अधिसूचना नई दिल्ली , 10 फरवरी , 2011 सं. 9/2011- सीमा- शुल्क ( गै . टै. )
सा.का.नि. 80 ( अ) . सीमा शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 75 , केन्द्रीय उत्पाद शुल्क अधिनियम , 1944 ( 1944 का । ) की धारा 37 तथा वित्त अधिनियम , 1994 ( 1994 का 32 ) की धारा 94 के साथ पठित धारा 93 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार सीमा शुल्क , केन्द्रीय उत्पाद शुल्क एवं सेवाकर प्रतिअदायगी नियमावली , 1995 को संशोधित करने के लिए पुनः निम्नलिखित नियमावली बनाती है , अर्थात् : -
1. ( 1 ) इन नियमों को सीमा शुल्क , केन्द्रीय उत्पाद शुल्क एवं सेवा कर प्रतिअदायगी ( संशोधन ) नियमावली , 2011 कहा जा सकता है ।
( 2 ) ये सरकारी राजपत्र में इनके प्रकाशन की तिथि से लागू होंगे ।
2. सीमा शुल्क, केन्द्रीय उत्पाद शुल्क एवं सेवा कर प्रतिअदायगी नियमावली , 1995 में ,-
( i ) नियम 3 में उप - नियम ( 1 ) में , दूसरे परन्तुक में खंड ( v ) में " शीर्ष 1006 , 2523 , 5205 , 5206 अथवा 5207 के अंतर्गत आने वाले " शब्द एवं आंकड़ों के लिए " शीर्ष 0401 , 0402 , 0403 , 0404 , 0405 , 0406 , 1006 , 2523 , 3501 , 5205 , 5206 अथवा 5207 के अंतर्गत आने वाले " शब्द एवं आंकड़े प्रतिस्थापित किए जाएंगे ;
( ii ) नियम 6 में , उप - नियम ( 4 ) में " शीर्ष 1006 , 2523 , 5205 , 5206 अथवा 5207 के अंतर्गत आने वाले " शब्द एवं आंकड़ों के लिए " शीर्ष 0401 , 0402 , 0403 , 0404 , 0405 , 0406 , 1006 , 2523 , 3501 , 5205 , 5206 अथवा 5207 के अंतर्गत आने वाले " शब्द एवं आंकड़े प्रतिस्थापित किए जाएंगे;
( iii ) नियम 7 में , उपनियम ( 5 ) में " शीर्ष 1006 , 2523 , 5205 , 5206 अथवा 5207 के अंतर्गत आने वाले " शब्द एवं आंकड़ों के लिए " शीर्ष 0401 , 0402 , 0403 , 0404 , 0405 , 0406 , 1006 , 2523 , 3501 , 5205 , 5206 अथवा 5207 के अंतर्गत आने वाले " शब्द एवं आंकड़े प्रतिस्थापित किए जाएंगे ।

राजेश कुमार , अग्रवाल , अवर सचिव टिप्पणी : मूल नियमावली भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप - खंड ( i ) में सा.का.नि. 441 ( अ ) , दिनांक 26 मई , 1995 के जरिए प्रकाशित हुई थी और इसमें अंतिम बार संशोधन अधिसूचना सं. 49 / 2010- सीमा शुल्क ( गै.टै. ) , दिनांक 17 जून , 2010 द्वारा सा.का.नि. 520 ( अ ) , दिनांक 17 जून , 2010 के जरिए किया गया था ।

GS.R. 80 ( E ). In exercise of the powers conferred by Section 75 of the Customs Act , 1962 ( 52 of 1962 ) . Section 37 of the Central Excise Act, 1944 ( 1 of 1944) and Section 93 A read with Section 94 of the Finance Act , 1994 (32 of 1994) , the Central Government hereby makes the following rules further to amend the Customs , Central Excise Duties and Service Tax Drawback Rules , 1995 , namely:-
1. ( 1) These rules may be called the Customs , Central Excise Duties and Service Tax Drawback ( Amendment ) Rules .
2011.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Customs , Central Excise Duties and Service Tax Drawback Rules , 1995. -
(i) in rule 3 , in sub - rule ( 1 ) , in the second proviso , in clause ( v) , for the words and figures " falling within heading 1006 . 2523,5205, 5206 or 5207 " , the words and figures " falling within heading 0401 , 0402, 0403 , 0404 , 0405 , 0406, 1006. 2523.3501 . 5205 , 5206 or 5207 " shall be substituted:
(ii) in rule 6, in sub - rule (4) , for the words and figures " falling within heading 1006, 2523 , 5205. 5206 or 5207 " , the words and figures " falling within heading 0401.0402 , 0403 , 0404, 0405 , 0406. 1006. 2523,3501,5205,5206 or 5207 " shall be substituted;
(iii ) in rule 7, in sub- rule ( 5 ) , for the words and figures " falling within heading 1006 , 2523 , 5205 , 5206 or 5207 " , the words and figures " falling within heading 0401, 0402 , 0403 , 0404 , 0405 , 0406, 1006, 2523 , 3501,5205 , 5206 or 5207 " shall be substituted.
