सा.का.नि. 5 (अ).- केन्द्रीय सरकार, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 34 की उपधारा (2) के खंड ( क ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( सदस्यो की पदावधि और अन्य सेवा शर्ते) नियम , 2003 में और सशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्
1 ( 1 ) इन नियमो का सक्षिप्त नाम भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( सदस्यो की पदावधि और अन्य सेवा शर्तें) संशोधन नियम , 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगे ।

2 भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( सदस्यो की पदावधि और अन्य सेवा शर्ते) नियम, 2003 (जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है) के नियम 3 के स्थान पर निम्नलिखित नियम रखा जाएगा अर्थात
' 3. अध्यक्ष के रूप में नियुक्ति के लिए अर्हता ( 1 ) कोई व्यक्ति अध्यक्ष के पद के लिए तभी अर्हित होगा जब
(क) वह भारत सरकार मे नियमित आधार पर सचिव या भारत सरकार में कम से कम दो वर्ष से अपर सचिव, या समतुल्य पद धारित करता है या धारित किया हा , या
(ख) पब्लिक सेक्टर उपक्रम विभाग द्वारा यथा अधिसूचित अनुसूची 'क' केन्द्रीय पब्लिक सेक्टर उपक्रम , जो मुख्यत अवसरचना जिसके अतर्गत अवसरचना वित्त पोषण भी है, में कार्यरत है, के बोर्ड मे पूर्णकालिक निदेशक है या रहा हो, या

(ग) अवसंरचना क्षेत्र में कार्यरत पब्लिक या प्राइवेट सेक्टर की अस्तित्व में या अवसंरचना वित्त- पोषण के क्षेत्र में कार्यरत अस्तित्व, जिसका शुद्ध मूल्य दो हजार करोड़ रुपए से कम न हो, में मुख्य कार्यकारी अधिकारी या निदेशक या समतुल्य पद धारित करता है या किया हो ,
और उसे अवसरचना और वित्ल क्षेत्र में कार्य करने का वृत्तिक ज्ञान और अनुभव हो
परन्तु उक्त खण्ड ( ग) में निर्दिष्ट अस्तित्व से किसी व्यक्ति पर अध्यक्ष के पद के लिए तभी विचार किया जाएगा जब उसने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण के साथ कार्य करने वाली संस्था की अपनी नौकरी से त्यागपत्र देने के पश्चात् दो वर्ष की विराम अवधि पूरी कर ली हो । '
(2) अध्यक्ष की नियुक्ति, खोज समिति की सिफारिशें प्राप्त किए जाने के पश्चात् की जाएगी जिसमें निम्नलिखित शामिल होंगे-
(क) मंत्रिमंडल सचिव
अध्यक्ष
(ख) सचिव, सड़क परिवहन और राजमार्ग मंत्रालय सदस्य
(ग) सचिव, योजना आयोग सदस्य
सदस्य (घ) निदेशक, इंडियन इंस्टीट्यूट आफ मैनेजमेंट, अहमदाबाद या बंगलौर या कोलकाता या इन्दौर या कोझीकोड या लखनऊ
(ड. ) अध्यक्ष-सह-प्रबन्ध निदेशक, इंडियन इंफ्रास्ट्रक्चर फाइनेंस कॉरपोरेशन लिमिटेड या भारतीय स्टेट बैंक या पंजाब नेशनल बैंक या बैंक ऑफ इंडिया या बैंक ऑफ बड़ौदा सदस्य
3. अर्थात्: - उक्त नियमों के नियम 5 उपनियम ( 1 ) के स्थान पर, निम्नलिखित उपनियम रखा जाएगा, '( 1 ) अध्यक्ष , इस रूप में अपना पद ग्रहण करने की तारीख से 3 वर्ष की अवधि के लिए पद धारण करेगा और दो वर्ष की और अवधि के लिए पुनर्नियुक्ति के लिए पात्र होगाः
परन्तु अध्यक्ष , पैंसठ वर्ष की आयु प्राप्त करने के पश्चात् इस रूप में पद धारण नहीं करेगा । '

NOTIFICATION
New Delhi , the 10th January, 2012
GS.R. 5 (E) . In exercise of the powers conferred by clause ( a) of sub- section (2 ) of section 34 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Central Government hereby makes the following rules further to amend the National Highways Authority of India (the term of office and other conditions of Service of Members ) Rules , 2003, namely: -
1. (1) These rules may be called the National Highways Authority of India ( the term of office and other conditions of Service of Members ) Amendment Rules , 2012 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2.. In the National Highways Authority of India ( the term of office and other conditions of Service of Members ) Rules , 2003 ( hereinafter referred to as the said rules ) , for rule 3, the following rule shall be substituted , namely: -
'3. Qualification for appointment as Chairman. (1 ) A person shall not be qualified for the post of Chairman unless he , -
(a) is holding or has held on regular basıs the post of Secretary to the Government of India or Additional Secretary to the Government of India for at least two years , or equivalent; or
(b) is or has been a full- time Director on the Board of a Schedule 'A' Central Public Sector Undertaking notified as such by the Department of Public Sector Enterprises engaged primarily in infrastructure including infrastructure finance , or
(c) is or has been a chief executive officer or Director or holding an equivalent position in a public or private sector infrastructure entity or an entity engaged in infrastructure finance , having a net worth of not less than two thousand crore rupees ,
and has professional knowledge and experience of dealing with infrastructure and finance:
Provided that any person from the entity referred to in clause ( c) shall be considered for the post of Chairman only after cooling off period of two years after he had resigned from his job from the entity having dealings with the National Highways Authority of India .
(2) The appointment of the Chairman shall be made after obtaining the recommendations of a Search Committee consisting of - THE GAZETTE OF INDIA EXTRAORDINARY

Chairperson;
(a) the Cabinet Secretary
Member;
(b) the Secretary , Ministry of Road Transport and Highways
Member;
(c) the Secretary , Planning Commission
Member;
(d) the Director, Indian Institute of Management, Ahmedabad or Bangalore or Kolkatta or Indore or Kozikode or Lucknow
Member.
(e) the Chairman- cum - Managing Director, Indian Infrastructure Finance Corporation Limited or State Bank of India or Punjab National Bank or Bank of India or Bank of Baroda
3. In the said rules , in rule 5 , for sub - rule ( 1 ) , the following sub -rule shall be substituted, namely -
"(1 ) The Chairman shall hold office as such for a term of three years from the date on which he enters upon his office and shall be eligible for re - appointment for å further term of two years
Provided that no Chairman shall hold office as such after he has attained the age of sixty- five years ." .
