सा.का.नि. 784(अ) .-केन्द्रीय सरकार, विधिक माप विज्ञान अधिनियम , 2009 (2010 का 1 ) की धारा 52 की उप- धारा ( 2 ) के खण्ड ( ञ ) के साथ पठित उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , विधिक माप विज्ञान ( पैकेज में रखी वस्तुएं) नियम, 2011 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम विधिक माप विज्ञान ( पैकेज में रखी वस्तुएं ) तृतीय संशोधन नियम , 2011 है ।
(2) ये 1 जुलाई , 2012 से प्रवृत्त होंगे ।
2. विधिक माप विज्ञान ( पैकेज में रखी वस्तुएं) नियम, 2011 (जिन्हें इसमें इसके पश्चात् मूल नियम कहा गया है ) में,
(क) नियम ( 5 ) के परन्तुक का लोप किया जाएगा ।
(ख ) खंड ( घ) में, उप- नियम ( 1 ) के तृतीय परन्तुक का लोप किया जाएगा ।
(ग) नियम 12 में , उप - नियम (6 ) के स्थान पर , निम्नलिखित उप-नियम रखा जाएगा , अर्थात्:-
" (6 ) इन नियमों के अधीन मात्रा की घोषणा में किसी भी प्रकार का ऐसा कोई शब्द अथवा पद अंतर्विष्ट नहीं होगा जिससे पैकेज में अंतर्विष्ट वस्तु की मात्रा के बारे में बढ़ा- चढ़ा कर , भ्रामक या अपर्याप्त प्रभाव पड़े या पड़ने की सम्भावना हो । " ,

(घ) नियम 19 में, उप- नियम (7 ) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्:-
" (7) पैकेजों पर अनिवार्य घोषणाओं की अपेक्षा फैक्ट्री स्तर पर और फैक्ट्री के डिपो के स्तर पर सुनिश्चित की जाएगी । " ,
(ङ) नियम 19 में, उप- नियम (8 ) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्:-
" (8 ) इस नियम के उपबंधों का अनुपालन न करने पर , इन पैकेजों के पाँच प्रतिनिधिक नमूनों को अभिग्रहण कर साक्ष्य के रूप में कार्रवाई की जा सकेगी और शेष पैकेजों को, यथास्थिति, निर्माता अथवा पैकर द्वारा अनुपालन पूरा करने के पश्चात् ही छोड़ा जाएगा । " ,
(च ) नियम 26 में खंड ( क ) के परन्तुक का लोप किया जाएगा ।
(छ) चतुर्थ अनुसूची में स्तंभ 3 के क्रम संख्यांक 15 के सामने की प्रविष्टि" आयतन " के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
" बजन"

NOTIFICATION
New Delhi , the 24th October, 2011
GS.R. 784(E ) .-In exercise of the powers conferred by sub- section ( 1 ) read with clause (j ) of sub- section (2) of Section 52 of the Legal Metrology Act, 2009 ( 1 of 2010), the Central Government hereby makes the following rules further to amend the Legal Metrology (Packaged Commodities) Rules, 2011 , namely :-
1. ( 1 ) These rules may be called as the Legal Metrology ( Packaged Commodities) Third Amendment Rules , 2011 .
(2).They shall come into force with effect from 1st July, 2012.
2. In the Legal Metrology (Packaged Commodities ) Rules, 2011 (hereinafter referred to as the principal rules ) ,-
(a) the proviso to the Rule 5 shall be omitted.
(b) in clause (d) , sub - rule ( 1 ) third proviso shall beomitted.
(c) in rule 12, for sub - rule (6 ) , the following sub-rule shall be substituted, namely : ---
"(6) the declaration of the quantity under these rules shall not contain any word or expression, of any sort whatsoever, which tends to create or is likely to create an exaggerated, misleading or inadequate

expression as to the quantity of the commodity contained in the package. " ,
(d) in rule 19 , for sub- rule (7) , the following sub - rule shall be substituted , namely :---
"(7) the requirement of mandatory declarations on packages shall be ensured either at the factory level and at the depot of the factory. ",
(e) in rule 19 , for sub - rule (8 ) , the following sub- rule shall be substituted, namely :-
"(8) For non- compliance of the provisions ofthis rule , action may be taken after seizing five representative samples of the packages as evidence and the rest of the packages may be released only after compliance is completed bythemanufacturer or the packer, as the case maybe.",
(f) in rule 26, in clause ( a) , the proviso shall be omitted.
(g) in the Forth Schedule , for the entry " volume" in column 3 against serial number 15 , the following entry shall be substituted, namely:- "weight".
