का.आ. 2091 ( अ ). केन्द्रीय सरकार की यह राय है कि भारत के राजपत्र, असाधारण, भाग 2, खंड (3) , उपखंड ( ii ) , तारीख 22 अगस्त, 2001 में प्रकाशित अधिसूचना संख्यांक का०आ० 814(अ) , तारीख 22 अगस्त, 2001 द्वारा जारी भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना में और संशोधन किया जाना लोकहित में आवश्यक और समीचीन है;
अतः, अब, केन्द्रीय सरकार मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 109 की उपधारा (3)द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, मोटर यान (नई अति सुरक्षा रजिस्ट्रीकरण प्लेट) आदेश , 2001 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थातः-
1. (1 ) इस आदेश का संक्षिप्त नाम मोटर यान (नई अति सुरक्षा रजिस्ट्रीकरण प्लेट) आदेश, 2011 है ।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. मोटर यान (नई अति सुरक्षा रजिस्ट्रीकरण प्लेट) आदेश, 2011 के पैरा 4 में, खंड ( xiv) के पश्चात् निम्नलिखित खंड अंतःस्थापित किए जाएंगे , अर्थात्: - " (xv) अनुमोदित विनिर्माता या प्रदायकर्ता अपने कब्जे में सभी सुरक्षा विशिष्टताओं के पूर्ण अभिलेख का अनुरक्षण करेगा जिसकी संबद्ध परीक्षा अभिकरणों द्वारा संपरीक्षा की जाएगी ।
(xvi) सुरक्षा अनुज्ञप्ति प्लेटों की विभिन्न सुरक्षा विशिष्टताओं का उपयोग केवल मोटर यानों पर इन प्लेटों के फिटमेंट के लिए अनुमोदित विनिर्माता या राज्यों या संघ राज्यक्षेत्र, प्रशासन द्वारा प्राधिकृत प्रदायकर्ता द्वारा किया जाएगा ।

(xvi ) अनुमोदित विनिर्माता या प्रदायकर्ता अपने कब्जे में सभी सुरक्षा विशिष्टताओं पर पूर्ण नियंत्रण रखेगा और वह या तो स्वयं द्वारा या उसके निमित्त किसी अन्य व्यक्ति द्वारा खुले बाजार में रजिस्ट्रीकरण प्लेट पर किसी सुरक्षा विशिष्टताके उपयोग के लिए उत्तरदायी होगा ।
(xvii) अनुमोदित विनिर्माता या प्रदायकर्ता, किसी को पृथक रूप से अपूर्ण प्लेटों या सुरक्षा विशिष्टताओं को बेचने के लिए प्राधिकृत नहीं होगा ।
(xix) इन उपबंधों के अनुपालन में असफल रहने पर विक्रेता को जारी किया गया प्रकार अनुमोदन प्रमाण पत्र, सरकार द्वारा निलंबन या रकरण के लिए दायी होगा ।

टिप्पण- मूल आदेश भारत के राजपत्र, असाधारण, भाग 2, खंड 3 , उपखंड ( ii ) , तारीख 22 अगस्त, 2001 में संख्यांक का.आ. 814(अ) तारीख 22 अगस्त, 2001 द्वारा प्रकाशित किया गया था और तत्पश्चात् अधिसूचना संख्यांक का० आ ० 1041 (अ ) , तारीख 16 अक्तूबर, 2001 और का० आ0 883 (अ) , तारीख 12 जून, 2006 द्वारा संशोधित किए गए ।

NOTIFICATION
New Delhi, the 16th September, 2011
S.O. 2091 (E )-Whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to further amend the notification of the Government of India in the Ministry of Road Transport and Highways issued vide notification number S.O. 814 (E) , dated, the 22nd August , 2001 , published in the Gazette of India , Extraordinary , part II , section 3, sub -section ( ii ) , dated, the 22nd August, 2001 ;
Now, therefore , in exercise of the powers conferred by sub- section (3) of section 109 of the Motor Vehicles Act, 1988 (59 of 1988) , the Central Government hereby makes the following further amendment in the Motor Vehicles (New High Security Registration Plates ) Order , 2001 , namely: -
1. (1) This order may be called the Motor Vehicles (New High Security Registration Plates) Order , 2011 .
(2) It shall come into force on the date of their publication in the Official Gazette.
2. In the Motor Vehicles (New High Security Registration Plates ) Order, 2001 , in para 4, after clause (xiv ) , the following clauses shall be inserted, namely: -
" (xv) The approved manufacturer or supplier shall maintain complete record of all the security features in their possession which shall be audited by the concerned testing agencies .
(xvi) Various security features of security license plates shall be used only by the approved manufacturer or supplier authorised by the States or the Union territory Administration for fitment of these plates on motor vehicles .

(xvii) The approved manufacturer or supplier shall exercise complete control over all the security features in its possession and shall be responsible for the use of any of the security feature on registration plate in the open market either by himself or by any other person on his behalf.
(xviii) The approved manufacturer or supplier shall not be authorised to sell incomplete plates or the security features separately to anyone .
(xix) The type approval certificate issued to the vendor shall be liable for suspension or cancellation by the Government for failure to comply with these provisions ." .
