का.आ. 2056 (अ) .- केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग) की अधिसूचना संख्यांक का.आ. 977 (अ) तारीख 20 अप्रैल, 2009 द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग सं. 3 के 168.500 कि.मी. से 265.000 कि.मी. (मध्य प्रदेश/ महाराष्ट्र सीमा धुले सेक्शन) तक के खंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है) को सौंपा था ;
और प्राधिकरण ने उक्त अधिनियम की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में, महाराष्ट्र राज्य में धूले राष्ट्रीय राजमार्ग संख्या 3 के 168.500 कि.मी. से 265.000 कि.मी. (मध्य प्रदेश/ महाराष्ट्र सीमा सेक्शन ) ( जिसे इसमें इसके पश्चात् उक्त सेक्शन कहा गया है ) तक के खंड को चार लेन का बनाने के लिए विकास, प्रचालन और अनुरक्षण के लिए मैसर्स धुले प्लेसनर टोलवे लिमिटेड , जिसका रजिस्ट्रीकृत कार्यालय हिंकोन हाउस, लाल बहादुर शास्त्री मार्ग, विखरोली (पश्चिम ) , मुम्बई 400083 महाराष्ट्र (जिसे इसमें इसके पश्चात् 'रियायतग्राहीँ कहा गया है) के साथ डिजाईन, निर्माण, वित्त, प्रचालन और अंतरण के आधार पर एक करार किया है;
अतः अब, केंद्रीय सरकार, राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संग्रहण) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 की धारा 8 क द्वारा प्रदत्त शंक्तियों का प्रयोग करते हुए, यह - अधिसूचित करती है कि उक्त सेक्शन के उपयोग के लिए फीस सारणी I के स्तम्भ (2 ) में विनिर्दिष्ट प्रकार के यांत्रिक यानों पर सारणी I और सारणी II में विनिर्दिष्ट आधार दर पर फीस उक्त नियम और उक्त रियायत करार के प्रावधानों के अनुसार उदगृहीत और संगृहीत की जायेगी और रियायतग्राही को वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से इनमें से जो भी पश्चात्वर्ती हो , समाप्ति की तारीख तक उक्त फीस संगृहीत और प्रतिधारित करने के लिए प्राधिकृत करती है, अर्थात्:-

(i) वास्तविक फीस से उक्त सेक्शन के सड़क उपयोक्ताओं से निम्नलिखित आधार पर प्रभारित वास्तविक फीस अभिप्रेत है-
(क) प्रत्येक फीस प्लाजा के लिए समनुदेशित परियोजना राजमार्ग की लम्बाई ;
(ख) उपर्युक्त सारणी में दी गई आधार फीस दरें सम्यक् रूप से सूचीबद्ध और पांच रूपये के निकटतम पूर्णांक में होगी ।
(ii) ' वाणिज्यिक प्रचालन की तारीख ' से वह तारीख अभिप्रेत है जब उक्त करार के अनुसार पूर्णता प्रमाण पत्र या अंतिम पूर्णता प्रमाण पत्र जारी किया जाता है ।
(iii) ' समाप्ति की तारीख ' से वह तारीख अभिप्रेत है जब प्राधिकारी और रियायतग्राही के बीच में किया गया करार, उक्त करार के उपबंधों के अनुसरण में समाप्त होता है या समाप्ति की सूचना द्वारा समाप्त किया जाता है ।

(iv) उन शब्दों और पदों के जो इस अधिसूचना में प्रयुक्त है और इसमें परिभाषित नहीं है किन्तु जो कि प्राधिकरण और रियायतग्राही के बीच में उक्त सेक्शन की बाबत हुए करार में परिभाषित हैं , क्रमशः वही अर्थ होंगे जो उक्त करार में हैं।
2. वर्ष 2007-08 के लिए स्थानीय निजी यातायात के लिए मासिक पास की दर 150 रुपये (एक सौ पचास रुपये) है, जो राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संग्रहण) नियम, 2008 के उपबन्धों के अनुसार प्रत्येक वर्ष पुनरीक्षण के अध्यधीन है ।.
3. राजमार्ग सेक्शन पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किए जाएगे, अर्थात्-

4. फीस का पुनरीक्षण पूर्ववर्ती पुनरीक्षण की तारीख से छः मास की अवधि के भीतर नही किया जायेगा।
5. फीस का संग्रहण निम्नलिखित अवस्थानों के पथकर प्लाजाओं पर प्रत्येक पथकर प्लाजा के सामने विनिर्दिष्ट दूरी के लिए किया जायेगा:

सेक्शन 45.600 कि.मी और ताप्ती नदी पुल जो कि लगभग 0.600 कि.मी लम्बा है , जिसकी अनुमानित लागत 51.40 करोड़ रुपये है और वन्य जीव अनेर बांध अभ्यारण्य बाईपास जो कि लगभग 5.80 कि.मी लम्बा है जिसकी अनुमानित लागत 64.64 करोड़ रुपये है ।
2. 244.500 कि.मी
लगभग 35.00 कि.मी. लम्बे सेक्शन के लिए और नारादाना बाईपास जो कि लगभग 2.00 कि.मी लम्बा है, जिसकी अनुमानित लागत 56.00 करोड़ रुपये है ।
6. फीस के संदाय से छूट, अतिभराई वाहनों के लिए फीस की दर दर में छूट उक्त नियमों के अनुसार किया जाएगा ।

NOTIFICATION
New Delhi , the 8th September, 2011
S.O. 2056(E ) .- Whereas, the Central Government, by notification of the Government of India in the erstwhile Ministry of Shipping , Road Transport and Highways (Department of Road Transport and Highways) number S.O. 977 (E), dated the 20th April, 2009, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988) , ( hereinafter referred to as said Act ) , has entrusted the stretch from Km 168.500 Km 265.000 ( Madhya Pradesh /Maharashtra Border- Dhule section) of national highway No. 3 in the State of Maharashtra to the National Highways Authority of India (hereinafter referred to as the Authority) ;

And whereas , pursuant to the provisions of section 14 of the said Act, the Authority has entered into an agreement with M/ s Dhule Palesner Tollway Limited, having its registered office at Hincon House, Lal Bahadur Shastri Marg , Vikhroli ( West) , Mumbai 400 083 (hereinafter referred to as the Concessionaire) for the development, operation and maintenance of the section from Km 168.500 265.000 (Madhya Pradesh / Maharashtra Border- Dhule section) of the National Highway No. 3 in the State of Maharashtra ( hereinafter referred to as the said section) to four lane divided carriageway on Design , Build, Finance, Operate and Transfer ( DBFOT) basis; to Km
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956, read with the National Highways Fee (Determination of Rates and Collection) Rules, 2008, the Central Government, hereby notifies that there shall be levied and collected fees on type of mechanical vehicles specified in Column (2) of the Table ( I ), for the use of said section at the base rate specified in Table I and Table II thereof and authorizes the said concessionaire to collect and retain the fee subject to and in accordance with the said rules and the provisions of the said concession agreement on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date, namely: -- भारत का राजपत्र:

1. For the purpose of this notification, -
(i) " actual fee " means the fees actually charged from the road users of the said section on the basis of- ar
(a) length of the project highway assigned at each toll plaza;
(b) base fee rates provided in the above Table duly indexed, and shall be rounded off to nearest Five rupee;
(ii) "date of commercial operation" means the date on which Completion Certificate or the Provisional Completion Certificate is issued in accordance with the said agreement;

(iii) "termination date" means the date on which the agreement entered into between the Authority and the Concessionaire expires pursuant to the provisions of the said agreement or is terminated by termination notice;
(iv) words and expressions used in this notification and not defined but defined in the agreement entered into between the Authority and the Concessionaire in respect of the said section shall have the same meaning as assigned to them respectively in the said agreement.
2. The rate of monthly pass for local personal traffic is Rs . 150.00 ( One Hundred fifty Rupees) for the year 2007-08 which is subject to revision every year as per the provisions of the National Highways Fee ( Determination of Rates and Collection) Rules,2008.
3. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

4. No revision shall be effected within a period of six months from the date of the preceding revision of fee.
