नई दिल्ली, 27 अक्तूबर , 2011 का.आ. 2445(अ).-विदेशी अभिदाय ( विनियमन) अधिनियम, 2010 ( 2010 का 42 ) की धारा 40 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्वारा उक्त धारा के अंतर्गत अपेक्षित पूर्व स्वीकृति के लिए निम्नलिखित अधिकारियों को प्राधिकृत करती है , नामतः
(i ) केन्द्रीय जांच ब्यूरो द्वारा जांच किए गए अपराधों के संबंध मेंकेन्द्रीय गृह सचिव;
( ii ) राज्य सरकारों की जांच एजेंसियों ( अपराध शाखा ) द्वारा जांच करने वाले अपराधों के संबंध में संबंधित राज्य सरकार के गृह सचिव ।

New Delhi, the 27th October, 2011
S.O. 2445 (E).-In exercise ofthe powers conferred by Section 40 of the Foreign Contribution (Regulation) Act, 2010 (42 of 2010 ) , the Central Government hereby authorises the following officers for according previous sanction as required under the said section , namely:-
(i) the Union Home Secretary in respect ofoffences investigated by the Central Bureau of Investigation;

(ii) the Home Secretary of the State Government concerned, in respect of offences investigated by the Investigating Agencies (Crime Branch) of the State Governments .

का.आ. 2446(अ).-विदेशी अभिदाय (विनियमन ) अधिनियम, 2010 (2010 का 42 ) की धारा 43 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्वारा उक्त अधिनियम के अंतर्गत दण्डनीय अपराधों की जांच हेतु निम्नलिखित संगठनों के पुलिस उप- निरीक्षक स्तर के अधिकारियों को प्राधिकारी के रूप में विनिर्दिष्ट करती है :
( i ) एक करोड़ रु. से कम या समतुल्य राशि के विदेशी अभिदाय की प्राप्ति के संबंध में विदेशी अभिदाय (विनियमन ) अधिनियम , 2010 ( 2010 का 42 ) के प्रावधानों के प्रथम दृष्टया उल्लंघन वाले अपराधों के संबंध में संबंधित राज्य सरकार की जांच एजेंसियां ( अपराध शाखा);
(ii ) एक करोड़ रुपये या समतुल्य या इसके अधिक राशि के विदेशी अभिदाय की प्राप्ति के संबंध में विदेशी अभिदाय (विनियमन ) अधिनियम, 2010 ( 2010 का 42 ) के प्रावधानों के प्रथम दृष्टया उल्लंघन वाले अपराधों के संबंध में तथा केन्द्र सरकार द्वारा उक्त अधिनियम के तहत विशेष रूप से सौंपे गए किसी अन्य मामले के संबंध में केन्द्रीय जांच ब्यूरो (सी.बी.आई. ) ।

NOTIFICATION
New Delhi , the 27th October , 2011
S.O. 2446(E) . In exercise of the powers conferred by Section 43 of the Foreign Contribution (Regulation) Act, 2010 (42 of 2010 ) , the Central Government hereby specifies that the officers not below the rank of Sub- Inspector ofPolice of the following organisations shall be the authorities for investigation of offences punishable under the said Act :-
(1) Investigating Agencies ( Crime Branch) of the StateGovernments , cause ofaction which arises in their respective States in respect of the offences that involve a primafacie violation of the provisions of the Foreign Contribution
[PART II-SEC. 3(ii ) ]
(Regulation) Act , 2010 (42 of2010) with regard to receipt of foreign contribution of an amount of less than one crore rupees or equivalent ;
(ii) Central Bureau of Investigation (CBI ) with regard to offences that involve a primafacie violation of the provisions of the Foreign Contribution (Regulation) Act , 2010 (42 of 2010 ) involving receipt of foreign contribution of an amount of one crore rupees or equivalent or above and in any other case which maybe specifically entrusted to the CBI by the Central Government under the said Act.
