axle -lift device' means a device permanently fitted to a vehicle for the purpose of reducing or increasing the load on the axle( s) , according to the loading conditions of the vehicle, either by raising the wheels clear off the ground/ lowering them to the ground or without raising the wheels off the ground (e.g. in the case of air suspension systems , or other systems) , in order to reduce the wear on the tyres when the vehicle is not fully laden, or make starting (moving off) on slippery ground easier for motor vehicles or vehicle combinations, by increasing the load on the driving axle .
(B) in Explanation - II ( B) ,-
(a) for clause ( ii ), the following shall be substituted , namely: -
"(ii) in the case of a vehicle having only three axles and the front axle is the only steering axle , the centre point of the rearmost axle , irrespective ofrear axle( s) being ' fixed' or ' retractable ( lift axle)' . " ;
(b) for clause ( iv) , the following shall be substituted , namely: -
"( iv) in the case of a vehicle having only three axles where two front axles are steering axles , the centre point of the rearmost axle , irrespective of rear axle(s) being ' fixed' or ' retractable (lift axle) . " ;
(c) for clause (v) , the following shall be substituted, namely: -
"(v) in the case of a vehicle having four or more than four axles ; the centre point of the rearmost axle , irrespective of rear axle( s) being 'fixed' or ' retractable ( lift axle)' . " .

3. In the said rules, in rule 95 after sub- rule (6) , the following shall be inserted, namely:-
"(7) Temporary use spare wheel/ tyre and Run Flat Tyre for vehicles of categories Mland N1 , if they are different from the normal tyre used on the vehicle shall conform to AIS 110: 2009, as amended from time to time , till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) . " .
4. In the said rules, in rule 124 A, after sub- rule (7), the following shall be inserted, namely:
"(8) On and after the 1st January , 2011 , the ballast mass , wherever used in agriculture tractor , shall conform to AIS 105 : 2008 , as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) .".
(9) On and after the 1st January , 2011, the protective structures, whereever provided in agriculture tractor, shall conform to IS: 11821 (Part 1)- 1992 or IS: 11821 (Part 2)-1992, as the case may be.
(10) On and after the 1st April, 2011, the load platform, wherever used in agriculture tractors , shall conform to AIS: 106-2009, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) .
(11) On and after the 1st April, 2011 , the attendant's seat, wherever used in agricultural tractors , shall conform to AIS: 111-2009, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) .
(12) On and after the 1st April , 2011 , for agricultural tractors , the driver's field of vision shall conform to AIS: 107-2009, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) . " .
5. In the said rules , in rule 125, in sub- rule (2) , after the first proviso, the following proviso shall be added, namely:
"Provided further that on and after the 1st April , 2011, for agricultural tractors, the rear view mirror specifications and installation requirements shall conformto AIS: 001-2001 and AIS: 114- 2009 respectively, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) ." .

6. In the said rules, in rule 125 B, in sub-rule (1) , for the word " defogging" , theword "defrosting" shall be substituted .
7. In the said rules, in rule 125 C,
(a) for sub- rule ( 1) , the following shall be substituted , namely: -
"(1) On and after the 1st day of April, 2011, the testing and approval for body building of new model of buses shall be in accordance with AIS: 052 ( Revision 1)-2008, as amended from time to time for vehicles mentioned therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986):
Provided that the provisions of this rule shall be applicable for the existing models on and after the 1st day of October , 2011. " ;
(b) after sub- rule (2) , the following sub- rule shall be added, namely: -
"(3) On a date to be notified, the testing and approval for body building of goods vehicles of category N2 and N3 with respect to cabin , bodies , containers , tankers and details thereof shall be in accordance with AIS: 093- 2008, as amended from time to time for vehicles mentioned therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 ( 63 of 1986) . " .
8. In the said rules, in rule 138 , in sub- rule (4) -
(A) for clause (a) , the following shall be substituted, namely: -
"( a) In case of vehicles other than motorcycles, a set of spare bulbs for head lamps and fuses , and a spare wheel, ready for use:
Provided that in case of M1 and N1 categories of vehicles , use of temporary use spare wheel shall be permitted and the provision of ready to use spare wheel shall not be mandatory if such vehicles are fitted with Run Flat Tyres as standard fitment . " .
9. In the said rules , in Form 22 - A-
(i) for the brackets , word and figures " [ see rules 47( g ), 115,124(2), 126A and 127 (1 ) , 127(2) ] " , substitute the following , namely: -
"[ see rules 47( g ), 115,124(2) , 125 C, 126A, 127 (1 ) and 127(2) ] " ,
( ii) for PART - II, the following shall be substituted, namely: -

Certified that the body of the following vehicle has been fabricated by us and the same complies with the provisions of the Motor Vehicles Act, 1988, and the rules made thereunder:

[Form 22 -A Part II shall be issued with the signature of the body builder duly printed in the Form itself by affixing facsimile signature in ink under the hand and seal of the body builder. ]
Note : - PART - II shall be applicable for new model of buses on or after the 1st April, 2011 and for the existing model of buses on or after the 1st day of October, 2011. " .
