सा.का.नि. 702(अ). स्वापक औषधि एवं मनः:प्रभावी पदार्थ नियमावली , 1985 के नियम 8 के अनुसरण में, केन्द्रीय सरकार , एतद्वारा , पहली अक्तूबर , 2011 को आरंभ होने वाले और 30 सितम्बर, 2012 को समाप्त होने वाले अफीम फसल वर्ष के दौरान केन्द्र सरकार की ओर से अफीम पोस्त की खेती के लिए लाइसेंसों की मंजूरी हेतु नीचे विनिर्दिष्ट सामान्य शर्तें अधिसूचित करती है :-
1. खेती करने के स्थान
किसी भी ऐसे भूखंड में पोस्त की खेती के लिए लाइसेंस दिया जा सकता है जिसे केन्द्रीय सरकार द्वारा इस संबंध में अधिसूचित किया जाए।
2. कृषि हेतु पात्रता
इस अधिसूचना के खण्ड 3 और 7 के अध्यधीन निम्नलिखित अफीम पोस्त की खेती के लाइसेंस हेतु पात्र होंगे :-
(i ) वे किसान जिन्होंने फसल वर्ष 2010-11 के दौरान अफीम पोस्त की खेती की थी और मध्य प्रदेश तथा राजस्थान राज्यों में औसतन अफीम की उपज कम से कम 58 किलोग्राम प्रति हैक्टेयर तथा उत्तर प्रदेश में 52 किलोग्राम प्रति हैक्टेयर की औसत अफीम उपज सौंपी थी।

( ii ) किसान जिन्होंने इस संबंध में प्रावधानों के अनुसार केन्द्रीय स्वापक ब्यूरो की देखरेख में फसल वर्ष 2010-11 के दौरान अपनी संपूर्ण पोस्त की फसल को नष्ट किया हो, परन्तु जिन्होंने इसी तरह फसल वर्ष 2009-10 के दौरान अपनी सम्पूर्ण पोस्त फसल को नष्ट नहीं किया हो।
( iii ) किसान जिनकी लाइसेंस मंजूर न करने के खिलाफ अपील को फसल वर्ष 2010-11 में निपटान की अंतिम तारीख के बाद अनुमति दे दी गई हो।
(iv) किसान जिन्होंने फसल वर्ष 2008-09 अथवा किसी अगले वर्ष में पोस्त की खेती की हो और जो अनुवर्ती वर्ष में लाइसेंस के लिए पात्र थे , किन्तु किसी कारणवश, स्वेच्छा से लाइसेंस प्राप्त न किया हो अथवा, जिन्होंने अनुवर्ती फसल वर्ष में लाइसेंस प्राप्त करने के बाद किसी कारणवश अफीम पोस्त की खेती वास्तव में न कीहो।
(v ) किसान जो मृत किसानों के कानूनन वारिस हैं और यदि एक से अधिक ऐसे कानूनन वारिस हैं तो उनमें से एक जिसको लाइसेंस के उद्देश्य के लिए जिला अफीम अधिकारी द्वारा निर्धारित किया जाए।
3. लाइसेंस की शर्तें
किसी भी किसान को तब तक लाइसेंस मंजूर नहीं किया जाएगा जब तक वह निम्नलिखित शर्तों को पूरा न करता हो/करती हो:-
( i ) उसने फसल वर्ष 2010-11 के दौरान पोस्त की खेती के लिए लाइसेंसशुदा वास्तविक क्षेत्र से 5 % क्षम्य क्षेत्र से अधिक क्षेत्र में खेती न की हो;

(ii ) उसने कभी भी अफीम पोस्त की अवैध खेती न की हो तथा स्वापक औषधि तथा मनःप्रभावी द्रव्य पदार्थ अधिनियम, 1985 और उसके अंतर्गत बनाए गए नियमों के अंतर्गत उस पर किसी अपराध के लिए किसी सक्षम न्यायालय में आरोप नहीं लगाया गया हो;
( iii ) फसल वर्ष 2010-11 के दौरान उसने केन्द्रीय नार्कोटिक्स ब्यूरो /नार्कोटिस्क आयुक्त द्वारा किसानों को जारी किन्हीं विभागीय अनुदेशों का उल्लंघन नहीं किया हो;
( iv) उसने वर्ष 2010-11 के दौरान मिलावटी अफीम अथवा राजकीय अफीम एवं क्षारोद कार्यशाला , नीमच अथवा गाजीपुर द्वारा घटिया के रूप में वर्गीकृत अफीम नहीं सौंपी हो;
( v ) उसने फसल वर्ष 2010-11 के दौरान ऐसी अफीम नहीं सौंपी हो जिसका गाढ़ापन 55 डिग्री से कम पाया गया हो।
4. अधिकतम क्षेत्र
(i ) सभी खंड 2 ( i ) से 2 ( v ) के अंतर्गत पात्र किसानों को 35 आरी के लिए लाइसेंस दिया जाएगा । तथापि खंड 2(i ) के उन किसानों को 50 आरी के लिए लाइसेंस प्रदान किया जाएगा जिन्होंने औसतन 60 कि.ग्रा. /है. या उससे अधिक की उपज दी है । किसान लाइसेंसशुदा क्षेत्र से कम क्षेत्र में खेती कर सकते हैं ।
( ii ) किसान अधिकतम तीन भू- खंडों में अफीम पोस्त बो सकते हैं।
( iii ) यदि किसान चाहें तो दूसरों के स्वामित्व के भू- खंडों को पट्टे पर लेने की अनुमति दी जाएगी ।
5. पूर्वचेतावनी
( i ) अनुवर्ती फसल वर्ष अर्थात् 2012-13 में अफीम पोस्त की खेती के लिए लाइसेंस प्राप्त करने के लिए पात्र बनने हेतु फसल वर्ष 2011-12 के दौरान मध्य प्रदेश और राजस्थान में प्रति हैक्टेयर 58 किलोग्राम और उत्तर प्रदेश में प्रति हैक्टेयर 52 किलोग्राम की न्यूनतम अर्हक उपज अवश्य सौंपी जानी चाहिए।
( ii ) वर्ष 2011-12 के दौरान सौंपी गई अफीम में शामिल मोर्फिन अवयव फसल वर्ष 2011-12 के लिए भुगतान का तथा फसल वर्ष 2012-13 में लाइसेंस हेतु पात्रता का आधार बन सकता है , यदि सरकार इस संबंध में ऐसा करने का निर्णय लेती है ।
( iii ) ऐसे कृषक जिन्होंने फसल वर्ष 2010-11 के दौरान अपनी सम्पूर्ण पोस्त की फसल नष्ट की हो , वे फसल वर्ष 2012-13 में लाइसेंस के पात्र उस स्थिति में नहीं होंगे , यदि उन्होंने फसल वर्ष 2011-12 में भी अपनी फसल को पूरी तरह से उखड़वा दिया हो ।
(iv ) ऐसे किसान अगले फसल वर्ष 2012-13 में लाइसेंस के पात्र नहीं होंगे जिनकी फसल वर्ष 2011-12 की

अफीम में पानी की मिलावट पाई गई हो तथा उसका गाढ़ापन 55 डिग्री से कम पाया गया हो।
(v) ऐसे किसान जिनकी फसल वर्ष 2011-12 कीअफीम राजकीय अफीम एवं क्षारोद कारखाना , नीमच अथवा गाजीपुर द्वारा मिलावटी पाई जाती है तथा घटिया के रूप में वर्गीकृत की जाती है वे अगले वर्ष 2012-13 में लाइसेंस के पात्र नहीं होंगे ।
6. माफी योग्य सीमा
यदि खेती किया गया वास्तविक क्षेत्र लाइसेंसशुदा क्षेत्र से 5 प्रतिशत तक अधिक है तो ऐसा अधिक क्षेत्र क्षम्य हो सकता है।
7. विविध
( i ) जो किसान वर्ष 2011-12 के दौरान अफीम पोस्त की खेती अपने भू- खण्ड पर नहीं , बल्कि दूसरों से पट्टे पर लिए गए भू- खण्ड पर करता है , भू-खण्ड के स्वामी का ब्यौरा , सर्वेक्षण संख्या और स्वापक आयुक्त द्वारा निर्देशित अन्य ब्यौरा प्रदान करेगा ।
(ii ) इन सामान्य लाइसेंसिंग शर्तों से नार्कोटिक्स आयुक्त/नार्कोटिक्स उपायुक्त के किसी भी लाइसेंस को जारी करने/उसे रोकने के अधिकार को उस स्थिति में कोई क्षति नहीं पहुंचती जब कभी स्वापक औषधि एवं मनःप्रभावी पदार्थ अधिनियम , 1985 के उपबंधों और उसके अंतर्गत बनाए गए नियमों के अनुसार ऐसा करना ठीक समझा जाए।
( iii ) लाइसेंस इस शर्त पर दिया जाएगा कि किसी भी खेत को सरकार द्वारा अथवा सरकार द्वारा विशिष्ट संस्था अथवा एजेंसी के साथ सहयोग करके किए जाने वाले अनुसंधान के प्रयोजनार्थ अधिगृहीत किया जा सकता है। जिस किसान के खेतों को अनुसंधान के लिए चुना जाएगा उसका अगले वर्ष लाइसेंस मंजूर करने पर विचार किया जाएगा बशर्ते उसने निर्धारित उपज प्रस्तुत की हो और वह अन्यथा पात्र हो। अनुसंधान हेतु चुने गए क्षेत्र को उपज की गणना करते समय लेखे में नहीं लिया जाएगा ।
( iv ) लाइसेंस इस अतिरिक्त शर्त के अध्यधीन होगा कि अफीम को निकाले बिना पोस्त भूसी प्राप्त करने के लिए किसी भी खेत को चुना जा सकता है। जिन किसानों के खेत ऐसे उपयोग के लिए चुने जाएंगे वे अन्यथा पात्र होने पर अगले फसल वर्ष के लिए लाइसेंस के लिए पात्र होंगे।
(v ) किसी किसान द्वारा सौंपी गई अफीम की मात्रा की गणना राजकीय अफीम एवं क्षारोद कार्यशाला , नीमच अथवा गाजीपुर में किए गए विश्लेषणों के आधार पर 70डिग्री गाढ़ेपन पर की जाएगी ।
(vi ) ऊपर वर्णित किसी भी बात के होते हुए भी ऐसे किसी भी गांव में अफीम की खेती की अनुमति नहीं दी [भाग II- खण्ड 3 ( i ) ]

जाएगी जहां पात्र किसानों की संख्या 5 अथवा इससे कम हो। तथापि, ऐसे गावों के संबंध में, जहां कहीं संभव हो, प्रभावित किसानों को उन पड़ोसी गावों में स्थानांतरित होने का विकल्प दिया जाएगा जहां अफीम कीखेती करने की अनुमति है ।

(v) Cultivators who are the legal heirs of deceased eligible cultivators and in case there are more than one such legal heir, the one determined by the District Opium Officer as legal heir for the purpose of the licence.

2. Conditions of Licence
NOTIFICATION

No cultivator shall be granted licence unless he/she satisfies that :

( i) He/ she did not, in the course of actual cultivation, exceed the area licenced for poppycultivation during the crop year2010- 11 beyond the 5 % ' Condonable Limit ' allowed in the licensing policy.
GS.R. 702(E ) .-In pursuance of rule 8 of the Nar- coticDrugs and Psychotropic Substances Rules , 1985 , the CentralGovernment hereby notifies the general conditions for grant of licence specified below for cultivation of opium poppy on account of the Central Government during the Opium Crop Year commencing on the 1st day of October, 2011 and ending with the 30th day ofSeptember, 2012 .
1. Place of Cultivation
(ii) He/ she did not at any time resort to illicit cultivation of opium poppy and was not charged in any competent court for any offence under the Narcotic Drugs and Psychotropic Substances Act, 1985 and the Rulesmade thereunder.
Opium poppy cultivation may be licenced in any tract asmaybe notified in this behalfby the Central Government.
2.Eligibility for Cultivation
(iii) He/she did not during the crop year 2010- 11 violate any departmental instructions issued by the Central Bureau of Narcotics/ Narcotics Commissioner to the cultivators .
Subject to clauses 3 and 7 of this notification ,'the following shall be eligible for a licence to cultivate opium poppy :
(iv) He/she did not tender during 2010-11 adulterated opium or opium classified as ' inferior opium' by the Government Opium and Alkaloid Works , Neemuch/Ghazipur.
(i) Cultivators who had cultivated opium poppy during the crop year 2010-11 and tendered an average yield of opium of not less than 58 kg/hectare in the States of Madhya Pradesh and Rajasthan and an average yield of opium of not less than 52 kg/ha in the State of Uttar Pradesh .
(v) He/ she did not tender during the crop year 2010-11 , opium which has been found tobe of a consistency lower than 55 degrees .
4. Maximum Area
(ii) Cultivators who ploughed back their entire opium poppy crop cultivated during the crop year 2010-11 under the supervision of the Central Bureau of Narcotics in accordance with the provisions in this regard, but had not similarly ploughed back their entire poppy crop during 2009-10 .
( i ) All eligible cultivators under clause 2( i ) to ( v) will be issued licence for 35 ares . However, cultivators who tendered average yield of 60 kg/ha and above under clause 2(i) category will be issued licence for 50 ares . The cultivators can cultivate in an area less than the licenced area.
(iii) Cultivators whose appeal against refusal of licence has been allowed after the last date of settlement in the crop year 2010-11 .
(ii) Cultivators can sow opium poppy in not more than three plots .
(iii) Cultivators will be permitted to take on lease, land belonging to others , to make up the licenced area, if they so desire .
(iv) Cultivators who cultivated opium poppy in the crop year 2008-09 or during any subsequent crop year and were eligible for a licence in the following crop year, but did 4

5. Forewarning
(i) A Minimum Qualifying Yield of 58 kg/ hectare in Madhya Pradesh and Rajasthan and 52 kg/hectare in Uttar Pradesh must be tendered during the crop year 2011-12 to become eligible for a licence to cultivate opium: poppy in the following year i.e. 2012-13 .
(ii) Morphine content of opium tendered during 2011-12 may become the basis for payment for the crop year 2011-12 and eligibility for licence in crop year 2012-13 , if the Government decides to do so in this regard.
(iii) Cultivators who had fully ploughed back their entire poppy during crop year 2010-11 would not be entitled for licence in the crop year 2012-13 , if they also uproot their crop fully in the crop year 2011-12.
( iv) Cultivators , whose opium for the crop year 2011-12 is found to be ' water mixed ' and of consistency lower than 55 degrees will not be eligible for a licence in the next crop year 2012-13 .
(v) Cultivators whose opium for the crop year 2011-12 is found to be adulterated and classified as ' inferior' by the Govt . Opium &Alkaloid Works , Neemuch or Ghazipur will not be eligible for licence in the next crop year 2012-13 .
6. Condonable limit
Ifthe area actually cultivated is up to 5% in excess . of the licenced area , such excess cultivation may be condoned.
7. Miscellaneous
(i) Any cultivator who cultivates opium poppy during 2011-12 not in his own land but in the land leasedfrom others shall provide details of owner of the plot, survey number and any other details as may be directed by the Narcotics Commissioner.

(ii) These General Licencing Conditions are without prejudice to the right of the Narcotics Commissioner/Deputy Narcotics Commissioner to issue/withhold a licence whenever it is deemed proper to do so in accordance with the provisions of the Narcotic Drugs & Psychotropic Substances Act , 1985 and the Rules made thereunder.
(iii) The licence will be subject to the condition that any field may be taken over for any research that may be conducted by the Government directly or in collaboration with any specialised institution or agency. The cultivator whose field is selected for research shall be considered for licence for the next year if he has tendered the stipulated MQY and is otherwise eligible. The area taken over for research will not be taken into account while calculating the yield.
(iv) The licence shall be subject to the further condition that any field may be selected for obtaining poppy straw without extraction of opium . Cultivators whose fields are selected for such use shall be eligible for a licence for the next crop year, if otherwise eligible .
(v) The quantity of opium tendered by a farmer willbe calculated at 70° consistency, on the basisof analysis by the Government Opium andAlkaloid Works , Neemuch or Ghazipur.
(vi) Notwithstanding anything stated above , opium cultivation will not be allowed in any village where the number of eligible cultivators is five or less . However in respect of such villages , wherever possible, the affected cultivators will be given an option to shift to such neighbouring village where opium cultivation is permitted .
