का.आ. 62 (अ). जबकि किसी व्यक्तियों और संगमों के कतिपय विधिविरुद्ध क्रियाकलापों के और अधिक प्रभावी निवारण के लिए, आतंकवादी कृत्यों और उनसे जुड़े मामलों से निपटने हेतु विधि- विरुद्ध क्रियाकलाप ( निवारण ) अधिनियम , 1967 ( 1967 का 37 ) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) अधिनियमित किया गया है ,
2. और जर्बाक उक्त अधिनियम की धारा 2 के खण्ड ( ड ) में, आतंकवादी सगठन को उक्त अनुसूची में सूचीबद्ध संगठन अथवा इस प्रकार सूचीबद्ध किसी संगठन के रूप में उसी नाम से सक्रिय संगठनों के रूप में परिभाषित किया गया;
3. और जबकि उक्त अधिनियम की अनुसूची में आतंकवादी संगठनों की सूची विनिर्दिष्ट की गई है;
4. और जबकि " गारो नेशनल लिबरेशन फ्रंट " गारो हिल्स का एक उग्रवादी सगठन जो वर्ष 2010 के शुरू में अस्तित्व में आया तथा वह गारा हिल्म जिल्ला में संगठन स्तर पर तथा शस्त्रों एवं संवर्ग के स्तर पर अपनी स्थिति मजबूत करता जा रहा है; और जबकि एक पृथक गारो राज्य के कथित उदद्देश्य के लिए संगठन , अन्य हिंसक गतिविधिया जम सरकारी कर्मचारियों पर हमला , सरकारी भवनों में ग्रनड फेकना , हिमा से जबरन फिरौती वसूलना इत्यादि के साथ निर्दोष नागरिकों तथा सुरक्षा बलों की हत्या वाले आतंकवादी कृत्य कर रहा है;
5. और जबकि केन्द्रीय सरकार मानती है कि गाग नेशनल लिबरेशन आर्मी" आंतकवाद में संलिप्त है;
6. अब अतः विधिवरुद्ध क्रियाकलाप ( निवारण ) अधिनियम , 1967 की धारा 35 की उप- धारा ( 1 ) के खण्ड ( क ) के द्वारा प्रदत्त शक्तियों का प्रयोग करन हुए केन्द्र सरकार गारो नेशनल लिबरेशन आर्मी तथा इसके सभी घटको और प्रमुख संगठना को उक्त अधिनियम की अनुसूची में आतंकवादी संगठन के रूप में शामिल करने के बारे में एतद्भाग निम्नलिखित आदेश करती है और उक्त प्रयोजन हेतु निम्नलिखित सशोधन करती है , अर्थात्
उक्त अधिनियम की अनुगृची मे क्रम सख्या 35 तथा उमस संबंधित प्रविष्टियों के पश्चात् निम्नलिखित क्रम मख्या और प्रविष्टिया अंतःस्थापित की जाएंगी अर्थात्
"36. गारो नेशनल लिबरेशन आर्मी ( जी एन एल ए ) , इसके सभी घटक और प्रमुख संगठन। "

NOTIFICATION
New Delhi, the 12th January, 2012
S.O. 62 (E ) . Whereas , the Unlawful Activities (Prevention)Act, 1967 (37 of 1967) (hereinafter referredto as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith ;
2.And whereas , clause (m) of Section 2 of the said Act defines the terrorist organisation to mean an organisation listed in the Schedule or an organisation operating under the same name as an organisation so listed;

3.Andwhereas , the Schedule to the saidAct specifies the list of terrorist organisations;
4.And whereas the Garo National LiberationArmy (GNLA) , a militant outfit ofGaro Hills , which came into existence in early 2010 has been consolidating its position in the three Garo Hills Districts both organisationally and interms ofweapons and cadres and to achieve the objective ofa separate Garo State, the outfit is resorting to terrorism in the form of killing of innocent civilians and security forces in addition to engaging in other violent activities like physical assault on Government employees , lobbing grenades in Government buildings and other violent activities and extortions .
5. And whereas , the Central Government believes that the Garo National Liberation Army (GNLA) is involved interrorism,

6.Now, therefore, in exercise of the powers conferred by clause (a) of sub- section ( 1 ) of Section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following to add the Garo National Liberation Army (GNLA) and all its formations and front organisations as terrorist organisation in the Schedule to the said Act and for the said purpose makes the following amendments, namely:---
In the Schedule to the said Act , after serial number 35 and the entries relating thereto, the following serial number and entries shall be inserted , namely:-
"36. Garo National LiberationArmy (GNLA) , all its formations and front organizations . "
