का.आ. 2086(अ).-केन्द्रीय सरकार की राय है कि अनुबद्ध अनुसूची में उल्लिखित मार्ग के अनुसार लोक प्रयोजन के लिए कोलकाता शहर में नौपाड़ा से दक्षिणेश्वर तक भूमिगत रेल के संन्निर्माण और उससे संबंधित अन्य संकर्म अपेक्षित है अथवा समीचीन है;
और केन्द्रीय सरकार का यह समाधान हो गया है कि सम्यक सतर्कता बरती जाए जिससे कि भूमि , भवन , गली , सड़क, रास्ते, नाले आदि के स्वामी या अधिभोगियों को न्यूनतम असुविधा या कठिनाई का सामना करना पड़े और नौपाड़ा से दक्षिणेश्वर तक भूमिगत रेल के संन्निर्माण के लिए रेखांक में दर्शाए अनुसार भूमि, भवन, गली , सड़क, रास्ते , नाले आदि में उपयोगकर्ता के अधिकार का अर्जन करना अनिवार्य है;
अनुसूची में उल्लिखित क्षेत्र के रेखांक का निरीक्षण , महाप्रबंधक , भूमिगत रेल, कोलकाता या उनके नामनिर्देशिती के कार्यालय में किया जा सकेगा;
अतः अब केन्द्रीय सरकार, भूमिगत रेल ( संकर्म संन्निर्माण ) अधिनियम, 1978 ( 1978 का 33 ) की धारा 21 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त अधिनियम की धारा 21 की उप- धारा ( 1 ) के खंड ( क ) के अधीन यह निदेश देती है कि इस अधिसूचना की तारीख से आगामी एक वर्ष के भीतर प्रस्तावित भूमिगत संरचनाओं के किसी भी ओर अनुबद्ध अनुसूची में उल्लिखित प्रस्तावित भूमिगत सरेखण या विभिन्न चौड़ाइयों के भीतर किसी भी भूमि के ऊपर कोई भवन नहीं बनाया जाएगा और न ही कोई अन्य संन्निर्माण कार्य किया जाएगा;
2. जहां उक्त अनुसूची में उल्लिखित ऐसी भूमि पर पहले से ही कोई भवन या संरचना अथवा जन उपयोगी सुविधाएं विद्यमान है वहां प्रस्तावित भूमिगत लाइनों के संन्निर्माण क्रिया- कलापों को या उनके निष्पादन को सुनिश्चित करने के लिए उन्हें तोड़ना या परिवर्तित करना अपेक्षित हो सकेगा ।
3. प्रत्येक व्यक्ति उक्त अधिनियम की धारा 21 की उप- धारा ( 5 ) में यथा-विनिर्दिष्ट , निदेशों का अनुपालन करने के लिए आबद्ध होगा ।
4. ऐसे किसी व्यक्ति को , जिसे इन निदेशों के परिणामस्वरूप कोई हानि या नुकसान हुआ है , ऐसी रकम संदत्त की जाएगी जो सक्षम प्राधिकारी द्वारा प्रथमतः अवधारित की जाएगी , यदि सक्षम प्राधिकारी द्वारा अवधारित रकम किसी भी पक्षकार को स्वीकार्य नहीं है तो उस रकम का अवधारण , सक्षम प्राधिकारी के आदेश की तारीख से साठ दिन के भीतर किसी भी पक्षकार द्वारा अपील प्राधिकारी को की गई अपील के आधार पर, अपील प्राधिकारी के आदेश द्वारा किया जाएगा ।

NOTIFICATION
New Delhi , the 15th September, 2011
S.O. 2086 (E ) . Whereas the Central Government is of the opinion that it is necessary or expedient for facilitating the construction of Metro Railway from Noapara to Dakshineswar in the city of Kolkata and other works connected therewith for public purpose, as per route mentioned in the accompanying ,Schedule ;
And whereas the Central Government is satisfied that due care has been taken so that minimum inconvenience and hardships are caused to the owners or occupiers of the land, building, street, road, passage , nullah etc. and the acquisition of the right of the user in the land , building, street , road , passage , nullah etc. shown in the plan is inescapable for construction of Metro Railway from Noapara to Dakshineswar ;
And whereas the plan of the area, mentioned in the said Schedule may be inspected in the Office of the General Manager , Metro Railway , Kolkata or his nominees ;
Now, therefore , in exercise of the powers conferred by sub - section ( 1 ) of section 21 of the Metro Railways ( Construction of Works) Act, 1978 (33 of 1978 ) (hereinafter referred to as the said Act) , the Central Government hereby directs under clause (a) of sub - section ( 1 ) of section 21 of the said Act that no building or any other construction shall be made or done above the proposed Metro alignment or on any land within the various widths mentioned in the accompanying Schedule on either side of the proposed Metro structures within one year from the date of publication of this notification;
2. Where, there are any buildings or structures or utilities already exist on such land as mentioned in the said Schedule , the same may be required to be demolished or altered to ensure construction activities or execution of the proposed Metro lines . :
3. Every person shall be bound to comply with the directions specified in sub - section ( 5) of section 21 of the said Act .
4. Any person who sustains any loss or damage in consequence of these directions shall be paid an amount which shall be determined by an order of the competent authority in the first instance and if the amount determined by the competent authority is not acceptable to either of the parties , the amount shall, on an appeal preferred by either of the parties , within sixty days from the date of the order of the competent authority , to the Appellate Authority , be determined by an order of the Appellate Authority.
