का.आ..2050(अं). जबकि आवेदक मैसर्स जीएमआर छत्तीसगढ़ एनर्जी लिमिटेड जिनका पंजीकृत कार्यालय स्किप हाऊस , 25/1 , म्यूजियम रोड , बंगलौर-560025 में है , ने जीएमआर छत्तीसगढ़ एनर्जी प्राइवेट लिमिटेड जेनरेटर स्विचयार्ड से रायपुर , छत्तीसगढ़ में पावरग्रिड पूलिंग स्टेशन तक अंतर- राज्य समर्पित 400 केवी डी/सी क्वाड लाईन एसीएसआर मूस ( क्वाड बंडलिंग ) बिछाने के लिए विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत अनुमोदन हेतु आवेदन किया है ।
और जबकि, भारत सरकार , विद्युत मंत्रालय ने पत्र सं. 11/2/2010- पीजी के द्वारा 8-11-2010 को जीएमआर छत्तीसगढ़ एनर्जी प्राइवेट लिमिटेड जेनरेटर स्विचयार्ड से रायपुर , छत्तीसगढ़ में पावरग्रिड पूलिंग स्टेशन तक समर्पित 400 केवी डी/सी क्वाड लाईन एसीएसआर मूस (क्वाड बंडलिंग ) ओवरहेड लाइन को बिछाने के लिए विद्युत अधिनियम , 2003 की धारा 68 के अंतर्गत मै. जीएमआर छत्तीसगढ़ एनर्जी लिमिटेड को अनुमोदन प्रदान किया था ।
और जबकि, आवेदक ने विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत वे सभी शक्तियां उसे प्रदान किए जाने का अनुरोध किया है जो सरकार द्वारा स्थापित अथवा अनुरक्षित करने अथवा कार्यों के लिए स्थापित अथवा अनुरक्षित किए जाने वाले टेलीग्राफ के उद्देश्य से टेलीग्राफ लाइनें तथा खंभे लगाने के संबंध में , भारतीय टेलीग्राफ अधिनियम, 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास हैं । स्कीम के अंतर्गत पारेषण लाइन निम्नलिखित गांवों , नगरों और शहरों में से , उन पर से , आस- पास से तथा बीच से होकर गुजरेंगी :

इसलिए, अब , सावधानीपूर्वक विचार करने के पश्चात्, भारत सरकार , विद्युत मंत्रालय विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत , अंतर - राज्यीय विद्युत पारेषण के लिए, अन्तर्राज्यीय पारेषण लाइनों हेतु उपर्युक्त उल्लिखित संस्थापना के लिए निम्नलिखित शर्तों एवं निबंधनों के अधीन , सरकार द्वारा स्थापित या देख - रेख या इस प्रकार स्थापित या देख - रेख किए जाने वाले टेलीग्राफ के उद्देश्य से टेलीग्राफ लाइनों और पोस्ट लगाने के संबंध में भारतीय टेलीग्राफ अधिनियम , 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास जो शक्तियां हैं, उन सभी शक्तियों को आवेदक को प्रदान करता है , अर्थात्:-
( i ) अनुमोदन 25 वर्ष के लिए प्रदान किया जाता है;
(ii ) आवेदक को प्रस्तावित लाइनों के निर्माण से पूर्व, संबंधित प्राधिकरणों अर्थात्स्थानीय निकायों, रेलवे राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी ;
(iii) आवेदक को पारेषण , ओ एंड एम, खुली पहुँच आदि के संबंध में उपयुक्त आयोग के विनियमों/ संहिताओं का पालन करना होगा ।

( iv ) आवेदक को छत्तीसगढ़ में जीएमआर छत्तीसगढ़ एनर्जी प्राइवेट लिमिटेड जेनरेटर स्विचयाई से रायपुर, छत्तीसगढ़ में पावरग्रिड पूलिंग स्टेशन तक समर्पित 400 केवी डी/सीक्वाड लाइन एसीएसआर मूस (क्वाड बंडलिंग ) को बिछाने का दायित्व सौंपा गया है । इस लाइन का ब्यौरा 25-9-2010 के भारत के राजपत्र में प्रकाशित किया गया है ।

(v ) आवेदक संबंधित राज्यों के मुख्य विद्युत निरीक्षक के अनुमोदन के पश्चात् लाइनों का प्रचालन करेगा । Villages :Gobda, Khamlarai, Gondgiri , Pahra, Ghatiya Khurd, Shivpuri , Khapri , Mudpar, Pand, Semariya, Pandmurdi , Kokdi , Hardi , Nandidni , Khundani , Pathariya , Medesara , Koriya, Hasada.
(vi ) यह अनुमोदन विद्युत अधिनियम , 2003 के प्रावधानों और उसके अंतर्गत बनाई गई नियमावली की अपेक्षाओं का आवेदक द्वारा अनुपालन किए जाने के अधीन है ।

New Delhi , the 8th September, 2011
Now, therefore , after careful consideration , Government of India, Ministry of Power , confers , under Section 164 of the Electricity Act, 2003 , all the powers on the applicant which telegraph authority possesses under the Indian Telegraph Act , 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by the Government or to be so established or maintained subject to following terms and conditions for installing the above mentioned interstate transmission lines for inter - state transmission of electricity, namely :-
(i) the approval is granted for 25 years ;
S.O. 2050 (E ) .- Whereas M/s .GMR Chattisgarh Energy Limited, the applicant with its Registered Office at Skip House, 25/1 , Museum Road , Bangalore 560025 , has applied for approval under Section 164 of the Electricity Act, 2003 for construction of dedicated 400 kV D/c line ACSR Moose (Quad bundling) from GMR Chattisgarh Energy Private Limited generator switchyard to PowerGrid Pooling Station at Raipur in Chattisgarh .
(ii) the Applicant shall have to seek the consent of the concerned authorities i.e. local bodies , Railways , National Highways , State Highways etc. before erection of proposed lines ;
(iii) the Applicant shall have to follow regulations / codes of the appropriate commission regarding transmission , O & M , open access etc; And whereas Government of India, Ministry of Power vide letter No. 11 /2/2010 - PG, dated 8-11-2010 had granted to M/ s . GMR Chattisgarh Energy Limited, approval under section 68 of the Electricity Act, 2003 for laying overhead transmission line for construction of dedicated 400 kV D/c line ACSR Moose (Quad bundling ) from GMR Chattisgarh Energy Private Limited generator switchyard to PowerGrid Pooling Station at Raipur in Chattisgarh .
(iv) the Applicant has been entrusted with the responsibility for construction of dedicated 400 kV D/c line ACSR Moose (Quad bundling) from GMR Chattisgarh Energy Private Limited generator switchyard to PowerGrid Pooling Station at Raipur in Chattisgarh . The details of the works are published in the Gazette of India of25-9-2010.
(v) the Applicant shall operate the lines after approval of Chief Electrical Inspector of respective States;
And whereas the Applicant has now requested to confer upon him all the powers under Section 164 of the Electricity Act, 2003 which telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by the Government or to be so established or maintained for the works . The transmission line covered under the scheme will pass through, over, around and between the following villages , towns and cities :-

(vi) the approval is subject to compliance by the Applicant to the requirement of the provisions ofTheElectricity Act, 2003 and the rules made thereunder.
