नई दिल्ली, 19 अक्तूबर , 2011 का.आ. 2418 (अ) .-केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1035 (अ) , तारीख 7 मई, 2010 द्वारा कर्नाटक राज्य में राष्ट्रीय राजमार्ग सं . 13 के 102.000 कि.मी. से 299.000 कि.मी. तक (बीजापुर- हुंगुंड- होसपेट सेक्शन) का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् "प्राधिकरण" कहा गया है ) को सौंपा है ;
और भारतीय राष्ट्रीय राजमार्ग अधिनियम, 1988(1988 का 68) की धारा 14 के प्रावधान के अनुसरण में प्राधिकरण ने मैसर्स बीजापुर- हुंगुंड टोलवे प्राइवेट लिमिटेड, जो 24.12.2009 को प्रस्तुत की गई बोलियों का सफल बोलीदाता है , और जिसका रजिस्ट्रीकृत कार्यालय " सद्भाव . हाउस" ला गार्डन पुलिस चौकी के सामने, एलिसब्रिज, अहमदाबाद -380006 , गुजरात , भारत में है (जिसे इसमें इसके बाद "रियायतग्राही" कहा गया है) , के साथ राष्ट्रीय राजमार्ग सं. 13 के 102.000 कि.मी. से 202.000 कि.मी. तक (डिजाइन चैनेज 102.00 कि.मी. से 199.221 कि.मी. और नए रारा सं . 50 के नए चैनेज 225.800 कि.मी. से 323.021 कि.मी. ) (जिसे इसमें इसके पश्चात् उक्त खण्ड कहा गया है) बीजापुर- हुंगुंड सेक्शन का चार लेन के विभाजित कैरिएजवे के रूप में विकास तथा प्रचालन और अनुरक्षण के लिए करार किया है (जिसे इसमें इसके पश्चात् उक्त करार कहा गया है ) ।

अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अबधारण और संग्रहण) नियम, 2008 (जिसे इसमें इसके पश्चात् "नियम" कहा गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त खण्ड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन, निवेशित पूंजी पर ब्याज, उचित लाभ , यातायात का परिमाण तथा प्राधिकरण और रियायतग्राही के बीच हुए करार में निहित अवधि को ध्यान में रखते हुए, यह अधिसूचित करती है कि (1) 2

उक्त खण्ड के उपयोग के लिए यांत्रिक यानों पर चार या अधिक लेन के खण्डों के उपयोग हेतु निवल सड़क खण्ड की लम्बाई के लिए सारणी 1 के स्तंभ (2 ) में निर्दिष्ट दर पर शुल्क ( जिसे इसमें इसके बाद " आधार दर" कहा गया है ) लगाया और संग्रहीत किया जाएगा और पुलों/ संरचना/ बाइपास , जिनकी लागत पचास करोड़ या अधिक है , का उपयोग करने वाले नीचे सारणी 1 और 2 में निर्दिष्ट प्रकार के वाहनों पर सारणी सं. 2 में निर्दिष्ट आधार दरों पर शुल्क उद्ग्रहित और संग्रहीत किया जाएगा, और वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, जो भी पश्चात्वर्ती हो , करार में निर्दिष्ट अवसान की तारीख तक शुल्क का संग्रहण करने तथा उसे प्रतिधारित के लिए उक्त रियायतग्राही को प्राधिकृत करती है ;

1 . फीस का उद्ग्रहण और संग्रहण निम्नलिखित टोल प्लाजाओं पर ऐसे टोल प्लाजाओं के लिए निर्दिष्ट दूरी के लिए शोध्य और संदेय किया जायेगा

3. वर्ष 2011-12 के लिए , स्थानीय निजी यातायात के संबंध में मासिक पास की दर 190.00 रूपए (एक सौ नब्बे रूपए मात्र) है जो, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण औरं संग्रहण) नियम, 2008 के प्रावधानों के अनुसार, प्रत्येक वर्ष पुनरीक्षण के अध्यधीन है ।
4. राजमार्ग सेक्शन पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किये जाएंगे , अर्थात्: - 2.

5. जो यांत्रिक यान नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुमत्य भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के यानों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक यान से अधिक भार को हटा न दिया जाए ।
6. यांत्रिक यानों के प्रवर्ग, उनके लिए अनुमत्य भार, छूटप्राप्त यानों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।

7. उक्त नियम के नियम 12 के अनुसार उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
8. फीस का पुनरीक्षण उक्त नियमों के नियम 5 के अनुसार वार्षिक रूप से किया जाएगा परंतु वह पूर्ववर्ती पुनरीक्षण की तारीख से छः मास की अवधि के भीतर नही किया जायेगा ।

S.O. 2418 (E) . Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1035 (E) , dated the 7th May, 2010, issued under section 11 of the National Highways Authority of India Act, 1988 ( 68 of 1988) , the Central Government has entrusted the stretch from kilometer 102.000 to kilometer 299.000 ( Bijapur Hungud Hospet section) of National Highway No. 13 in the State of Karnataka to the National Highways Authority of India (hereinafter referred to as the " Authority" ) ;

And whereas , pursuant to the provision of section 14 of the National Highways Authority of India Act , 1988 ( 68 of 1988) , the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M / s Bijapur Hungund Tollway Private Limited , having its registered office at " Sadbhav House" , Opposite Law Garden Police Chowki , Ellisbridge , Ahmedabad - 380006 , Gujarat , India ( hereinafter referred to as the " Concessionaire " ) , the successful bidder for bids submitted on 24.12.2009 for the development of Bijapur - Hungund section from Km 102.000 to Km 202.000 (design chainage Km 102.00 Km 199.221 and new chainage Km 225.800 Km 323.021 of new NH No. 50 ) on National Highway No. 13 (hereinafter referred to as the " said section" ) to four lane divided carriageway and operation and maintenance of the said section .

Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 ( hereinafter referred to as the "Rules") , the Central Government , having regard to the expenditure involved in building, maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length for use of the four and more lane sections ( hereinafter referred to as " base rate" ) and at the base rates specified in the Table No.2 for bridges/ structure/ bypass costing Rupees Fifty crore or more on the Type of Vehicles specified in Table 1 and 2 below , and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later, till the termination date as specified in the agreement ;

3. The rate of monthly pass for local personal traffic is Rs.190.00 ( rupees One Hundred Ninety only) for the year 2011-12 which is subject to revision every year as per the provisions of the National Highways Fee ( Determination of Rates and Collection) Rules , 2008 .
4. For multiple journey on the highway section , passes shall be issued at the following rates , namely.

5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the Rules .
7 . The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .
8. The fee rates shall be revised annually in accordance with the Rule 5 of the said rules provided that no revision shall be effected with six months .
