का.आ. 2437(अ).-मोटरयान अधिनियम , 1988 की धारा 58 की उप - धारा ( 3 ) एवं धारा 110 की उप- धारा ( 3 ) ( ए ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार, एतद्वारा , निम्नलिखित ट्रेलरों के महाराष्ट्र में पंजीकरण हेतु , जिनका अधिकतम सुरक्षित लदान भार और आकार संलग्न अनुसूची में उल्लिखित है , अनुमोदन प्रदान करती है :-

6. उपर्युक्त छूट इन शर्तों के अध्यधीन है:-
(i ) इन ट्रेलरों का प्रचालन कभी- कभार किया जाएगा ।
( ii ) लो. नि. वि./स्थानीय प्राधिकारियों/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभिन्न सड़कों के लिए विनिर्दिष्ट भार प्रतिबंधों का अनुपालन किया जाएगा और वाहनों को प्रत्येक बार सड़कों पर लाते समय इन प्राधिकारियों से अनुमति ली जाएगी । सुरक्षा की दृष्टिसे ट्रेलरों का प्रत्येक प्रचालन राज्य/संघ शासित प्रदेश/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के संबंधित परिवहन विभाग द्वारा अनुमोदित किया जाएगा और उस पर कड़ी निगरानी रखी जाएगी ।
( iii ) वाहन पर खतरे संबंधी सभी झंडियां और बत्तियां लगी होनी चाहिएं, बेहतर यह होगा कि लदे हुए वाहन के आगे तथा पीछे एक - एक वाहन स्पष्ट रूप से यह दर्शाता हुआ चले कि भारी लदा हुआ वाहन गुजर रहा है ।
( iv ) सड़क की चौड़ाई में ट्रेलरों को जोड़ने की अनुमति नहीं दी जाएगी ।
( v ) वाहनों के आवागमन कार्यक्रम की सूचना कम- से - कम दस दिन पूर्व संबंधित कार्यपालक इंजीनियरों को दी जानी चाहिए और उनकी स्वीकृति प्राप्त कर लेनी चाहिए ।
( vi ) ट्रेलरों का अलग पंजीकरण किया जाएगा न कि संयुक्त रूप से ।
( vii ) किसी राज्य या केन्द्र शासित प्रदेश के लोक निर्माण विभाग/स्थानीय प्राधिकारियों/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा यदि ऐसा निर्देश दिया जाए तो लदे हुए वाहनों को उस राज्य/संघ शासित प्रदेश में सड़कों पर बने पुलों से गुजरने की अनुमति नहीं होगी और ऐसे मामलों में आवेदकों को नदियों/नालों को पार करने के लिए स्वयं व्यवस्था करनी होगी ।
( viii ) बड़े आकार के कार्गो को ध्यान में रखते हुए उन्हें किसी मार्ग विशेष पर चलने से पहले प्रत्येक बार संबंधित राज्य या संघ शासित प्रदेश के प्राधिकारियों/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण की अनुमति प्राप्त करनी होगी । ऐसे प्रत्येक आवागमन के लिए संबंधित प्राधिकारी द्वारा समय का निर्धारण किया जाना चाहिए
( ix ) वे राज्य/संघ शासित प्रदेश/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के प्राधिकारियों द्वारा निर्धारित गति- सीमा का पालन करेंगे ।
( x ) उक्त वाहन , यातायात के सामान्य आवागमन में कोई बाधा पहुंचाए बगैर चलाया जाना चाहिए ।
(xi ) सड़क पर चलने के लिए ट्रेलरों की अधिकतम गति दस कि. मी. /घंटा से अधिक नहीं होनी चाहिए
( xii ) ट्रेलरों की सम्पूर्ण चौड़ाई में अगले एवं पिछले हिस्से पर पीले एवं काले रंग से जेबरा पट्टी बनाई जाएगी और उस पर रात्रि के समय चलाने के लिए विधिवत् लिखा होना चाहिए/पार्किंग के लिए आगे और पीछे समुचित रूप से लाल बत्ती होनी चाहिए तथा दिन में दोनों ओर लाल झण्डी लगाई जाएंगी , जिससे वाहन की सही- सही स्थिति का स्पष्ट रूप से पता चल सके। इसके अतिरिक्त , माल का बाहरी भाग पूरी तरह से एक लाल परावर्तक/परावर्ती टेप से ढका होना चाहिए ताकि रात्रि के समय बाहरी भाग निर्विघ्न रूप से दिखाई दे ।
(xii ) मै. एम एफ सी ट्रांसपोर्ट प्रा. लि. , मुम्बई , सड़कों अथवा सड़क ढांचों/ अन्य सड़क प्रयोक्ताओं/व्यक्तियों को ऐसे वाहनों के प्रचालन के कारण प्रत्यक्ष अथवा अप्रत्यक्ष रूप से हुई किसी क्षति के लिए राज्य/ संघ शासित प्रदेश सरकार/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण या किसी अन्य प्रभावित व्यक्ति को ऐसी राशि का भुगतान करने के लिए जिम्मेदार होगा ।
(xiv) मै. एम एफ सी ट्रांसपोर्ट प्रा. लि. , मुम्बई, ऐसे प्रतिबंधों का पालन करेंगे जो इस संबंध में राज्य सरकारों/संघ शासित प्रदेश/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा आदेश द्वारा विनिर्दिष्ट किए जाएं ।
( xv) मै. एम एफ सी ट्रांसपोर्ट प्रा. लि. , मुम्बई , ऐसे वाहनों के प्रत्येक बार आवागमन के संबंध में राज्य सरकार/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा इस संबंध में विनिर्दिष्ट ऐसे प्राधिकारी या अधिकारी को अग्रिम सूचना देगा ।
(xvi ) पंजीकरण प्रमाण- पत्र में एक विशेष प्रविष्टि की जाए कि वाहनों के मालिक के लिए यह आवश्यक होगा कि वह प्रत्येक प्रचालन के लिए संबंधित प्राधिकारी अर्थात् राज्य सरकार/संघ शासित प्रदेश सरकार/ भारतीय राष्ट्रीय राजमार्ग प्राधिकरण से अनुमति प्राप्त करे ।
7. केन्द्रीय मोटरयान नियमावली , 1989 के नियम 47 के तहत निर्धारित शर्तें पूरी करने तथा बिक्री दस्तावेज ( बीजक , सभी करों के भुगतान का सबूत ) प्रस्तुत करने के बाद ही महाराष्ट्र राज्य में ट्रेलरों का पंजीकरण किया जाएगा ।

NOTIFICATION
New Delhi , the 25th October, 2011
S.O. 2437 (E) . In exercise of the powers conferred by sub -section (3 ) of Section 58 and sub- section (3)(a) of Section 110 of the Motor Vehicles Act , 1988 , the Central Government hereby accords approval to the registration in Maharashtra of following trailers with maximum safe laden weight and dimensions as mentioned in the Schedule appended hereto :--

6. The above relaxation is subject to the conditions that :-
(i) The operations of the trailer shall be done only sparingly.
(ii) Load restrictions on various roads stipulated by the Public Works Department/ Local Authorities/National Highway Authority of India will be observed and permission of such authorities will be obtained every time the vehicles are put on the roads . Each of such movement of the trailers will be approved and closely monitored by the concerned road authorities in State/Union Territory/National Highway Authority of India from safety point of view.
(iii) The vehicles should display all danger flags and lights , preferably the vehicle should be preceded and followed by a vehicle displaying prominently that a heavy load is passing.
(iv) Coupling of the trailers along side by side the width of the road shall not be permitted.
(v) The program of the movement of the trailer should be intimated at least ten days in advance to the Executive Engineers concerned and their clearance obtained.
(vi) The trailer shall be registered individually and not as a combination .
(vii) If so directed by the Public Works Department of a State /Union Territory/National Highway Authority of India, the loaded vehicles will not be allowed to pass over the bridges on the roads in that State/ Union Territory and in such cases applicants will have to make their own arrangements to cross the rivers/drains .
(viii) They would need to obtain permission each and every time before moving on a particular route from concerned State or Union Territory Authorities/National Highway Authority of India enroute , in view of the oversized cargo. For each such movement, the timing should be prescribed by the concerned authority.

(ix) They would adhere to the speed limits prescribed by the authorities in State /Union Territory /National HighwayAuthority of India.
(x).The said vehicles should be moved without any hindrance to the normal flow of traffic .
(x1) The maximum speed of the trailer for movement on the road shall not exceed 10 kms./hour .
(xii) The trailer shall be painted for the entire width by yellow and black zebra strips on the front and rear sides duly marked for night time driving/parking suitably by red lamps at the front and rear and red flags on both the sides during day time to indicate the extreme position of the vehicles clearly. In addition the entire overhang shall be covered with a red reflector/reflective tape to facilitate clear vision of overhang at night time.
(xii) M/s . MFC Transport, Pvt. Ltd. , Mumbai, would be liable to pay such amount to the Government of State/ Union Territory/National Highway Authority of India or any other affected person where any damage is caused to the roads or road structures/other road users /person directly or indirectly due to the movement ofthe trailers .
(xiv) M/s . MFC Transport, Pvt . Ltd. , Mumbai , will observe such restrictions as the State /Union Territory Government/National Highway Authority of India may by order specify in this behalf.
(xv) M/s . MFC Transport, Pvt . Ltd. , Mumbai, will give advance intimation to such authority or officer specified in this behalf by the State Government/Union Territory Government/National Highway Authority ofIndia regarding each movement of such vehicles .
(xvi) A specific entry in Registration Certificate is to be made that the trailers owner in case of each and every movement will be required to take the permission of concerned Authority i.e. State Government/Union TerritoryGovernment/National Highway Authority of India .
7. The trailer shall be registered in the State of Maharashtra only subject to fulfilment of conditions laid down under Rules 47 of the Central Motor Vehicles Rules , 1989 and production of sale documents ( invoice , proof ofpayment of alltaxes)..
