का.आ. 284(अ).- केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्यांक का.आ. 196 (अ) तारीख 6 मार्च, 2000 और अधिसूचना संख्यांक का.आ. 93 (अ) तारीख 22 जनवरी 2002 द्वारा कर्नाटक राज्य में राष्ट्रीय राजमार्ग सं . 7 के क्रमशः 535.000 कि.मी. से 539.000 कि.मी. , 527.000 कि.मी. से 535.000 कि.मी. और 539.000 कि.मी से 556.000 कि.मी. ( हैदराबाद बेंगलौर सेक्शन ) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है) को सौंपा था ;
और प्राधिकरण ने उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में , कर्नाटक राज्य में राष्ट्रीय राजमार्ग संख्या 7 के 534.720 कि.मी. से 556.000 कि.मी. ( प्रोजेक्ट चैनेज 534.720 कि.मी से 556.84 कि.मी ) ( देवनहल्ली बेंगलौर सेक्शन ) ( जिसे इसमें इसके पश्चात् उक्त सेक्शन कहा गया है ) तक के विद्यमान सेक्शन के उन्नयनीकरण , प्रचालन और अनुरक्षण के लिए मैसर्स नवयुग देवनहल्ली टोलवे प्राइवेट लिमिटिड जिसका रजिस्ट्रीकृत कार्यालय 1259 , लक्ष्मी टावर्स, रोड नम्बर 36, जुबली हिल्स, हैदराबाद 500033 ( जिसे इसमें इसके पश्चात् ' रियायतग्राही " कहा गया है) के साथ डिजाइन , निर्माण , वित्त, प्रचालन और स्थानांतरण के आधार पर एक करार किया है;
अतः , अब , केंद्रीय सरकार, राष्ट्रीय राजमार्ग फीस ( दरों का अवधारण और संग्रहण) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह अधिसूचित करती है कि उक्त खंड के उपयोग के लिए सारणी 1 और सारणी 2 में विनिर्दिष्ट यांत्रिक यानों के प्रवर्ग से उक्त सारणी में दी गई आधार फीस दरों पर फीस उद्ग्रहीत और संगृहीत की जाएगी और रियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से , इनमें से जो भी पश्चात्वर्ती हो, समाप्ति की तारीख तक उक्त फीस संगृहीत और प्रतिधारित करने के लिए प्राधिकृत करती है, अर्थात्ः-

विस्तार: - इस अधिसूचना के प्रयोजन के लिए , -
(1) (1) वास्तविक फीस से उक्त सेक्शन के सड़क उपयोक्ताओं से निम्नलिखित आधार पर प्रभारित वास्तविक फीस अभिप्रेत है ;
(क) परियोजना राजमार्ग की लम्बाई ;
(ख) उपर्युक्त सारणी में दी गई आधार फीस सम्यक रूप से सूचीबद्ध और पांच रूपये के निकटतम पूर्णांक में होगी ।
(ii) 'वाणिज्यिक प्रचालन की तारीख' से वह तारीख अभिप्रेत है जब उक्त सेक्शन के संबंध में प्राधिकरण और रियायतग्राही के बीच करार के अनुसार सभी पूर्ववर्ती शर्तों का समाधान करने के पश्चात् वाणिज्यिक प्रचालन प्रारंभ होता है ।
(iii ) ' समाप्ति की तारीख ' से वह तारीख अभिप्रेत है जब उपर्युक्त करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति की सूचना द्वारा समाप्त किया जाता है ।
(iv) उन शब्दों और पदों के जो इस अधिसूचना में प्रयुक्त है और इसमें परिभाषित नहीं है किन्तु प्राधिकरण और रियायतग्राही के बीच में हुए करार में परिभाषित हैं , वही अर्थ होंगे जो उक्त करार में हैं ।

2. फीस का संग्रहण निम्नलिखित अवस्थानों के पथकर प्लाजाओं पर प्रत्येक पथकर प्लाजा के सामने विनिर्दिष्ट दूरी के लिए किया जायेगा ।

2. राष्ट्रीय राजमार्ग 7 पर 538.000 कि.मी. 18.40 कि.मी. रोड सेक्शन और उपरगामी संरचना जिसकी लम्बाई 3.72कि.मी. है , जिसकी अनुमानित लागत दो सौ बीस करोड़ रुपए है ।
3. फीस के संदाय से छूट , अति फेरे हेतु यान के लिए फीस की दर, दरों में छूट आदि किसी भी व्यक्ति के अनुरोध पर रियायतग्राही उसे किसी मास में 50 (पचास) या उससे अधिक एकतरफा टिकटों, के लिए रियायती मूल्य, क्रमश: यान के लिए जो कि एकल यात्रा के लिए दो तिहाई शुल्क के बराबर होगा , जारी करेगा उक्त करार के उपबन्धों के अनुसार लागू होंगे ।
4. फीस का पुनरीक्षण पूर्ववर्ती पुनरीक्षण की तारीख से छः मास के भीतर नही किया जायेगा।

NOTIFICATION
New Delhi , the 7th February, 2011
S.O. 284 (E) . Whereas , the Central Government by notifications of the Government of India in the Ministry of Road Transport and Highways number S.O. 196 (E) , dated the 6th March , 2000 and S.O. 93 (E) , dated the 22nd January, 2002 issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988) , hereinafter referred to as said Act , entrusted the stretches from Km 535.000 Km 539.000 , Km 527.000 Km 535.000 and Km 539.000 Km 556.000 ( Hyderabad -Bangalore section) of National Highway No. 7 respectively in the State of Karnataka to the National Highways Authority of India ( hereinafter referred to as the Authority) ;
And whereas , pursuant to the powers conferred by section 14 of the said Act, the Authority has entered into an agreement with M/ s Navayuga Devanahalli Tollway Private Limited , having its registered office at 1259 , Lakshmi Towers , Road No. 36 , JubileeHills , Hyderabad 500033 ( hereinafter referred to as the Concessionaire ) for up gradation , operation and maintenance of the existing section from Km 534.720 to Km 556.000 ( project chainage from Km 534.720 Km 556.84 ) ( Devanhalli Bangalore section) of the National Highway No. 7 in the State of Karnataka (hereinafter referred to as the said section) on Design , Build , Finance , Operate and Transfer ( DBFOT) basis ;
Now , therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , read with the National Highways Fee (Determination of Rates and Collection) Rules , 2008 , the Central Government , hereby notifies that there shall be levied and collected fees on category of the mechanical vehicles , specified in the Table I and Table II for the use of said section at the base rate specified therein , and authorizes the said Concessionaire to collect and retain the fee subject to and in accordance with the said rules and the provisions of the said Concession Agreement on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date , namely: --

Explanation.- For the purpose of this notification , -
( i) " actual fee" means the fees actually charged from the road users of the said section on the basis of-
(a) length of the project highway ;
(b) base fee rates provided in the above Tables duly indexed , and shall be rounded off to nearest Five rupee;
(ii) "date of commercial operation " means the date on which commercial operation of the said section begins after satisfying all conditions precedent in accordance with the said agreement;
( iii ) " termination date" means the date on which the agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice ;
(iv) words and expressions used in this notification and not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section shall have the same meaning as assigned to them respectively in the said agreement .
2. The fee shall be collected at the following location of toll plaza for the distance specified:

3. Exemption from payment of fee , rates of fee for overloaded vehicles , discounts in rates etc shall be in accordance with the said rules . Upon request from any person for issue of tickets for fifty or more one way journey in a month , discounted rates equivalent to two third of fee for single journey for the respective vehicle as per the provisions of the said agreement shall be applicable.
4. No revision shall be effected within a period of six months from the date of the preceding revision of fee.
