सा.का.नि. 661 (अ).-महापत्तन न्यास अधिनियम, 1963 (1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) में प्रदत शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतंद्वारा विशाखापट्टणम पोर्ट ट्रस्ट के न्यासी मंडल द्वारा वही अधिनियम की धारा 123 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, बनाये गये विशाखापट्टणम पोर्ट ट्रस्ट (स्टीवडोर्स की लाईसेंसिंग एवं संबंधित मामले ) विनियम , 2011 जो और आंध्र प्रदेश सरकारी राजपत्र में इस अधिसूचना में संलग्न अनुसूची के विवरण में दी गई तिथि को प्रकाशित किया गया - को अनुमोदन देती है ।
2. उक्त अधिसूचना सरकारी राजपत्र में प्रकाशन कीतिथि सेलागू होगी ।

विशाखापट्टणम पोर्ट ट्रस्ट ( स्टीवडोर और संबद्ध मामलों का लाईसेसिंग ) अधिनियम , 2011
(क) " लघु शीर्ष" - " इन अधिनियमों को विशाखापट्टणम पोर्ट ट्रस्ट (स्टीवडोर और संबद्ध मामलों का लाईसेंसिंग ) अधिनियम, 2011 कहा जाएगा " ।
( ख ) ये राजपत्र में अंतिम प्रकाशन की तिथि से लागू होंगे ।
2. परिभाषा. इन अधिनियमों में जब तक प्रसंग से
अन्यथा अपेक्षित न हो

(क) " अधिनियम" का अर्थ महापत्तन न्यास अधिनियम,
1963 ।
(ख) " मंडल " का अर्थ अधिनियम के अंतर्गत यथा गठित विशाखापट्टणम पोर्ट ट्रस्ट का न्यासी मंडल है ।
(ग ) " अध्यक्ष " का अर्थ " मंडल के अध्यक्ष " से है ।
(घ) "फॉर्म" का अर्थ इन विनियमों में संलग्न फॉर्म से है ।
( च ) " पोर्ट " का अर्थ विशाखापट्टणम पोर्ट है ।
( छ ) " पोर्ट ट्रस्ट" का अर्थ विशाखापट्टणम पोर्ट ट्रस्ट है ।
(ज) -" स्टीवडोर " का अर्थ पोर्ट में वाहकों पर किसी भी रूप में कार्गो की लदाई , उतराई और स्टोवेज के लिए प्राधिकृत एजेंट से है जिसे अधिनियम 5( VI) के अंतर्गत लाइसेंस दिया गया है ।
(झ) " यातायात प्रबंधक " का अर्थ फिलहाल यातायात विभाग के विशाखापट्टणम पोर्ट के अधिकारी प्रभारी के रूप में वि पोटू के अधिकारी है और यातायात प्रबंधक के अधिकार में शामिल उप और सहायक हैं तथा यातायात प्रबंधक के अंतर्गत कार्य करते हैं ।
3 कार्यक्षेत्र:
स्टीवडोरिंग की गतिविधियाँ निम्नांकित हैं :
(क) पोर्ट द्वारा लिया गया स्टीवडोरिंग ।
(ख) लाईसेंस प्राप्त स्टीवडोर द्वारा स्टीवडोरिंग ।
(ग ) लाईसेंस करार में यथा उल्लिखित बीओटी टर्मिनल प्रचालक द्वारा स्टीवडोरिंग ।

स्टीवडोरिंग में समुद्री वाहक पर कार्यवाही सहित कर्मकार और निर्यात कार्गो (लदान) के लिए हुकिंग और आयात कार्गो की ( उतराई ) की अनुहुकिंग सहित जलमान पर कार्यरत कर्मकार अथवा पोर्ट में जो कार्यविधि चालू है , वे शामिल हैं ।
4. स्टीवडोरिंग प्रभारः
स्टीवडोरिंग सेवाओं के लिए प्रिंसिपल्स से स्टीवडोरों द्वारा स्टीवडोरिंग प्रभार वसूल किया जाता है , जिस में पोर्ट को चुकाए जानेवाले प्रभार शामिल होते हैं । प्रिंसिपल्स से स्टीवडोरों द्वारा वसूल किए जाने वाले प्रभार पार्टियों एवं मार्कट फोरसिस के आधार पर किये जाते हैं ।
स्टीवडोरिंग लाईसेंस जारी करने के लिए नियम और शर्त:- 5.
आवेदक, कंपनी अधिनियम के अंतर्गत पंजीकृत कम्पनी होना चाहिए अथवा भागीदारी फर्म या कोई अन्य विधिक सत्रा होनी चाहिए । : क)
आवेदक को कम से कम रू. 5 लाख की प्रतिभूति जमा करनी होगी ।
ख)
ग) स्टीवडोर्स को अपने या भाड़े के न्यूनतम उपस्कर / गियर की व्यवस्था करनी होगी ।
घ) स्टीवडोर्स को कार्गो संभलाई / स्टोवेज़ कार्य में न्यूनतम 2 वर्ष का अनुभव प्राप्त 4 पर्यवेक्षकों को नियोजित करना होगा । आवेदन पत्र के साथ उनके संक्षिप्त विवरण संलग्न करना होगा । (F च) लाईसेंस अवधि के लिए लाईसेंस जारी / नवीकरण के लिए न्यूनतम शुल्क रु. 50,000 होगा , जो समय समय पर संशोधित किया जाएगा ।
छ) स्टीवडोरिंग लाईसेंस जारी करना:
(1 ) जलयानों के बीच माल उतारने और नौचालन कार्य करने और पोर्ट के या बोर्ड के अधीन क्षेत्र में वार्फस , पीयर्स, क्वे या डॉक और पोर्ट के भीतर जलयानों के स्टीवडोरिंग में शामिल कोई अन्य कार्य करने के लिए , आवेदक व्यक्तियों को तीन वर्ष की अवधि के लिए यातायात प्रबंधक स्टीवडोरिंग लाईसेंस जारी कर सकता है ।
ज) इन अधिनियमों के अंतर्गत यातायात प्रबंधक द्वारा जारी किए गए लाईसेंस के बिना पोर्ट में समुद्री जहाजों पर काम करने के लिए अन्य किसी स्टीवडोर को अनुमति नहीं दी जाएगी ।
6. लाईसेंस की वैधता / नवीकरण
क) लाईसेंस जारी करने की तिथि से तीन वर्ष की अवधि तक लाईसेंस की वैधता होगी ।
ख) पोर्ट द्वारा निर्धारित न्यूनतम गारंटी उत्पादन / निर्धारित निष्पादन पैरामीटर प्राप्त करने के आधार पर लाईसेंस का पक्का नवीकरण किया जाएगा ।
ग) लाईसेंस समाप्त होने के कम से कम तीन महीने पूर्व पोर्ट के निर्धारित प्रोफॉर्मा में स्टीवडोर को लाईसेंस नवीकरण के लिए आवेदन पत्र देना होगा ।

घ) यदि स्टीवडोर आवश्यक शर्तों को पूरा करता है और नवीकरण के लिए योग्य है लेकिन , लाईसेंस अवधि समाप्त होने के पहले सुरक्षा अनुमति की प्रतीक्षा में है तो पोर्ट, क्षतिपूर्ति बन्ध- पत्र निष्पादित करने पर स्टीवडोरिंग प्रचालन कार्य की अनुमति दे सकता है ।
7. कार्य / उत्तरदायित्व:
(क) निम्नांकित आधारभूत मानदण्डों को दृष्टि में रखते हुए पोर्ट स्टीवडोरिंग लाइसेंसिंग नियमों के अनुसार सुरक्षित तथा दक्ष संभलाई को सुनिश्चित करने के लिए समय समय पर स्टीवडोरों के कार्य / उत्तरदायित्वों और निष्पादन पेरामीटर्स निर्धारित कर सकता हैं ।
(क) स्टीवडोर को ऐसे प्रचालन से संबंधित सभी स्वीकृत सुरक्षा पद्धत्तियों का पालन करना होगा
(ख) खराब गियर के उपयोग से होनेवाली हानि या क्षति के लिए स्टीवडोर ही उत्तरदायी होगा ।
)عل( ऐसे प्रचालनों से उत्पन्न सभी तीसरी पार्टी दावों के लिए स्टीवडोर मंडल को क्षतिपूर्ति करेगा ।
(घ) किसी प्रकार की दुर्घटना होने पर कर्मकार प्रतिकर अधिनियम के अनुसार दावों का निपटारां करना स्टिवडोर की जिम्मेदारी होगी ।.
(च) जब कभी नैमैत्तिक कर्मकार नियोजित किये जाये, स्टीवडोर को यह सुनिश्चित करना होगा कि ऐसे कर्मकार का जीवनबीमा किया गया है
(छ) ऐसे प्रचालनों के समय में बोर्ड के गियर प्लांट या कोई अन्य संपत्ति की हानि होने पर, स्टीवडोर ऐसी हानि या क्षति की पूर्ति बोर्ड को करेगा ।..
(ज) स्टीवडोर अनुसूचित प्रभार अग्रिम के रूप में पोर्ट को चुकायेगा ।
(झ) स्टीवडोर प्रतिवाहक के लिए समुचित पर्यवेक्षी कार्मिक नियोजित करेगा ।
(ख) उसे समय समय पर यातायात प्रबंधक द्वारा कर्मकारों की सुरक्षा, उत्पादकता में अभिवृद्धि, तथा श्रम अनुशासन के लिए जारी अनुदेशों का पालन करना होगा ।
8. लाईसेंस प्रदान करने / नवीकरण के लिए आवेदन पत्र:
क) स्टीवडोरिंग लाईसेंस देने नवीकरण के लिए आवेदन पोर्ट द्वारा निर्धारित प्रपत्र में किया जाना चाहिए ।
ख) इन विनियमों के अंतर्गत दिया गया / नवीकरण किया गया प्रत्येक लाईसेंस पोर्ट द्वारा निर्धारित ' प्रपत्र' में होना चाहिए ।
गं) लाईसेंस समाप्त होने की तिथि के बाद लाईसेंस नवीकरण के लिए प्राप्त आवेदन पत्रों पर विचार नहीं किया जाएगा, न
घ) मूल लाईसेंस खराब होने ग्रा बिगड़ जाने पर यातायात प्रबंधक को आवेदन और रू. 100/- भुगतान करके लाईसेंस की दूसरी प्रति प्राप्त कर सकते है ।

[PART II-SEC. 3 (1 ) ] 9. लाईसेंस का रद्ध होना / निलंबन:
क) स्टीवडोर को जारी की गई लाईसेंस , स्टीवडोर द्वारा लाईसेंस की किसी भी शर्त का उल्लंघन करने या नीचे सूचित किसी भी कारणों के लिए पोर्ट किये भी लगय में लाईसेंस रद्ध / निलंबित कर सकता है ।
क) स्टीवडोरिंग फर्म का सी ई ओ किसी गलती में शामिल होकर अदालत द्वारा नैतिक भृष्ट दोषी सिद्ध किया गया हो और उस के लिए बाद में दंड के रूप में छः महिने जेल में रहा हो और दण्ड समाप्त होने की तिथि से पाँच वर्ष की अवधि समाप्त नहीं हुआ हो ।
ख) फर्म, न्यूनतम गारंटी उत्पादन / पोर्ट द्वारा यथा निर्धारित पेरामीटरों से कम संभलाई करने पर ।
ग सुरक्षा अधिनियम और डॉक सुरक्षा उपाय आदेशों का उल्लंघन करने पर ।
घ) अनुपयुक्त और असुरक्षित संभलाई पद्धतियों को अपनाने पर ।
च) सामग्री सबंधी तथ्यों का गलत विवरण देने पर ।
छ) परिक्षीण न्यायनिर्णय या निर्धारण में पहुँचना ।
ज) पोर्ट में किसी कार्य में बाधा डालना ।
झ) स्टीवडोरिंग प्रचालन स्थानांतरित करना या किसी अन्य व्यक्ति या पक्ष को सबलेट करना ।
ट) सुरक्षा संबंधी नियम और आईएसपीएस कोड़ जैसे अनुदेशों आदि का उल्लंघन करना ।
कोई कदाचारा मंडल (वारेंट) के विचार में ऐसे रद्ध या निलंबन को न्यायजगत सिद्ध करता है ।
अनैतिक / भ्रष्टाचार में शामिल होना ।
ड)
ख) बशर्ते कि मामले के अनकुसार ऐसे लाइसेंस को दद्ध या निलंबित करने के लिए लाइसेंसधारी को उनके नद्ध या निलंबन के उचित कारनों को दिरपाने के लिए मौका दिये बिना उनका लाइसेंस रद्ध या निलंबन नहीं किया जाएगा ।
10. अपील:
लाइसेंस जारी करने को रद्ध / निलंबन / अस्वीकृति करने संबंधी किसी आदेश द्वारा व्यथित व्यक्ति उस आदेश की सूचना के 30 दिनों के अंदर मामले के अनुसार अध्यक्ष या किसी अन्य उच्च प्राधिकार को लिखित में उस आदेश के विरूद्ध अपील कर सकता है ।
11. पोर्ट / डीएलबी /लाईसेंस धारक या बाहर से कर्मकारों का नियोजन:
कर्मकारों की आपूर्ति के लिए स्टीवडोर द्वारा दी गई माँग के अनुसार पोर्ट, कर्मकारों की आपूर्ति करने में असफल होने पर स्टीवडोर को अपनी ओर से व्यवस्था करने के लिए अनुमति देगा ।

12. उत्पादन आदि के लिए डॉटम, नार्म
पिछले 3 वर्षों के दौरान निष्पादन ज्ञान की विधिवत जानकारी लेते हुए समय समय पर पोर्ट डॉटम, उत्पादन के लिए नार्मस्, प्रोत्साहन दर आदि का निर्धारण करेगा ।
13. प्रशिक्षण, नए तकनीकि का उपयोग
स्टीवडोरिंग गतिविधियों में नियोजित व्यक्तियों को उत्पादन एवं दक्षता में वृद्धि के लिए एवं सुरक्षा के लिए कार्गो संभलाई की नई पद्धतियों में प्रशिक्षित किया जायें
14. इन विनियमों में किसी अन्य बात के होते हुए भी, इन, विनियमों को जारी करने की तिथि में प्रवृत्त . स्टीवडोरिंग लाईसेंस को (ऐसा समझा जाता है कि) इन विनियमों के अंतर्गत ही जारी किया गया माना जाएगा और लाईसेंस की अवधि समाप्त होने तक इसकी वैधता जारी रहेगी ।

6. लाइसेंस नवीकरण के मामले में पूर्व अनुभव बदायें । (पिछले 3 वर्ष में स्टीवडोर्ड कार्गो और टनेज का विवरण दें । )

7. कर्मकार क्षति पूर्ति अधिनियम 1923 आदि के तहत मजदूरी , क्षतिपूर्ति के लिए वित्तीय क्षमता की राशि (वित्तीय क्षमता के लिए बैंकर्स से प्रमाण पत्र एवं आयकर क्लीयरेंस प्रमाण- पत्र प्रस्तुत करना होगा । )
8. क्या आवेदक ठेकाकृत पैसल , कार्गो की स्टीवडोरिंग के लिए समुचित गियर प्राप्त करने का इच्छुक है (आवश्यक प्रमाण पत्र सहित गियर की सूची प्रस्तुत करनी होगी । )
9. क्या आवेदन के पास / इस नियोजन में अनुभवी एवं नियम विनियमों से परिचित समुचित स्टाफ है / या लेने का इच्छुक है । (स्टाफ की सूची उनके अनुभव के साथ प्रस्तुत की जाये । )
10. क्या आवेदक ने विशाखपट्टणम पोर्ट ट्रस्ट, डॉक लेबर बोर्ड / विशाखपट्टणम स्टीवडोरिंग एसोसिऐशन के साथ किये कार्य के लिए सभी देय चुका दिये है । (भुगतान प्रमाण पत्र का प्रुफ प्रस्तुत करना. होगा । )
11. क्या लाइसेंस शुल्क , बयाना राशि, बैंक गारंटी के लिए एक लाख रूपये नकद का भुगतान कर दिया गया है ( भुगतान की रसीद लगई जाये । यदि लाइसेंस जारी नहीं किया गया / हटाया नहीं गया तो लाइसेंस फीस और जमा वापिस कर दिया जायेगा । )

NOTIFICATION
New Delhi , the 3rd September, 2011-
GS.R. 661 (E).-In exercise of the powers conferred by sub -section ( 1 ) of Section 124 read with sub-section ( 1 ) of Section 132 of the Major Port Trusts Act, 10 (38 of 1963 ), the Central Government Thereby approves with modification the Vaisakhapatnam Port.ust (Licensing of Stevedores ) Regulation, 2011 made by the Board of Trustees of Vaisakhapatnam Port in exercise of the powers conferred on them by Section 123 of the said Act, as detailed in the Schedule annexed to this Notification.
2. The said Notification shall come into force from the date of publication of this Notification in the Official Gazette .
SCHEDULE
THE VISAKHAPATNAM PORT TRUST (LICENSING OF STEVEDORES AND ALLIED MATTERS ) REGULATIONS , 2011
a) Short Title - These Regulations may be called "The Visakhapatnam Port Trust (Licensing of Stevedores and Allied Matters) Regulations , 2011 ".
b) They shall come into force with effect from the date of final publication in the Gazette .
2. Definitions - In these Regulations, unless the context otherwise requires: -
a) "Act" means the Major Port Trusts Act, 1963 .
b) "Board" means the (Major) Board of Trustees of the Port of Visakhapatnam as constituted under the Act.
c) " Chairman" means Chairman of the "Board " .
d) "Form" means form annexed to these Regulations .
e) "Port" means Visakhapatriam Port.
f) "Port Trust" means Visakhapatnam Port Trust.
g) "Stevedore" is an authorized agent for loading and unloading and stowage of cargo in any form on board the vessels in Ports and to whom the license has been given under regulation 5 (VI)
h) "Traffic Manager" means the Officer of the Visakhapatnam Port Trust for the time being in charge of the Traffic Department and includes the Deputies and Assistants to the Traffic Manager and any other Officers acting under the authority of the Traffic Manager .
3 Scope:
Stevedoring Covers the following activities:
a) Stevedoring undertaken by the port
b) Stevedoring by the licensed stevedore.
c) Stevedoring by the BOT terminal operator as prescribed in the License agreement
The Stevedoring may cover the activities on board involving workmen and extending to hooking for export (loading) cargo and unhooking of import (unloading) cargo involving workmen on- board or whatever practice prevalent in theport.

4 Stevedoring Charges
The Stevedoring charges are levied by the stevedores from the Principals for the Stevedoring services, which include the charges payable to the Port. Charges to. be collected by Stevedore from the principals is left to the parties and market forces .
5. Terms & Conditions For Issue Of Stevedoring Licence
a) The applicant shall be a Company registered under Companies Act or a partnership firm or any other legal entity .
b) The applicant shall deposit security of at least Rs . 5 lakhs
c) The Stevedores shall undertake to provide minimum equipment/gear either owned or hired.
d) The Stevedores should undertake to employ at least 4 Supervisory personnel with minimum two years of cargo handling /stowage experience . Their profiles have to be enclosed along with the application.
e) The fee for issue/renewal license shall be a minimum ofRs. 50,000 for the period of the license, which may be revised from time to time.
f) Issue of Stevedoring License ( 1 ) The Traffic Manager may issue stevedoring licenses for a period of three years on application to persons to act as Stevedores at the Port to perform the work of landing and shipping of goods between vessels in the Port and the wharves, piers, quays or docks belonging to or in the possession of the Board and any other work involved in the Stevedoring of Vessels within the Port .
g) No Stevedores shall be allowed to work on board any vessel in the Port except under a license issued by the Traffic Manager under these Regulations.
6. Validity /Renewal Of License
a) The License will be valid for a period of three years from the date of issuance of license.
b) The Licence will be strictly renewed on the basis of achieving minimum guaranteed through put/prescribed performance parameters as fixed by the port.
c) Application as per the prescribed proforma of the port for renewal of stevedores Licence shall be made at least three month before the expiry of the licence.
d) If the stevedore fulfils the required conditions and is eligible for renewal but awaiting safety clearance before expiry of the license period, port may permit the stevedoring operation by executing an indemnity bond.
7. Duties & Responsibilities
(A) Port may from time to time prescribe duties , responsibilities and performance parameters of stevedores to ensure the safe and efficient handling as per their stevedoring licensing rules, keeping in view the following basic criteria.
a) Stevedore shall comply with all accepted safe practices in relation to such operations

b) Stevedore shall be solely responsible for any accident or damage resulting from the useof defective gear
c) Stevedore shall indemnify the Board against all third party claims arising out of such operations.
d) In the event of any acci stevedore is liable to settle the clain as per de workmen'sCompensation Act .
e) Whenever casual workers are deployed, the stevedore should ensure that such worker are covered by the insurance policy
f) If the stevedore in the course of any such operations damages any gear, plant or any other property of the Board, the stevedore shall compensate the Board for such loss ordamage.
g) Stevedore shall pay scheduled charges to Port in advance .
h) The stevedore may deploy adequate supervisory personnel per vessel .
(B) He shall comply with such instructions as may be issued from time to time by the Traffic Manager in the interest of safety, improved productivity and labour discipline .
8. Application For Grant / Renewal Of License
a) The application for Grant / Renewal of Stevedoring License shall be made in the "form " which may be prescribed by the Port.
b) Every license granted or renewed under these Regulations shall be in the " form " which may be prescribed by the Port.
c) No application for renewal of licenses received after the date of expiry of the license will be considered .
d) In the event of loss or defacing of the original license, a duplicate license may be obtained on an application made to the Traffic Manager on payment of Rs.100/- .
9. Cancellation/Suspension Of Licence
A) The port may at any time suspend or cancel the license issued to a stevedore for violation of any of the terms of license or for any reasons listed below when .
a) The CEO of the stevedoring firm has been convicted by the Court of any offence involving moral turpitude and sentenced in respect thereof to imprisonment for not less than six months, and a period of five years has not elapsed from the date of expiry of the sentence .
b) The firm handles less than the minimum guaranteed throughout / the prescribed Parameters as fixed by the port.

c) Violates safety regulations and mandatory dock safety measures .
d) Adopts improper and unsafe handling methods
e) Misrepresents or misstates of material facts
f) Adjudged insolvent or going into liquidation
g) Causing obstruction to any work in the port.
h) Transfers the stevedoring operations or sublets the license to any other individual or parties.
i) Violates security related rules & instructions like ISPS code compliance etc. , j ) Any misconduct which in the opinion of the board warrant such Cancellation or . suspension
k) Indulges in Illegal/corrupt practices.
B) Provided that no such license shall be cancelled or suspended as the case may be until the holder of the license has been given a reasonable opportunity for showing ' cause why his license should not be cancelled or suspended as the case may be.
Appeal J
10.
Anyperson aggrieved by any order relating to cancellation /suspension/refusal to issue licenses, may prefer an appeal in writing to the Chairman or any other higher authority as the case may be within 30 days of the communication of the order appealed against .

13 Deployment Of Workers From Port / DLBs /License Holder. Or Outside.
In case the port is unable to supply the requisite workers against the requisition placed by stevedores, the port may allow the stevedores to make their own arrangement for this purpose.

12. Datum, Norms For Productivity, Etc.
Portmay determine Datum , Norms for productivity, rate of incentive etc. from time to time duly taking cognisance of the performance parameters during last 3 years.
Training, Use Of Modern Technology,
13.
The personnel deployed in stevedoring activities, shall be trained in modern methods of cargo handling for improving the productivity, efficiency and safety.
14. Not with standing any thing contained in these Regulations, Stevedoring licence which may be in force on the date of issue of these Regulation shall be deemed to have been issued under these Regulations and shall continue to be valid till the expiry of the period of such licences .

7 Amount of financial ability to meet obligations on account of wages , compensation under Workmen's Compensation Act 1923 etc. (A Certificate from the Bankers as to the financial ability and Income Tax Clearance Certificate is to be produced).
8 Whether the applicant his willing to acquire adequate gear for stevedoring the contracted Vessel , Cargo . (List of gear with necessary Certificate is to be furnished) .
