सा.का.नि. 675 ( अ ).-राष्ट्रीय अध्यापक शिक्षा परिषद् अधिनियम , 1993 ( 1993 की सं. 73 ) की धारा 31 ( 2 ) ( छ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, एतद्वारा , राष्ट्रीय अध्यापक शिक्षा परिषद् नियम , 1997 में निम्नलिखित पुनः संशोधन करती है अर्थात्:-
1. ( 1 ) इन नियमों को राष्ट्रीय अध्यापक शिक्षा परिषद् ( तृतीय संशोधन ) नियम , 2011 कहा जाएगा ।
(2 ) ये 1 अप्रैल , 2012 से लागू होंगे।
2. राष्ट्रीय अध्यापक शिक्षा परिषद् नियम , 1997 ( जिसे इसमें आगे मूल नियमावली कहा गया है ) के नियम 9 में अंक " 40,000 " के स्थान पर अंक " 50,000 " प्रतिस्थापित किया जाएगा ।
3. मूल नियमों में , मौजूदा नियम के स्थान पर नियम 10 नीचे दिए अनुसार प्रतिस्थापित किया जाएगा , अर्थात्:-
10 ( 1 ) एनसीटीई अधिनियम की धारा 14 अथवा धारा 15 के अंतर्गत दिए गए अस्वीकृति आदेश अथवा धारा 17 के अंतर्गत दिए गए प्रत्याहरण आदेश से असंतुष्ट कोई व्यक्ति इन आदेशों के जारी होने के साठ दिन के अंदर इन नियमों के साथ परिशिष्ट के रूप में संलग्न फार्म 1 अथवा फार्म 2 में परिषद् से अपील कर सकता है। अपील प्रस्तुत करने के साथ 10,000 रुपए का शुल्क ऑनलाइन देय होगा :
परंतु शर्त यह है कि कोई अपील साठ दिन की उक्त अवधि के समाप्त हो जाने के बाद भी अस्वीकार की जा सकती है यदि अपीलकर्ता परिषद् को संतुष्ट कर देता है कि साठ दिन की सीमित अवधि के अंदर अपील प्रस्तुत नहीं करने के लिए उसके पास पर्याप्त कारण हैं।
2. अपील 10,000 रुपए के प्रक्रिया शुल्क के साथ राष्ट्रीय अध्यापक शिक्षा परिषद् की वेबसाइट पर ऑनलाइन पद्धति के जरिए इलेक्ट्रानिक माध्यम से प्रस्तुत की जा सकती है । अपीलकर्ता भरे हुए ऑनलाइन आवेदनपत्र को डाउनलोड करेगा और अपेक्षित दस्तावेजों के साथ हार्ड प्रतियों के दो सेट अपील को ऑनलाइन प्रस्तुत करने के दो दिन के अंदर सदस्य सचिव, एनसीटीई, नई दिल्ली को डाक द्वारा भेजेगा ।

महोदय,
उपर्युक्त अपीलकर्ता निम्नलिखित तथ्यों और आधारों पर राष्ट्रीय अध्यापक शिक्षा परिषद् अधिनियम , 1993 की धारा 18 के अंतर्गत अपील का ज्ञापन प्रस्तुत करता है : 1. ( क) अपीलकर्ता ने राष्ट्रीय अध्यापक शिक्षा परिषद् अधिनियम, 1993 ( 1993 का 73 ) की धारा 14/15 के अंतर्गत पाठ्य के लिए मान्याता हेतु दिनांक ...को भुवनंश्वर/ भोपाल/जयपुर/ बंगलौर स्थित पूर्वी/पश्चिमी/उत्तरी /दक्षिण क्षेत्रीय समिति के समक्ष अपील की थी ।
(ख) क्षेत्रीय समिति ने दिनांक कारणों से मान्यता देना अस्वीकार कर दिया है । के अपने आदेश , जिसकी एक प्रति यहां संलग्न है , के जरिए निम्नलिखित
अपीलकर्ता अनुरोध करता है कि क्षेत्रीय समिति द्वारा मान्यता प्रदान की जानी चाहिए थी । क्षेत्रीय समिति ने इस मामले का निर्णय करने में त्रुटि की है और इस बात के निम्नलिखित आधार हैं :

1. राष्ट्रीय अध्यापक शिक्षा परिषद् अधिनियम , 1993 ( 1993 का 73 ) की धारा 14/15 के अंतर्गत अपीलकर्ता को भुवनेश्वर/भोपाल/जयपुर/बंगलौर स्थित क्षेत्रीय समिति ने दिनांक क्षेत्रीय समिति द्वारा दिनांक को मान्यता प्रदान की गई थी। के अपने आदेश , जिसकी एक प्रति यहां संलग्न है , के जरिए निम्नलिखित आधार पर मान्यता/अनुमति वापस ले ली है। अपीलकर्ता अनुरोध करता है कि क्षेत्रीय समिति ने इस मामले पर निर्णय करने में त्रुटि की है और इस बात के निम्नलिखित आधार हैं :

NOTIFICATION
New Delhi , the 13th September, 2011
GS.R. 675 (E) . In exercise of powers conferred by Section 31 (2) ( g) of the National Council for Teacher EducationAct, 1993 (No. 73 of 1993 ) , the Central Government hereby makes the following further amendments to the National Council for Teacher Education Rules , 1997, namely :-
1. (1 ) These Rules may be called the National Council for Teacher Education (Third Amendment) Rules , 2011 .
(2) They shall come into force from the 1st ofApril , 2012.
2. In the National Council for Teacher Education Rules , 1997 ( hereinafter referred to as principal Rules ) , in rule9, for the figure " 40,000", the figure " 50,000 " , shall be substituted.
3. In the principal Rules , rule 10, for the existing rule, the following shall be substituted, namely: - 10 (1) Any person aggrieved by a refusal order made under Section 14 or Section 15 or withdrawal order made under Section 17 of the NCTE Act, may prefer an appeal in Form I or Form II appended to these Rules , to the Council within Sixty days of issue of such orders , along with a fee of Rs . 10,000/- payable online with the submission of appeal :
Provided that an appeal may be admitted after the expiry of the said period of sixty days , if the appellant satisfies the Council that he had sufficient cause for not preferring the appeal within the period of limitation of sixty days .
(2) The appeal may be submitted electronically through online mode on the website of National Council for Teacher Education along with processing fee ofRs . 10,000/- . The appellant shall download the filled in online application and post two sets of hard copies accompanied with the requisite documents , to the Member Secretary, NCTE, New Delhi within two days of online submission of the appeal .
