का.आ. 35 (अ).-विदेश व्यापार नीति 2009-14 के पैरा 2.1 के साथ पठिन 2010 में यथा मशाधित विदेश व्यापार ( विकास और विनियमन ) अधिनियम , 1992 [ एफटी ( डी ण्ट आर ) अधिनियम , 1992 ] की धारा 5 द्वारा प्रदत्त शक्तिया का प्रयोग करते हुए , केन्द्र सरकार एनद्दाग निर्यात और आयात मदों के आइटीसी ( एचएस ) वर्गीकरण , 2009-14 की अनुसूची-2 के " परिशिष्ट -3 " में तत्काल प्रभाव से निर्माखित संशोधन करती है ।
2. निर्यात ओर आयात मदों के आईटामी ( एचएस ) वर्गीकरण , 2009-14 की अनुसूची-2 के " परिशिष्ट-3 " के प्रथम पृष्ठ के दूसरे पैरा के बाद निम्नलिखित पग जोड़ा जाता ह
"डीटीए से एसईजेड को स्कोमैट मदों की आपूर्ति
डीटीए से एसईजेड को स्कोमैट मदों की आपूर्ति के लिए किसी निर्यात अनुमति की आवश्यकता नहीं है । तथापि , डीटीए से एसईजेड को स्कोमैट मदों की सभी आपूर्तियों की सूचना आपूर्तिकर्ता द्वारा संबंधित एसईजेड के विकास आयुक्त को उक्त आपूर्तियों के प्रभावी होने से एक सप्ताह के भीतर निर्धारित प्रपत्र ( अनुलगक -1 ) में देनी होगी । डीटीए से एसईजेड को की गई ऐसी आपूर्तियों की वार्षिक रिपोर्ट, निर्धारित प्रपत्र (अनुलग्नक-2 ) में विकास आयुक्त ( डीसी ) , एसईजेड द्वारा स्कोमेट सेल डीजीएफटी ( मुख्यालय ) , वाणिज्य विभाग , उद्योग भवन , मोलाना आज़ाद रोड , नई दिल्ली-110011 को भजनी होगी । पिछल वित्तीय वर्ष के दौगन की आपूर्तियों की रिपोर्ट विकास आयुक्त, एसडजट द्वारा प्रत्येक वित्तीय वर्ष की 15 मई तक प्रग्नून क्ररनी हागो ।
एसईजेड में देश के बाहर स्कोमैट मदों का निर्यात
यदि स्कोमेट मदा का वास्तविक रूप से निर्यात एसईजेड में देश के बाहर यानि दूसरे देश को किया जाता है , तो निर्यात अनुमति आवश्यक है ( एसईजेड नियमावली , 2006 के नियम 26 का मदर्भ नल)। "
अधिसूचना का उद्देश्य विदेश व्यापार नीति और एमरजड नियमावली , 2005 में उल्लिखित मोजूदा नीतिगत प्रावधानों के अनुसार, डॉली से गदजड को स्कोमेट भरा की आपूर्ति हेतु निर्याद अनुमति आवश्यक है। इस अधिमृत्रास क नहत एसी अनुमति की आवश्यकता नही होगी । तथापि. एसईजेड ओर डीटीए ( ईओयू सहित ) दोनों से देश के बाहर स्कोमैट मदों के निर्यात के लिए निर्यात अनुमति की आवश्यकता बनी रहेगी ।

NOTIFICATION
New Delhi , the 6th January, 2012
No. 93 ( RE- 2010 ) /2009-2014
S.O.35 ( E) . In exercise of powers conferred by Section 5 of the Foreign Trade ( Development & Regulation ) Act 1992 ( FT( D & R) Act , 1992 } as amended in 2010, read with Para 2.1 of Foreign Trade Policy 2009-14, the Central Government hereby makes the following amendment to 'Appendix 3 ' to Schedule 2 of ITC ( HS) Classifications of Export and Import Items , 2009-14 with immediate effect .
2. Following para is added after the second para on first page of 'Appendix 3 ' to Schedule 2 ofITC ( HS ) Classifications of Export and Import Items , 2009-14:
"Supply of SCOMET Items from DTA to SEZ
No export permission is required for supply of SCOMET items from DTA to SEZ . However, all supplies of SCOMET items from DTA to SEZ will be reported to the Development Commissioner of the respective SEZ by the supplier in the prescribed proforma ( Annexure 1 ) within one ( 1 ) week of the supplies getting effected . An annual report of such supplies from DTA to SEZ shall be sent to SCOMET Cell , DGFT ( Hars ) , Department of Commerce, Udyog Bhawan , Maulana Azad Road , NewDelhi - 110011 , by the Development Commissioner ( DC ) , SEZ in the prescribed proforma ( Annexure 2) . Report by the DC, SEZ tobe filedby 15th May of every financial year for the supplies effected during the preceding financial year .
Exportof SCOMET Items from SEZ to outside the country
Exportpermission is required if the SCOMET items are to be physically exported outside the country from SEZ i.e. to another country ( Refer Rule 26 of the SEZ Rules , 2006) . "
3. Purpose of the notification : As per the extant policy provisions enshrined in FTP and SEZ Act, 2005, export permission is required for supply of SOMET items from DTA to SEZ . With this notification , no such permission will be required . However , export permission will continue to be required for export of SCOMET items outside the country both from SEZ and DTA ( including EOUS).
