विषय : खाद्य तेल के निर्यात पर रोक को 30-9-2012 तक बढ़ाना और 10,000 टन की सीमा के तहत ब्रान्डेड उपभोक्ता पैक में खाद्य तेल के निर्यात पर 1-11-2011 से 31-10-2012 तक छूट ।
का.आ. 2251 (अ)-विदेश व्यापार नीति, 2009-2014 (समय- समय पर यथा संशोधित) के पैरा 2.1 के साथ पठित विदेश व्यापार (विकास और विनियमन ) अधिनियम , 1992 ( 1992 की संख्या 22 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा , समय - समय पर यथा संशोधित अधिसूचना सं. 7 दिनांक 30-9-2010 के साथ पठित अधिसूचना सं. 85 दिनांक 17-3-2008 में तत्काल प्रभाव से संशोधन करती है ।
2. खाद्य तेलों के निर्यात पर निषेध प्रारंभ में अधिसूचना सं. 85 दिनांक 17-3-2008 द्वारा 17-3-2008 से एक वर्ष की अवधि के लिए लगाया गया था जिसे समय - समय पर बढ़ाया गया था और इस समय अधिसूचना सं. 7 दिनांक 30-9-2010 के द्वारा यथा- अधिसूचित यह निषेध 30-9-2011 तक है । अब खाद्य तेल के निर्यात पर रोक 30-9-2012 तक बढ़ा दी गई है ।
3. उपर्युक्त प्रतिबंध में छूट देते हुए, समय - समय पर जारी विभिन्न अधिसूचनाओं के जरिए कुछ रियायतें प्रदान की गई हैं, नामतः (क) अरंडी के तेल के निर्यात (ख) कोचीन पत्तन से नारियल के तेल के निर्यात ( ग ) निर्यात किए जाने वाले गैर खाद्य

माल के उत्पादन के लिए 100% निर्यात्तोन्मुख एककों को डी टी ए से खाद्य तेलों (इनपुट कच्चे माल के रूप में ) के मान्य निर्यात (घ ) आई टी सी (एचएस) कोड 15159010 , 15159020 , 15159030 , 15159040 , 15179010 , और 15219020 के तहत लघु वन्य उत्पादों से विनिर्मित तेलों के निर्यात, यद्यपि खाद्य हों ( ड. ) आर्गेनिक खाद्य तेल के 10,000 मीट्रिक टन प्रति वर्ष निर्यात ।
4. इसके अतिरिक्त, दिनांक 1-11-2010 की अधिसूचना सं. 9 , के अनुसार 10,000 टन की सीमा के तहत 5 किग्रा. तक के ब्रान्डेड उपभोक्ता पैक में खाद्य तेल का निर्यात अभी 1-11-2010 से 31-10-2011 तक अनुमत है । अब वही छूट 31-10-2012 तक निम्नानुसार बढ़ा दी गई है:
(i) पत्तनों में कोई परिवर्तन नहीं होगा अर्थात् निर्यात सीमा- शुल्क ई डी आई पत्तनों से अनुमत होंगे ;
(ii ) निर्यात की अवधि1-11-2011 से 31-10-2012 तक होगी;
(iii ) निर्यातों के लिए अनुमत कुल मात्रा की सीमा 10,000 टन है; और
(iv) पैकिंग में कोई परिवर्तन नहीं होगा अर्थात् 5 किग्रा. तक के ब्रान्डेड उपभोक्ता पैक में निर्यात की अनुमत्तिहोगी;
5. इस अधिसूचना का प्रभाव :
खाद्य तेलों के निर्यात पर निषेध को 30-9-2012 तक बढ़ा दिया गया है । परन्तु यह उपर्युक्त पैरा ( 3 ) और ( 4 ) में यथाउल्लिखित रियायतों/छूट पर लागू नहीं होगा । अधिसूचना सं. 60 दिनांक 20-11-2008 के अनुसार मछली के तेल का निर्यात आगे भी मुक्त रहेगा ।

Subject : Extension of ban on export of edible oils up to 30-9-2012 and exemption for export of edible oil in branded consumer packs with a ceiling of 10,000 tons from 1-11-2011 to 31-10-2012.
S.O. 2251 (E) .- In exercise ofpowers conferred by Section 5of the Foreign Trade (Development & Regulation) Act, 1992 (No. 22 of 1992) read with Para 2.1 ofthe Foreign TradePolicy,2009-2014 (as amended from time to time), the Central Government hereby amends , with immediate effect, Notification No. 85 dated 17-3-2008 read with Notification No. 7 dated 30-9-2010 , as amended from time to time.

Export ofedible oils was initially prohibited for a period of one year with effect from 17-3-2008 vide Notification No. 85 dated 17-3-2008 which was extended from time to time and is presently up to 30-9-2011 notified through Notification No. 7 dated 30-9-2010 . Now the ban onexport ofedible oil is extended up to 30-9-2012 .
3. In relaxation of above prohibition , certain exemptions have been granted through various notifications issued from time to time namely : (a) export of Castor Oil (b ) export of coconut oil from Cochin Port ( c) Deemed export of edible oils (as input raw material ) from

DTA to 100 % EOUS for production of non -edible goods to be exported (d) export of oil produced out of minor forest produce even ifedible, ITC (HS) Code 15159010 , 15159020, 15159030 , 15159040, 15179010 and 15219020 (e) export of 10,000 MTs per annum of organic edible oils .
4. In addition, export of edible oils in branded consumer packs of up to 5 Kgs . with ceiling of 10,000 tons is presently permitted from 1-11-2010 to 31-10-2011 in terms ofNotification No. 9 of 1-11-2010 . Now the same dispensation has been extended up to 31-10-2012 as follows:-
(1) There shall be no change in ports i.e. exports willbe permitted from Custom EDI Ports;
(ii) The period ofexport will be from 1-11-2011 to 31-10-2012;
(iii) The total quantity ceiling permitted for exports is 10,000 tons; and
(iv) There shall be no change in packing i.e. exports permitted in branded consumer packs up to 5Kgs .
5. Effect of this notification :
Prohibition on export of edible oils has been extended up to 30-9-2012. But, the same will not apply to relaxations/ exemption as mentioned in para (3 ) and (4) above . Export of fishoil continues to be free as per Notification No. 60dated 20-11-2008.
