का.आ. 2027(अ) .- केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 (1988 का 68) की धारा 11 के अधीन जारी भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय (सड़क खंड ) की अधिसूचना संख्यांक का.आ. 78 (अ) तारीख 4 फरवरी , 1999 द्वारा आंध्रप्रदेश और उड़ीसा राज्य में राष्ट्रीय राजमार्ग सं. 5 के 0.00 कि.मी. से 233.00 कि.मी. ( विशाखापट्नम से उड़ीसा/ आंध्रप्रदेश बोर्डर सेक्शन ) और 233.00 कि.मी से 418.00 कि.मी (आंध्रप्रदेश / उड़ीसा बोर्डर से भुवनेश्वर सेक्शन ) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है) को सौंपा था:
अतः अब, केंद्रीय सरकार, राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संग्रहण) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह अधिसूचित करती है कि उड़ीसा और आंध्रप्रदेश राज्य में राष्ट्रीय राजमार्ग सं . 5 पर चार लेन के लोडापट्टी से पुईनटोला सेक्शन 216.15 कि.मी. से 284.00 कि.मी. ( नया चैनेज 477.054 कि.मी से 419.600 कि.मी तक ) ( कुल लम्बाई 57.454 कि.मी, इच्चापुरम बाईपास जिसकी लम्बाई 8.435 कि.मी है सम्मिलित है और जिसकी अनुमानित लागत 28.17 करोड़ है ) के उपयोग के लिए निम्नलिखित सारणी के स्तंभ (2) में यांत्रिक यानों पर स्तंभ (3 ) में विनिर्दिष्ट आधार दर पर फीस उदगृहीत और संगृहीत की जाएगी और प्राधिकरण को या तो अपने पदधारियों के माध्यम से या संविदाकार के माध्यम से उक्त फीस संग्रहित करने हेतु प्राधिकृत करती है अर्थात्:-

1. राजमार्ग सेक्शन पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किया जायेगा अर्थात् : --

2. जिस जिले में फीस प्लाजा पड़ता है वहां रजिस्टर किए गए वाणिज्यिक यानों ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर ) के लिए फीस उस श्रेणी के यानों के लिए निर्धारित दर का 50 % होगा परन्तु ऐसे वाणिज्यिक यानों के उपयोग के लिए कोई उपमार्ग अथवा वैकल्पिक सड़क उपलब्ध न हो ।
3. प्राधिकरण फीस का संग्रहण 45.054 कि.मी लम्बाई के लिए, 477.054 कि.मी से 432.00 कि.मी तक के खंड के पूरा होने के पश्चात् शुरू करेगा और 432.00 कि.मी से 419.60 कि.मी तक के खंड के पूरा होने पर फीस का संग्रहण पूरे खंड के लिए जिसकी लम्बाई 57.454 कि.मी है , पर किया जायेगा ।

4. फीस का उद्ग्रहण और संग्रहण निम्नलिखित अवस्थान के पथकर प्लाजा के सामने ऐसे पथकर प्लाजा के लिए विनिर्दिष्ट दूरी के लिए किया जायेगाः-
(क) 477.054 कि.मी से 432.000 कि.मी तक के खंड के पूरा होने पर :
पथकर प्लाजा का अवस्थान ( चेनेज)
राज्य में जिला सिरीकाकुलम आंध्रप्रदेश बेलुपाडा गांव , 473.632 कि.मी
लंबाई (कि.मी. म) जिसके लिए फीस संदेय है
सेक्शन 36.619 कि.मी लम्बाई और 8.435 कि.मी बाईपास के लिए ।
(ख) 477.054 कि.मी से 419.600 कि.मी तक के पूरे खंड के पूरा होने पर :
पथकर प्लाजा का अवस्थान (चेनेज)
आंध्रप्रदेश राज्य में जिला सिरीकाकुलम बेलुपाडा गांव , 473.632 कि.मी
लंबाई (कि.मी. म) जिसके लिए फीस संदेय है
सेक्शन 49.019 कि.मी लम्बाई और 8.435 कि.मी बाईपास के लिए ।

New Delhi , the 30th August , 2011
S.O. 2027 ( E) . Whereas , the Central Government , vide notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing ) number S.O. 78 ( E) , dated the 4th February, 1999, issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Central Government, entrusted the stretches from Km. 0.00 to Km . 233.00 (Vishakhapatnam to Orissa/Andhra Pradesh Border section) and Km. 233.00 to Km. 418.00 (Andhra Pradesh/Orissa Border to Bhubaneshwar section) of National Highway No. 5 in the State of Andhra Pradesh and Orissa respectively to the National Highways Authority of India ( hereinafter referred to as the Authority) ;
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956) , read with the National Highways Fee ( Determination of Rates and Collection) Rules , 2008 , the Central Government, hereby notifies that there shall be levied and collected fees on category of mechanical vehicles specified in column 2 of Table , for the use of the four lane Loddaputti to Puintola section from Km 216.15 Km 284.00 ( New chainage Km 477.054 Km 419.600) of National Highway No. 5 (total length being 57.454 kilometers , including Ichapuram bypass of 8.435 kilometers length with estimated cost of rupees 28.17 crores) at the base rate specified in column 3 of Table on the National Highway No. 5 in the State of Orissa and Andhra Pradesh and authorises the Authority to collect , either through its officials or through a contractor, the said fee , namely: - [PART II-SEC. 3 (ii)]

1. For multiple journey on the highway section , passes shall be issued at the following rates , namely;

2. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
3. The authority shall start collection of user fee for 45.054 Km length after completion of the stretch of Km 477.054 Km 432.00 Km and on completion of the stretch of Km 432.00 Km 419.60 the rates will be collected for the whole stretch of Km 57.454 .

4. The fee levied and collected hereunder shall be due and payable at the following toll plaza for the length specified for such Toll Plaza:
