सा.का.नि. 6 (अ). - महापत्तन न्यास अधिनियम 1963 ( 1963 का ३४ ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप-धारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार एतद्द्वारा मुम्बई पत्तन न्यास कर्मचारी (अवकाश ) विनियम , 1975 में और संशोधन करते हुए , मुम्बई पत्तन के न्यासी बोर्ड द्वारा बनाए गए मुम्बई पत्तनं न्यास कर्मचारी (अवकाश) संशोधित विनियम , 2011 को अनुमोदित करती है जो इस अधिसूचना की अनुसूची में निर्धारित है ।
2. कथित संशोधित विनियम सरकारी राजपत्र में अधिसूचना की प्रकाशन की तारीख से प्रवृत्त होंगे ।

अनुसूची
महापत्तन न्यास अधिनियम , 1963 की धारा 28 द्वारा प्रदत्त अधिकारो का उपयोग करके, मुबई पत्तन न्यासी मडल मुंबई पोर्ट ट्रस्ट कर्मचारी ( अवकाश ) विनियम, 1975 मे आगे सशोधन करते हुए एतद्वारा निम्न विनियम बनाता है, यथा -
1. येविनियम मुबई पोर्ट ट्रस्ट ( अवकाश ) संशोधन विनियम, 2011 कहलाये जायेगे .

2. मुंबई पोर्ट ट्रस्ट ( अवकाश ) विनियम, 1975 में,
(ए) विनियम 32ए
(i ) उप- विनियम ( 1 ) के वाक्यांश (हूँ ) में "और/अथवा" शब्दो के बदले "और" शब्द का उपयोग किया जाए.
(ii ) उप -विनियम ( 1 ) खण्ड वाक्य ( बी) के बदले निम्न का समावेश किया जाए.
" ( बी) " खण्डवाक्य ( ए) के अतर्गत अवकाश वेतन के बराबर नगद राशि का निम्नानुसार परिकलन किया जाएगा तथा वह एक समय निपटान के रुप में एक मुश्त राशि मे भुगतान योग्य होगी
(i ) अर्जित अवकाश के बराबर नगद राशि = सेवा निवृत्ति की तिथि को देय वेतन अधिक उस तिथि को देय महगाई भत्ता खाते में जमा. बचे हुए अर्जित अवकाश के दिनो की सख्या बशर्ते अर्जित 30 अवकाश तथा अर्ध वेतन अवकाश की कुल संख्या 300दिन से अधिक न हो.
(ii) अर्ध वेतन अवकाश घटक के बदले नगद भुगतान = सेवा निवृत्ति की तिथि को खाते में जमा अर्ध वेतन देय अर्ध वेतन अवकाश का x अवकाश के दिनों की वेतन अधिक उस तिथि को देय महँगाई भत्ता सख्या- बशर्ते खाते में जमा अर्जित अवकाश 30 तथा अर्ध वेतन अवकाश की कुल संख्या का योग 300 दिनों से अधिक न हो.
टिप्पण : अवकाश के नगदीकरण की संपूर्ण सीमा अर्जित अवकाश तथा अर्ध वेंतन अवकाश दोनो को मिलाकर 300 दिन से अधिक न हो .
iii ) निम्नलिखित को उप विनियम ( सी ) के रुप में जोडा जाए
" ( सी) अर्जित अवकाश की कमी को पूरा करने के लिए अर्ध वेतन अवकाश को परिवर्तित करने को अनुमति नही दी जाएगी. "
iv) उप विनियम ( 3 ) , खण्डवाक्य ( ए ) , उपखण्ड वाक्य ( ii ) के बदले निम्न का समावेश किया जाए -
सेवा-विस्तार की अवधि की समाप्ति के बाद निवृत्ती की तिथि को खाते में जमा अर्जित अवकाश तथा अर्धवेतन अवकाश; अधिक सेवा विस्तार की अवधि के दौरान लिया अर्जित एवं अर्ध वेतन अवकाश घटाकर उसी अवधि में खाते में जमा 3

अर्जित एव अर्धवेतन अवकाश दोनो के सबध में उपविनियम ( 1 ) मे दिये प्रावधान के अनुसार उत्तंने दिंनो के ( वेर्तन के ) बराबर नगद राशि - बशर्ते कि कुल देय अवकाश अधिकतम 300 दिन हो
v) उप विनियम ( 4 ) के बदले निम्न का समावेश किया जाए. जो कर्मचारी विनियम 32 के उपविनियम ( 1 ) के खण्ड ( सी ) में उल्लिखित - अनुसार सेवा निवृत्त होता है या निवृत्त किया जाता है उसे उसके खाते मे जमा अवकाश , अर्जित अवकाश तथा अर्धवेतन अवकाश दोनो के बराबर नगदी का भुगतान अवकाश मजूर करनेवाला सक्षम प्राधिकारी मंजूर कर सकता है, बशर्ते कि कुल दिन अधिकतम 300 दिन हो भुगतान योग्य अवकाश बराबर नगद राशि जो उक्त उप विनियम ( 1 ) ( बी) मे बताए नुसार होगी
VI) उप विनियम ( 6 ) , खण्ड ( ए) , उप खण्ड ( 1 ) मे "अर्जित अवकाश " शब्दो के स्थान पर "अर्जित अवकाश तथा अर्ध वेतन, अवकाश दोनो " - इन शब्दो को समाविष्ट किया जाए
v11 ) उप विनियम ( 6) , खण्ड ( ए) , उप खण्ड ( 111 ) मे, "अर्जित अवकाश " शब्दो के स्थान पर, अर्जित अवकाश तथा अर्ध वेतन अवकाश दोनो को समाविष्ट किया जाए
(बी) विनियम 32 ( बी ) के बदले निम्नलिखित का समावेश किया जाय " सेवाकाल मे मृत्यु हो जाने के मामले मे अवकाश वेतन बराबर नगदी . "
"यदि किसी कर्मचारी की मृत्यु सेवा काल के दौरान हो जाती है तो उस मामले मे मृतक कर्मचारी के जमा खाते मे मृत्यु की तिथि को जो अर्जित अवकाश तथा अर्ध वेतन अवकाश जमा होगा उसके बराबर अवकाश वेतन की नगद राशि का भुगतान उप -विनियम ( 1 ) ( ए ) मे दिए प्रावधान के अनुरुप उसके परिवार को किया जाएगा बशर्ते वह अवकाश 300 दिनो से अधिक न हो भुगतान योग्य नगद राशि वही होंगी जो विनियम 32 ( ए) के उप विनियम ( 1 ) ( बी ) तथा ( सी ) मे उल्लिखित है
(सी ) ( 1 ) विनियम 36 उप विनियम ( 1 ) में, अक तथा शब्द के स्थान पर अक और शब्द " 180" दिन समाविष्ट किये जाए .
(ii ) विनियम 36. उप विनियम ( 3 ) ( ii ) मे , " एक वर्ष " शब्दों के स्थान पर शब्द
"दो वर्ष" का समावेश किया जाए
फुट नोट मुख्य विनियम सरकार द्वारा पोत परिवहन पत्रलय के दिनाक 14 08 1975 के पत्र क्र. पीइबी- ( 40 )/75 के अतर्गत मजूर किये गये थे तथा अनुमोदन महाराष्ट्र सरकार के दिनाक 21 08 1975 के राजपत्रं मे प्रकाशित किया गया था पिछला सशोधन दिनाक 18.06 2009 के जी एस आर 428 ( इ ) के अनुसार किया गया.

GS.R. 6(E ). In exercise of the powers conferred by sub - section ( 1 ) of Section 124, read with sub- section ( 1 ) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Government hereby approves the Mumbai Port Trust Employees (Leave ) Amendment Regulations , 2011 made by the Board of Trustees for the Port of Mumbai further to amend the Mumbai Port Trust Employees (Leave ) Regulations , 1975 and set out in the Schedule annexed to this Notification
2. The said Amendment Regulations shall come into force on the date of publication of this notification in the official Gazette .

SCHEDULE
1 .
In exercise of the powers conferred by section 28 of the Major Port Trusts Act , 1963 , the Board of Trustees of the Port of Mumbai hereby make the following regulations further to amend the Mumbai Port Trust Employees (Leave) Regulations , 1975 , namely ..
1. These regulations may be called the Mumbai Port Trust (Leave) Amendment Regulations , 2011 .
2. In the Mumbai Port Trust Employees (Leave) Regulations , 1975,
(A) In regulation 32A ( i) in sub- regulation ( 1) in clause (a) , for the words " and/ or" the word " and" shall be substituted.
(ii) subregulation ( 1) , clause.(b) may be substituted as under.-
" (b) The cash equivalent of leave salary under clause (a) shall be 5

calculated as follows and shall be payable in one lumpsum as a one - time settlement .
= (1) Cash equivalent for earned leave
Pay admissible on the date of retirement plus x Dearness Allowance admissible on that date
of Number of days unutilized earned leave at credit subject to the total of earned leave and half pay leave not exceeding 300days .

= (n) Cash payment in lieu of half pay leave component X
Number of days of half pay leave at credit subject to the total of earned leave and half pay leave at credit not exceeding 300 days
Half pay leave salary admissible on the date of retirement plus Dearness Allowance admissible on that date

{
Note : The overall limit for encashment of leave including both earned leave and half pay leave shall not exceed 300 days . "
(m) The following shall be added as subregulation(c)
" (c) To make up the shortfall in earned leave , no commutation of half pay leave shall be permissible . "
(iv) In subregulation (3) , clause (a) , subclause ( 11) shall be substituted as under .
"after expíry of the period of extension , cash equivalent in the manner provided in subregulation ( 1) in respect of both earned leave and half pay leave at credit on the date of retirement , plus the earned leave and half pay leave earned during the period of extension reduced by the earned leave and half pay leave avaled during such period subject to a maximum of 300 days "

(v). For the subregulation (4), the following shall be substituted. "An employee who retires or is retired from service in the manner mentioned in clause ( c) of subregulation ( 1) of regulation 32 and may be granted by the authority competent to grant leave , cash equivalent of the leave salary in respect of both earned leave and half pay leave at his credit subject to a maximum of 300 days . The cash equivalent payable shall be the same as in subregulation ( 1 ) (b) above. "
(vi) In subregulation ( 6) , clause (a) , subclause ( i) , for the words "earned leave" , the words " both earned leave and half pay leave " may be substituted.
(vii) In subregulation ( 6) , clause (a) , sub clause (11) , for the words "earned leave " , the words "both earned leave and half pay leave" may be substituted .
(B) For regulation 32 (B) , the following shall be substituted. Cash equivalent of leave salary in case of death while in service .
In case of an employee dies while in service , cash equivalent of the leave salary for both earned leave and half pay leave, if any, at the credit of the deceased employee on the date of his death not exceeding 300 days shall be paid to his famıly in the manner provided in sub -regulation ( 1) (a) and the cash equivalent payable shall be the same as in sub - regulation (1) (b) and (c) of regulation 32(A) .
(C ). (i) In regulation 36, sub regulation ( 1) , for the figures and word " 135 days" , the figures and word 180 days" shall be substituted.

( u) In regulation 36, sub regulation ( 3) (1) , for the words "one year", the words " two years " shall be substituted
