आ.अ. 44(अ).-यतः , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 61क में यह उपबंधित है कि मतदान मशीनों द्वारा ऐसी रीति से मत दिए और रिकार्ड किए जाएंगे जैसा कि निर्वाचन आयोग ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों के लिए प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए निर्दिष्ट करे ; तथा
2. यतः आयोग ने हरियाणा में 4 - हिसार संसदीय निर्वाचन क्षेत्र की परिस्थितियों पर विचार किया है , और वह संतुष्ट है कि उपर्युक्त वर्णित संसदीय निर्वाचन क्षेत्र में मतदान के लिए पर्याप्त संख्या में इलैक्ट्रॉनिक वोटिंग मशीनें उपलब्ध हैं, तथा मतदान कर्मचारी इलैक्ट्रॉनिक वोटिंग मशीनों के दक्षतापूर्वक संचालन करने के लिए प्रशिक्षित हैं तथा निर्वाचक भी इलैक्ट्रॉनिक वोटिंग मशीनों की कार्यप्रणाली से पूर्णतया परिचित हैं;
3. अतः , अब, भारत निर्वाचन आयोग एतद्वारा हरियाणा राज्य में 4- हिसार संसदीय निर्वाचन क्षेत्र को ऐसे निर्वाचन क्षेत्र के रूप में विनिर्दिष्ट करता है जिसमें 19 सितम्बर , 2011 को अधिसूचित किए गए उक्त राज्य की लोक सभा के चालू उप निर्वाचन में , निर्वाचनों का संचालन नियम , 1961 के अधीन निर्धारित रीति से इलैक्ट्रॉनिक मतदान मशीनों के माध्यम से मत डाले और रिकार्ड किए जाएंगे जैसा कि इस विषय पर आयोग द्वारा समय - समय पर अनुपूरक अनुदेश जारी किए जाते हैं।

Ο. Ν . 44 (Ε) . Whereas , Section 61A of the Representation of the People Act , 1951 , provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency as the Election Commission of India may, having regard to the circumstances of each case specify; and
2. Whereas , the Commission has considered the circumstances in 4-Hisar Parliamentary Constituency in Haryana, and it is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in the above- mentioned Parliamentary Constituency, the polling personnel are well trained in efficient handling ofthe Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines ;
3. Now, therefore , the Election Commission of India hereby specifies 4- Hisar Parliamentary Constituency in Haryana as the constituency in which the votes at the current bye -election to the House of the People from the said State notified on 19th September, 2011 , shall be given and recorded by means of Electronic Voting Machines in the manner prescribed under the Conduct ofElections Rules, 1961 , and the supplementary instructions issued by the Commission from time to time onthe subject.
