का.आ. 2098(अ) -जबकि आवेदक मैसर्स एमको एनर्जी लिमिटेड जिनका पंजीकृत कार्यालय 701/704, 7वाँ तल, नमन सेंटर, ए-विंग, बान्द्रा कुर्ला कॉम्प्लेक्स , बान्द्रा , मुंबई -400051 में है , ने एमको एनर्जी विद्युत संयंत्र से महाराष्ट्र के भद्रावती में पीजीसीआईएल 400 केवी उपकेन्द्र तक समर्पित 400 केवी डी/सीट्विन मूस पारेषण लाइन बिछाने के लिए विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत अनुमोदन हेतु आवेदन किया है ।
और जबकि, भारत सरकार , विद्युत मंत्रालय ने पत्र सं. 11/4/2007- पीजी के द्वारा 17-6-2008 को वरोरा, जिला चन्द्रपुर (महाराष्ट्र) से भद्रावती, जिला चन्द्रपुर ( महाराष्ट्र) में पीजीसीआईएल के 400 केवी उपकेन्द्र तक 400 केवी डबल सर्किट की समर्पित पारेषण लाइन को बिछाने के लिए विद्युत अधिनियम , 2003 की धारा 68 के अतर्गत मै. एमको एनर्जी लिमिटेड को अनुमोदन प्रदान किया था ।
और जबकि, आवेदक ने अब विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत वे सभी शक्तियां उसे प्रदान किए जाने का अनुरोध किया है जो सरकार द्वारा स्थापित अथवा अनुरक्षित करने अथवा कार्यों के लिए स्थापित अथवा अनुरक्षित किए जाने वाले टेलीग्राफ के उद्देश्य से टेलीग्राफ लाइनें तथा खंभे लगाने के संबंध में, भारतीय टेलीग्राफ अधिनियम , 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास हैं । स्कीम के अंतर्गत शामिल पारेषण लाइन निम्नलिखित गांवों, नगरों और शहरों में से , उन पर से, आस- पास से तथा बीच से होकर गुजरेंगी :-

इसलिए, अब , सावधानीपूर्वक विचार करने के पश्चात्, भारत सरकार, विद्युत मंत्रालय विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत , अंतर्राज्यीय विद्युत पारेषण के लिए , अन्तर्राज्यीय पारेषण लाइनों हेतु उपयुक्त उल्लिखित संस्थापना के लिए निम्नलिखित शतों एवं निबंधनों के अधीन, सरकार द्वारा स्थापित या देख - रेख या इस प्रकार स्थापित या देख - रेख किए जाने वाले टेलीग्राफ के उद्देश्य से टेलीग्राफ लाइनों और पोस्ट लगाने के संबंध में भारतीय टेलीग्राफ अधिनियम , 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास जो शक्तियां हैं, उन सभी शक्तियों को आवेदक को प्रदान करता है , अर्थात्:-
(i) अनुमोदन 25 वर्ष के लिए प्रदान किया जाता है ;
(ii ) आवेदक को प्रस्तावित लाइनों के निर्माण से पूर्व, संबंधित प्राधिकरणों अर्थात् स्थानीय निकायों , रेलवे, राष्ट्रीय राजमार्ग , राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी;

( iii ) आवेदक को पारेषण , ओ एंड एम , खुली पहुँच आदि के संबंध में उपयुक्त आयोग के विनियमों/संहिताओं का पालन करना होगा;
( iv ) आवेदक को महाराष्ट्र के भद्रावती में एमको एनर्जी विद्युत संयंत्र से पीजीसीआईएल 400 केवी उपकेन्द्र तक समर्पित 400 केवी डी/सी ट्विन मूस पारेषण लाइन को बिछाने के लिए दायित्व सौंपा गया है। इस कार्य का ब्यौरा 23 अप्रैल , 2011 के भारत के राजपत्र में प्रकाशित किया गया है ;
( v ) आवेदक संबंधित राज्यों के मुख्य वैद्युत निरीक्षक के अनुमोदन के पश्चात् लाइनों का प्रचालन करेगा;
(vi ) यह अनुमोदन विद्युत अधिनियम , 2003 के प्रावधानों और उसके अंतर्गत बनाई गई नियमावली की अपेक्षाओं का आवेदक द्वारा अनुपालन किए जाने के अधीन है।

S.O. 2098 (E) .-Whereas M/ s EMCO Energy Limited, the Applicant with its Registered Office at 701 / 704, 7th Floor, Naman Centre , A - Wing , Bandra Kurla Complex, Bandra, Mumbai-400051 , has applied for approval under Section 164 of the Electricity Act, 2003 for construction of Dedicated 400 kV D/ c Twin Moose transmission line from EMCO Energy Power Plant to PGCIL 400 kV Substation at Bhadravati in Maharashtra .
And whereas on 17-6-2008 , vide letter No. 11/4/ 2007-PG, the Government of India , Ministry of Power, had granted to M/ s EMCO Energy Limited, approval under Section 68 of the Electricity Act, 2003 for laying the dedicated transmission line of 400 kV double circuit from Warora, District Chandrapur (Maharashtra) to 400 kV Substation of PGCIL at Bhadrawati District , Chandrapur (Maharashtra) .
And whereas the applicant has now requested to confer upon him all the powers under Section 164 of the Electricity Act, 2003 which telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by the Government or to be so established or maintained for the works . The transmission line covered under the scheme will pass

Now, therefore , after careful consideration , Government of India, Ministry of Power , confers, under Section 164 of the Electricity Act, 2003 , all the powers on theApplicant which telegraph authority possesses under the IndianTelegraph Act, 1885 with respect to the placing oftelegraph lines and posts for the purposes of a telegraph established or maintained , by the Government or to be so established or maintained subject to following terms and conditions for installing the above mentioned interstate transmission lines for interstate transmission of electricity, namely :-
(1) the approval is granted for 25 years;
(ii) the applicant shall have to seek the consent of the concerned authorities i.e. , local bodies , Railways , National Highways , State Highways etc. , before erection of proposed lines;
(iii) the applicant shall have to follow regulations/ codes ofthe appropriate commission regarding transmission, O & M, open access etc.;
(iv) the applicant has been entrusted with the responsibility for construction of dedicated400 kV D/ c Twin Moose transmission line from EMCO Energy Power Plant to PGCIL 400 kV Substation at Bhadravati in Maharashtra . The details ofthe works are published in the Gazette ofIndia ofApril 23 , 2011 .
(v) the applicant shall operate the lines after approval of Chief Electrical Inspector of respective States;
(vi) the approval is subject to compliance by the applicant to the requirement of the provisions ofthe ElectricityAct, 2003 and the rules made thereunder.
