का.आ. 2482(अ). अन्तर्राज्यिक जल विवाद अधिनियम , 1956 ( 1956 का 33 ) की धारा 4 के अधीन अधिसूचना सं. का.आ. 437 (अ ) द्वारा तारीख 2 जून , 1990 को कावेरी जल विवाद अधिकरण ( जिसे इसके पश्चात् उक्त अधिकरण कहा गया है ) का गठन अन्तर्राज्यिक कावेरी नदी और उसकी नदी घाटी से संबंधित जल विवादों के न्यायनिर्णयन के लिए किया गया था;
उक्त अधिकरण से उक्त अधिनियम की धारा 5 की उप- धारा ( 2 ) के अधीन उसकी रिपोर्ट और विनिश्चय को 5 अगस्त , 2005 को या उससे पूर्व प्रस्तुत करने की अपेक्षा की गई थी;
केन्द्रीय सरकार ने अधिसूचना सं. का.आ. 980 ( अ ) , तारीख 12 जुलाई , 2005 द्वारा , रिपोर्ट और विनिश्चय प्रस्तुत करने की अवधि को 6 अगस्त, 2005 से एक वर्ष की और अवधि के लिए विस्तारित किया था;
और केन्द्रीय सरकार ने अधिसूचना सं. का.आ. 1399 ( अ) , तारीख 1 सितम्बर , 2006 द्वारा , रिपोर्ट और विनिश्चय को प्रस्तुत करने कीअवधि को 6 अगस्त, 2006 से छह मास की और अवधि के लिए फिर विस्तारित किया था;
और उक्त अधिकरण ने उक्त अधिनियम की धारा 5 की उप- धारा ( 2 ) के अधीन उसकी रिपोर्ट और विनिश्चय , 5 फरवरी , 2007 को प्रस्तुत कर दिए थे;
और पक्षकार राज्यों और केन्द्रीय सरकार , ने उक्त अधिनियम की धारा 5 की उप- धारा ( 3 ) के परंतुक के अधीन 27 अप्रैल , 2007 , 30 अप्रैल, 2007 और 3 मई, 2007 को उक्त अधिकरण को और निर्देश किया था तथा अधिकरण ने 3 मई, 2007 से एक वर्ष के भीतर अतिरिक्त रिपोर्ट प्रस्तुत करनी थी;
और केन्द्रीय सरकार ने उक्त अधिकरण के अनुरोध पर अधिसूचना सं. का.आ. 1164( अ) , तारीख 16 मई , 2008 द्वारा उक्त अधिकरण द्वारा और रिपोर्ट को प्रस्तुत करने की अवधि को 3 मई, 2008 से छह मास की अतिरिक्त अवधि के लिए विस्तारित किया था; तथा अधिसूचना सं. का.आ. 2506 ( अ ) , तारीख 23 अक्तूबर , 2008 द्वारा उक्त अधिकरण द्वारा अतिरिक्त रिपोर्ट प्रस्तुत करने की अवधि को 3 नवम्बर , 2008 से एक वर्ष की और अवधि के लिए विस्तारित किया था; तथा अधिसूचना सं. का.आ. 2628 ( अ) , तारीख 19 अक्तूबर , 2009 द्वारा उक्त अधिकरण द्वारा अतिरिक्त रिपोर्ट प्रस्तुत करने की अवधि को 3 नवम्बर , 2009 से एक वर्ष की और अवधि के लिए विस्तारित किया था तथा पुनः अधिसूचना सं. का.आ. 2605 ( अ) , तारीख 21 अक्तूबर, 2010 द्वारा उक्त अधिकरण द्वारा अतिरिक्त रिपोर्ट प्रस्तुत करने की अवधि को 3 नवम्बर , 2010 से एक वर्ष की और अवधि के लिए विस्तारित किया था;
और उक्त अधिकरण ने अतिरिक्त रिपोर्ट प्रस्तुत करने की अवधि को विस्तारित करने का पुनः अनुरोध किया है;
अतः अब , केन्द्रीय सरकार, उक्त अधिनियम की धारा 5 की उप- धारा ( 3 ) के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त अधिकरण द्वारा अतिरिक्त रिपोर्ट प्रस्तुत करने की अवधि को 3 नवम्बर, 2011 से एक वर्ष की और अवधि के लिए विस्तारित करती है।

NOTIFICATION

S.O. 2482 ( E) .-Whereas , the Cauvery Water Disputes Tribunal (hereinafter referred to the said Tribunal) was constituted on 2nd June , 1990 vide notification number S.O. 437 (E), dated the 2nd June, 1990 under Section 4 ofthe Inter-StateRiver Water Disputes Act, 1956 ( 33 of 1956) for the adjudication of the water disputes regarding Inter-State RiverCauvery and river valley thereof;
And whereas the said Tribunal was required to submit its report and decision under sub- section (2) of Section 5 of the said Act on or before 5th August, 2005;
And whereas the Central Government, vide notification number S.O. 980(E) , dated the 12th July, 2005 had extended the period of submission of report and decision for a further period of one year with effect from 6thAugust, 2005;
And whereas the Central Government vide notificationnumber S.O. 1399 (E) , dated the 1st September, 2006 extended the period of submission of report and decision for a further period of six months with effect from 6th August, 2006;
And whereas the said Tribunal submitted its report and decision under sub - section (2) of Section 5 of the said Act on 5th February, 2007;
And whereas the party States and Central Government made further reference to the said Tribunal

under the proviso to sub-section (3 ) of Section 5 of the said Act on 27th April , 2007 , 30th April , 2007 and 3rd May, 2007 and the Tribunal had to submit a further report within one year from 3rd May, 2007;
Andwhereas the Central Government , on request of the said Tribunal , vide notification number S.O. 1164 (Ε) , dated 16th May, 2008 extended the period of submission of further report by the said Tribunal for a further period of six month with effect from 3rd May, 2008 ; and vide notification number S.O.2506( E) , dated 23rd October, 2008 extended the period of submission of further report by the said Tribunal for a further period of one year with effect from 3rd November, 2008 and again vide number S. O. 2628(Ε) , dated the 19th October, 2009 extended the period of submission of further report by the said Tribunal for a furtherperiod of one year with effect from 3rd November , 2009; and again vide notification number S.O. 2605(E) , dated 21stOctober, 2010 extended the period of submission of further report by the said Tribunal for a further period of one year with effect from 3rd November , 2010 ;
And , whereas the said Tribunal has again requested to extend the period of submission of further report;
Now, therefore, in exercise of the powers conferred by proviso to sub- section (3 ) of Section 5 of the said Act , the Central Government hereby extends the period of submission of further report by the said Tribunal for a further period of one year with effect from 3rd November , 2011.
