2. विनियम 8(2 ) में निम्नलिखित उपबंध का समावेश होगा :

[बशर्ते कलकत्ता पत्तन न्यास कर्मचारी ( नियंत्रण ) विनियम , 1987 के विनियम 3 ( 11 ) के उपबंधों के तहत जहाँ किसी यौन उत्पीड़न का मामला हो , इन अभियोगों की जाँच के लिए अभियोग समिति गठित की गई, जिसे जाँच प्राधिकारी समझा जाएगा, जिसकी नियुक्ति अनुशासनिक प्राधिकारी द्वारा इन विनियमों हेतु की जाएगी और अभियोग समिति, यदि यौन उत्पीड़न के अभियोग में जाँच हेतु अभियोग समिति के लिए पृथक प्रक्रिया निर्धारित नहीं होती है तो इन विनियमों में दिए गए प्रक्रियाओं के अनुरूप व्यवहारिक रूप से जाँच करेगी । ] सा.का.नि. 769(अ), महापत्तन न्यास अधिनियम, 1963 (1963का अधिनियम 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 कीउप- धारा ( 1 ) द्वारा प्रदत्त शक्तियाँ प्रयुक्त करके , केन्द्रीय सरकार, एतद्वारा , कोलकाता पत्तन न्यास के न्यासी बोर्ड द्वारा तैयार किए गए कोलकाता पत्तन न्यास कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) पाँचवा संशोधन विनियम , 2011 को अनुमोदित करती है जो इस अधिसूचना के साथ लगी अनुसूची में निर्धारित है ।
2. उक्त अधिनियम , सरकारी राजपत्र में इसके प्रकाशन की तारीख से लागू होगा ।

NOTIFICATION
महापत्तन न्यास अधिनियम , 1963 ( 1963 का अधिनियम 38 ) की धारा 124 के साथ पठित धारा 28 का खंड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , कोलकाता पत्तन का न्यासी मंडल एतद्वारा कोलकाता पत्तन न्यास कर्मचारी ( वर्गीकरण , नियंत्रण और अपील) विनियम , 1987 को संशोधित कर निम्नलिखित विनियम बनाता है :-

1. संक्षिप्त शीर्षक व प्रारंभ. (i) इन विनियमों को कोलकाता पत्तन न्यास कर्मचारी ( वर्गीकरण , नियंत्रण और अपील ) पंचम संशोधन विनियम , 2011 के नाम से जाना जाएगा तथा राजपत्र में

1963 ) , the Central Government hereby approves the Kolkata Port Trust Employees' (Classification, Control and Appeal) 5th Amendment Regulations , 2011 made by the Board ofTrustees of Kolkata Port Trust as set out in the Schedule annexed to this Notification .
2. The said Regulations shall come into force on the dateoftheir publication in the Official Gazette.

SCHEDULE
Kolkata Port Trust Employees ' ( Classification , Control and Appeal) 5th Amendment Regulations , 2011
In exercise of the powers conferred by Clause (b) of Section 28 read with Section 124 of the Major Port Trusts Act , 1963 (Act 38 of 1963 ) , the Board of Trustees for the Port of Kolkata hereby makes the following Regulations to amend the Kolkata Port Trust Employees ' ( Classification , Control and Appeal ) Regulations , 1987 .
1. Short Title and Commencement . These Regulations shall be called Kolkata Port Trust Employees' (Classification, Control and Appeal ) 5th Amendment Regulations , 2011 and shall come into effect from the date of publication in the Official Gazette .

2. The following proviso shall be inserted below Regulation 8 (2 ) : --
[Provided that where there is a complaint of sexual harassment within the meaning of Regulation 3 ( 11 ) of the Calcutta Port Trust Employees ' ( Conduct) Regulations , 1987 , the Complaints Committee established for inquiring into such complaints , shall be deemed to be the Inquiring Authority appointed by the Disciplinary Authority for the purpose of these Regulations and the Complaints Committee. shall hold , if separate procedure has not been prescribed for the Complaints Committee for holding the inquiry into the complaints of sexual harassment , the inquiry as far as practicable in accordance with the procedure laid down in these Regulations. ]
Note . The principal regulations were published in the Gazette of India vide G.S.R. 700( E) , dated the 10th August, 1987. The ist Amenedment Regulation was published vide GS.R. 474(E) , dated the 20th April , 1988 , the 2nd Amendment regulation was published vide GS.R.372(E), dated the 27th March , 1992 , the 3rd Amendment Regulation was published by G.S.R. 223 (E) , dated the 26th March , 2004 and the 4th Amendment Regulation was published by G.S.R. 284(E) , dated the 12th May, 2006.
