का.आ. 2380 (अ).- केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग अधिनियम , 1956 (1956 का 48) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा उक की उपधारा (1 ) के अधीन जारी की गई भारत सरकार के तत्कालीन पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्या का.आ. 1827 (अ), तारीख 26 अक्तूबर, 2007 और का.आ. 936 (अ) , तारीख 24 अप्रैल , 2008 , जो दोनों भारत के राजपत्र, असाधारण , भाग ।। , खण्ड 3 , उपखंड (ii ) में प्रकाशित की गई थीं, द्वारा तमिलनाडु राज्य के कोयम्बतूर जिले में राष्ट्रीय राजमार्ग संख्या 67 के 284/600 कि.मी. से 316/200 कि.मी. (करुर-कोयम्बतूर सेक्शन) तक के भूखण्ड के निर्माण (चौड़ा करने / चार लेन का बनाने , आदि) , अनुरक्षण, प्रबंध और प्रचालन के लिए उक्त अधिसूचनाओं से उपाबद्ध अनुसूचियों में विनिर्दिष्ट भूमि का अर्जन करने के अपने आशय की घोषणा की थी ;
और यतः अधिसूचना संख्या का.आ. 1827 (अ) , तारीख 26 अक्तूबर , 2007 का सार उक्त अधिनियम की धारा उक की उपधारा (3) के अधीन तारीख 27 नवम्बर, 2007 को "दि हिन्दू" और "डेली थाँथी" दोनों में तथा अधिसूचना संख्या का.आ. 936 (अ) , तारीख 24 अप्रैल , 2008 का सार तारीख 16 मई , 2008 को "दि हिन्दू" और " डेली थाँथी" दोनों में प्रकाशित किया गया था ;
और यतः उक्त 3 ए (1 ) अधिसूचनाओं के संबंध में उडी अधिसूचनाएं भी क्रमशः संख्या का.आ. 1194 (अ ), तारीख 23 मई , 2008, और संख्या का.आ. 2735 (अ) , तारीख 26 नवम्बर, 2008 के तहत प्रकाशित की गई थी ;

और यतः उक्त अधिनियम की धारा 3 जी की उपधारा (3) के अधीन अधिसूचना संख्या का.आ. 1194 (अ) , तारीख 23 मई , 2008, और संख्या का.आ. 2735 (अ), तारीख 26 नवम्बर, 2008 के संबंध में नोटिस क्रमशः तारीख 16 जुलाई, 2008 को "दि हिन्दू" और "डेली थाँथी" दोनों में तथा 11 जनवरी, 2009 को "दि इण्डियन एक्सप्रेस" और "डेली थाँथी" दोनों में प्रकाशित किए गए थे ;
और यतः थीरू आरनटराजन और 8 अन्य ने केवल अधिसूचना संख्या का.आ. 1194 (अ) , तारीख 23 मई, 2008, और अधिसूचना संख्या का.आ. 2735 (अ) , तारीख 26 नवम्बर, 2008 जो क्रमशः 16 जुलाई, 2008, और 11 जनवरी , 2009 को प्रकाशित की गई थी के संबंध में उक्त अधिनियम की धारा 3जी के अधीन नोटिस के प्रकाशन पर आपत्ति करते हुए 10,223 वर्ग मीटर के लिए माननीय उच्च न्यायालय मद्रास में 2008 की रिट याचिका संख्या 19946 से 19954 तक दायर की, जबकि उक्त उडी अधिसूचना संख्या का. आ. 1194 (अ) , तारीख 23 मई, 2008 और संख्या का.आ. 2735 (अ), तारीख 26 नवम्बर, 2008 में गांव थेरक्कु अविनाशीपलायम में कुल अधिसूचित भूमि 36,037 वर्ग मीटर है और अधिसूचना संख्या का.आ. 1194 (अ), तारीख 23 मई, 2008 के संबंध में 20,478 वर्ग मीटर के लिए दायर की गई जबकि गांव अलगुमलई में उक्त 3 डी अधिसूचना में कुल 36,353 वर्ग मीटर भूमि अधिसूचित की गई है । माननीय उच्च न्यायालय मद्रास ने 18 सितम्बर, 2008 को केवल भूमि को बेकब्जा करने का अंतरिम स्थगन आदेश दिया । अतः 13 नवम्बर, 2008 को अलगुमलई गांव के संबंध में तथा 18 नवम्बर, 2008 और 31 जुलाई , 2009 को थेरक्कु अविनाशीपलायम गांव के संबंध में पंचाट पास किए गए थे ;
और यतः 2008 की रिट याचिका संख्या 19946 से 19954 और 2008 की 22050 और 22051 के अनुसरण में मद्रास उच्च न्यायालय के माननीय एकल न्यायाधीश ने इस आधार पर रिट याचिका को 03फरवरी, 2010 को खारिज कर दिया कि धारा उसी (2) के अन्तर्गत किए गए आदेश को माननीय उच्च न्यायालय मद्रास के समक्ष चुनौती नहीं दी गई है, ;
और यतः याचिकाकर्ताओं ने माननीय मद्रास उच्च न्यायालय में 2008 की रिट याचिका संख्या 19946 से 19954 और 2008 की 22050 और 22051 में विद्वान एकल न्यायाधीश द्वारा 3 फरवरी, 2010 को पारित आदेश के विरुद्ध 2010 की रिट अपील संख्या 339 से 349 के अधीन अपील की । चूंकि कोई स्थगन आदेश नहीं दिए गए थे इसलिए भाराराप्रा ने जिला कलक्टर, तिरुप्पुर से अनुरोध किया कि एनएच अधिनियम की धारा 3(ई) का विधिवत पालन करते हुए राष्ट्रीय राजमार्ग द्वारा अपेक्षित भूमि का कब्जा लेने के लिए आवश्यक प्रबंध करे क्योंकि सक्षम प्राधिकारी एवं जिला राजस्व अधिकारी , कोयम्बतूर द्वारा 3 (ई) नोटिस 18 फरवरी 2009 को पहले ही जारी किए जा चुके हैं । तिरुप्पुर कलक्टर की तारीख 15 जून, 2010 की कार्यवाहियों के अनुसार, नियमित तहसीलदार, तिरुप्पुर ने 30 जून, 2010 को उक्त भूमि का कब्जा ले लिया । माननीय मद्रास उच्च न्यायालय ने 01 जुलाई , 2010 को यथा- स्थिति बनाए रखने के आदेश दिए :
और यतः इस बीच , थीरू आर. नटराजन ने माननीय मद्रास उच्च न्यायालय में जिला कलक्टर, तिरुप्पुर की 15 जून , 2010 की कार्यवाहियों को रद्द करने का अनुरोध करते हुए 2010 की रिट याचिका संख्या 17991 दायर की । माननीय मद्रास उच्च न्यायालय ने रिट याचिका संख्या 17991/2010 और 2010 की एम.पी. संख्या 2 में 10 अगस्त, 2010 को अंतरिम स्थगन आदेश दिए और बाद में 18 अगस्त, 2010 को रिट याचिका संख्या 17991/2010 में 2010 की एम.पी. संख्या 2 में यह कहते हुए कि 2010 की रिट अपील संख्या 339 से 349 में पहले ही यथास्थिति बनाए रखने के आदेश दिए गए हैं इसलिए इस याचिका में किसी अंतरिम स्थगन की आवश्यकता नहीं है ;
और यतः उक्त कथित याचिकाकर्ताओं द्वारा की गई 2010 की रिट अपील संख्या 339 से 349 और 2010 की रिट याचिका17991 के अनुसरण में, माननीय मद्रास उच्च न्यायालय ने रिट अपीलों का स्वीकार किया था और 9 नवम्बर, 2010 को यह आदेश जारी किए थे कि सक्षम प्राधिकारी द्वारा राष्ट्रीय राजमार्ग अधिनियम, 1956 की धारा ३-सी (2) के अधीन पारित आदेश और पारिणामिक आदेश रद्द किए जाते हैं और सक्षम प्राधिकारी (एलए) को निदेश दिए कि अपीलकर्ताओं द्वारा अधिनियम की धारा 3 -सी (2) के अधीन दायर आक्षेपों पर विचार करें और सुविवेचित आदेश पारित करके उनका निपटान करे और प्रतिवादी को आगे यह अनुदेश दिए कि मामले में आगे कार्रवाई करे ;

और यतः थीरू पी. मुरूगेशन ने तारीख 16 जुलाई, 2008 की 3 डी ( 1 ) अधिसूचना के सार के प्रकाशन पर आक्षेप करते हुए रिट याचिका संख्या 17530/2008 दायर की । माननीय उच्च न्यायालय ने 24जुलाई, 2008 को केवल बेकब्जा करने के लिए अंतरिम आदेश पारित किए । माननीय उच्च न्यायालय के एकल न्यायाधीश ने 08 फरवरी , 2011 को वही आदेश पारित किए जो रिट अपील संख्या 339 से 439 और 2010 की रिट याचिका 17791 में खंड पीठ ने पारित किए थे ।
और यतः उक्त कथित रिट अपील और रिट याचिका मामलों में याचिकाकर्ताओं को ओक्षेपों पर विचार करने के लिए सक्षम प्राधिकारी के समक्ष प्रस्तुत होने का अवसर प्रदान किया गया था ;
और यतः 20 दिसम्बर , 2010 को आक्षेप प्राप्त हुए थे और याचिकाकर्ताओं को अवसर प्रदान किए गए थे और 15 मार्च, 2011 और 09 मई, 2011 को पूछताछ के लिए बुलाया गया और आक्षेपों पर विचार किया गया तथा सक्षम प्राधिकारी और जिला राजस्व अधिकारी, जिला तिरुप्पुर ने उन्हें उक्त अधिनियम की धारा 3-सी (2) के अधीन तारीख 22 जून, 2011 के आरओसी. एफ4 / 15695/09 में आदेश के तहत् अननुज्ञात कर दिया ;
और सक्षम प्राधिकारी ने उक्त अधिनियम की धारा उडी की उपधारा ( 1 ) के अनुसरण में, केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
अतः अब, केन्द्रीय सरकार , सक्षम प्राधिकारी की उक्त रिपोर्ट प्राप्त हो जाने पर और उक्त अधिनियम की धारा उडी की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि उक्त अनुसूची में विनिर्दिष्ट भूमि का पूर्वोक्त प्रयोजन के लिए अर्जन किया जाना चाहिए ;
और अब , केन्द्रीय सरकार, उक्त अधिनियम की धारा उडी की उपधारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशन पर , उक्त अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर आत्यन्तिक रूप से केन्द्रीय सरकार में निहित हो जाएगी ।

NOTIFICATION

S.O. 2380(E ) .- Whereas by the notifications of the Government of India in the thenMinistry of Shipping , Road Transport and Highways , ( Department of Road Transport and Highways ) number S.O. 1827 ( E ) , dated the 26th October 2007 and S.O.936 ( E) dated the 24th April2008 , both published in the Gazette of India , Extraordinary, Part II , Section 3 , Sub- section (ii ) and issued under sub-section (1 ) of Section 3A of the National Highways Act 1956 (48 of 1956) ( hereinafter referred to as the said Act ) , the Central Government , declared its intention to acquire the land specified in the Schedules annexed to the said notifications for building (widening / four laning , etc. ) , maintenance, management and operation of National Highway No.67 on the stretch of land from km. 284/600 to km.316/200 ( Karur - Coimbatore Section) in District Coimbatore in the State of Tamil Nadu .
And whereas the substance of the notification number S.O. 1827 (E ) , dated the 26th October 2007 has been published in " The Hindu " and " Daily thanthi " , both dated the 27th November 2007 and of notification number.S.O.936 ( E) dated the 24th April 2008 in "The Hindu " and " Daily Thanthi " , both dated the 16th May 2008 under sub- section (3 ) of Section 3A of the said Act.
And whereas 3D notifications were also published in respect of the aforesaid 3A( 1 ) notifications vide number S.O. 1194 ( E) , dated the 23rd May 2008 and number S.O. 2735 (E) , dated the 26th November 2008 respectively.
And whereas notices in respect of notifications number S.O. 1194 (E ) , dated the 23rd May 2008 and number S.O. 2735 ( E) , dated 26th November 2008, under sub section (3) of section 3G of the Act were published in "The Hindu " and " Daily Thanthi " , both dated the 16th July 2008 and " The Indian Express:, and " Daily Thanthi " , both dated the 11th January 2009 respectively.

And whereas Thiru . R.Natarajan and 8 others filed W.P.Nos . 19946 to 19954 of 2008 in the Hon'ble High Court of Madras objecting only to the publication of the notice under section 3G of the said Act in respect of notification number S.O. 1194 ( E) , dated the 23rd May 2008 and notification number S.O.2735 (E) , dated 26th November 2008 published on 16th July 2008 and on 11th January 2009 respectively for an extent of 10,223 Sq.mts . whereas the total extent notified in the above said 3D Notification number S.O. 1194 ( E) , dated the 23rd May 2008 and number S.O.2735(E) , dated the 26th November 2008 i.e 36,037 Sq.mts . in respect of Therkku Avinashipalayam village and for an extent of 20,478 Sq.mts . in notification number S.O. 1194 ( E) , dated the 23rd May 2008 , whereas the total extent notified in the above said 3D Notification i.e 36,353 Sq.mts . in respect of Alagumalai village . The Hon'ble High Court of Madras ordered interim stay on 18th August 2008 for dispossession of land alone . Therefore awards were passed on the 13th November 2008 for Alagumalai Village and on the 18th November 2008 and on the 31st July 2009 for Therkku Avinashipalayam Village for the full extent covered in 3D( 1 ) notifications .
Andwhereas in pursuance of W.P. Nos . 19946 to 19954 of 2008 and 22050 and 22051 of 2008 the Hon'ble Single Judge of High Court , Madras has dismissed the W.P. on the 03rd February 2010 on the ground that the order made under section 3C( 2) was not challenged before the Hon'ble High Court of Madras .
And whereas the petitioners have preferred Writ Appeal Nos . 339 to 349 of 2010 in Hon'bleHigh Court , Madras against the orders dated the 3rd February 2010 passed by the Learned Single Judge in W.P.Nos. 19946 to 19954 of 2008 and 22050 and 22051 of 2008 . As there was no stay , the NHAI requested the District Collector, Tiruppur to make necessary arrangements to take possession of the land required by NHAI after due compliance with section 3 (E ) of the said NH Act as the 3 (E ) notices under the referred sections were already issued by the competent authority and District Revenue Officer , Coimbatore on the 18th February 2009. As per Tiruppur Collector's proceedings dated the 15th June 2010 , the above land was taken in possession by the Regular Tahsildar , Tiruppur on the 30th June 2010. The Hon'bleHigh Court , Madras have issued orders on the 01st July 2010 to maintain the status quo.
And whereas, in the mean while , Thiru . R. Natarajan has filed Writ Petition No.17991 of 2010 in the Hon'ble High Court of Madras with a request to quash the proceedings dated the 15th June 2010 of the District Collector, Tiruppur The Hon'ble High Court , Madras have made an order of interim stay on the 10th August 2010 in W.P.No.17991/2010 and M.P.No.2 of 2010 and subsequently issued orders on the 18th August 2010 in M.P. No.2 of 2010 in W.P.No.17991 /2010 that as already status quo has been ordered in W.A.Nos.339 to 349 of 2010, there need be no interim stay in this petition .

And whereas in pursuance of Writ Appeal numbers 339 to 349 of 2010 and W.P. 17991 of 2010 preferred by the above said petitioners , the Hon'ble High Court, Madras was pleased to allow the Writ Appeals and issued orders on the 09th November 2010 to the effect that the order passed by the competent authority under section 3 -C( 2) of the NH Act 1956 and the consequential orders are quashed and directed the competent authority ( LA) , to consider the objections filed by the appellants under section 3 -C( 2) of the said Act and to dispose of the same in accordance with law by passing a reasoned order and further it has been instructed to the respondent to proceed in the matter.
And whereas Thiru . P. Murugesan has filed W.P. No. 17530 / 2008 objecting to the publication of the substance of the 3D ( 1 ) Notification, dated the 16th July 2008. The Hon'ble High Court passed order of interim stay for dispossession alone on the 24th July 2008. The Single Judge of the Hon'ble High Court passed order on the 08th February 2011 same as ordered in the Division Bench Judgment of W.A. No. 339 to 349 and W.P. 17991 of 2010.
And whereas the petitioners in the above said W.A. and W.P. Cases have been afforded opportunity of appearing before the competent authority for consideration of the objections.
And whereas objections have been received on the 20th December 2010 and the petitioners were given opportunities and called for an enquiry on the 15th March 2011 and on the 09th May 2011 and the same have been considered and disallowed by the competent authority and District Revenue Officer, District Tiruppur under section 3-C (2) of the said Act videorder in Roc . F4/15695/09 dated 22nd June 2011.

And whereas in pursuance of sub section (1 ) of section 3D of the said act , the competent authority has submitted its report to the Central Government .
Now, therefore , upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub- section (1 ) of Section 3D of the said Act , the Central Government hereby declares that the land specified in the said Schedule shouldbe acquired for the aforesaid purpose.
And further , in pursuance of sub- section (2) of Section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette , the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances .

SCHEDULE
Brief description of the land to be acquired , with or without structure , falling within the stretch of land from km 284/600 to km 316/200 (Karur - Coimbatore Section ) on the National Highways No.67 in Tiruppur District in the State of Tamil Nadu .
