का.नि.आ. 05(अ).-केन्द्रीय सरकार , सशस्त्र बल अधिकरण अधिनियम , 2007 ( 2007 का 55 ) की धारा 41 की उप - धारा ( 2 ) के खण्ड ( च ) , खण्ड ( छ ) और खण्ड ( ट ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सशस्त्र बल अधिकरण ( प्रक्रिया ) नियम , 2008 का संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सशस्त्र बल अधिकरण ( प्रक्रिया ) संशोधन नियम , 2011 है ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. सशस्त्र बल अधिकरण ( प्रक्रिया ) नियम , 2008 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) में , ( क ) नियम 7 को उसके उप - नियम ( 1 ) के रूप में पुनर्संख्यांकित किया जाएगा और इस प्रकार पुनर्संख्यांकित नियम 7 के उप- नियम ( 1 ) के पश्चात् निम्नलिखित उप -नियम अंतःस्थापित किया जाएगा , अर्थात्:-
" ( 2 ) उप- नियम ( 1 ) में किसी बात के होते हुए भी उस उप - नियम में निर्दिष्ट आवेदन फीस केवल निम्नलिखित के संबंध में संदेय होगी -
( i ) मूल आवेदन ( मू.आ. ) ;
( ii ) पुनर्विलोकन आवेदन ( पू.आ. ) ;
(iii ) अवमान आवेदन ( अ.आ. ) ;
( iv ) अर्जी के पुनर्स्थापन के लिए आवेदन ( प्र.आ. ) ; और
( v ) मामले के अंतरण के लिए आवेदन ( एक पीठ से दूसरी पीठ में या उसी पीठ के किसी न्यायालय से किसी अन्य न्यायालय में ) ( अं.आ. ) " ।
3. मूल नियम के नियम 12 के पश्चात् निम्नलिखित उप- नियम अंतःस्थापित किया जाएगा , अर्थात्:-
" 12क. नियम 8 के अधीन प्रत्येक आवेदन और नियम 12 के अधीन उसका उत्तर उस व्यक्ति के द्वारा जिसने यथास्थिति आवेदन या उत्तर सत्यापित किया है , शपथ पत्र से समर्थित होगा । "

NOTIFICATION
New Delhi , the 29th July, 2011
S.R.O. 05 (E) .-In exercise of the powers conferred by clauses ( f) , (g) and (k) of sub - section ( 2) of Section 41 of the Armed Forces Tribunal Act , 2007 (55 of 2007) , the Central Government hereby makes the following rules to amend the Armed Forces Tribunal (Procedure) Rules , 2008 , namely : --
1. Short title and Commencement . ( 1 ) These rules may be called the Armed Forces Tribunal ( Procedure) Amendment Rules , 2011 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. IntheArmed Forces Tribunal (Procedure) Rules , 2008 , (hereinafter referred to as the Principal Rules ) , (a) Rules 7 shall be re - numbered, as sub-rule ( 1 ) thereof and after sub - rule ( 1) of rules 7 as so re- numbered, the following sub- rule shall be inserted, namely :---
"(2) Notwithstanding anything contained in sub- rule ( 1 ) , the application fee referred to in that sub- rule shall be payable only in respect of-
(1) Original Application (OA) ;
(ii) Review Application (RA) ;
(iii) Contempt Application (CA) ;
(iv)Application for restoration of Petition ( MA) ; and
(v) Application for transfer of case ( from one Bench to another or from one court to another in the same Bench ) ( AT) " .
3. After rule 12 of the principal rules, the following sub - rule shall be inserted , namely :-
" 12A. Every application under rule 8 and the reply under rule 12 shall be supported by an affidavit of the person verifying the application or reply, as the case may be . "
