सा.का.नि. १(अ).-वाणिज्यिक पोत परिवहन अधिनियम , 1958 ( 1958 का 44 ) ( इसकै बाद इसे उक्त अधिनियम कहा गया है ) की धारा 285 की उप - धारा ( 1 ) , धारा 288 की उप-धारा ( 1 ) और ( 2 ) , धारा 289 , धारा 296 की उप- धारों ( 1 ) और (2 ) के साथ पठित धारा 435 - एक्स द्वारा प्रदत्त शक्तियो का प्रयोग करत हुए केन्द्रीय सरकार , इस बात से सतुष्ट होते हुए कि उक्त अधिनियम के भाग XV-ए ( मात्स्यिकी नौका) के अतर्गत बने नियमो की अपेक्षाओं का पालन करना व्यवहारिक नही है , एतद्वारा 20 मीटर से कम लबाई वाली भारतीय मात्स्यिकी नौकाओ को, जैसा कि पजीयन प्रमाण- पत्र मे दर्ज हो , अधिसूचना की तारीख से दो वर्ष तक की अवधि के लिए वाणिज्यिक पात परिवहन ( भारतीय मात्स्यिकी नौका निरीक्षण ) नियम , 1988 की अपेक्षाओ से इस शर्त के साथ छूट प्रदान की जाती है कि ऐसी मात्स्यिकी नौकाएँ निम्नलिखित विनियमो तथा नियमो मे निर्धारित उपकरणा को ले जाएगी तथा इन्हे कुशलतापूर्ण स्थितियों मे रखा जाएगा
। वाणिज्यिक पोत परिवहन ( अग्निशामक उपस्कर ) नियम , 1969 या वाणिज्यिक पोत परिवहन ( ऑग्न उपस्कर ) नियम, 1990; यथा प्रयोजनीय
2 वाणिज्यिक पोत परिवहन ( समुद्र में टक्कर की रोकथाम ) नियम , 1975; और
3. वाणिज्यिक पोत परिवहन ( जीवन रक्षक उपस्कर ) नियम , 1982 या वाणिज्यिक पोत परिवहन ( जीवन रक्षक उपस्कर) नियम , 1991 ; यथा प्रयोजनीय ।
यह अधिसूचना दिनाक 18-8-2009 की पहले वाली अधिसूचना सा का नि. 579 ( अ ) के क्रम में जारी की जाती है ।

NOTIFICATION
New Delhi , the 13th January, 2012
GS.R. 9(E) . In exercise of the powers conferred by sub- section ( 1 ) of Section 285, sub- sections (1 ) and(2) of Section 288, Section 289, sub section (1 ) & (2) of Sections 296, read with Section 435 -X of the Merchant Shipping Act, 1958 (44 of1958) (hereinafter referred to as the said Act) , the Central Government, being satisfied that it is impraoticable to comply with the requirements of the rules made under Part XV- A (Fishing Boats ) of the said Acı, hereby exempts the Indian fishing boats of less than 20 meters in length, as recorded in the certificate of registry, from the requirements of Merchant Shipping (Indian Fishing Boats Inspection) Rules , 1988 for a period of two years with effect from date of notification subject to the condition that such fishing boats carry the equipments prescribed in following rules and regulations and the same are maintained in efficient condition
1. TheMerchant Shipping (Fire Appliances) Rules, 1969 or Merchant Shippurg (Fire Appliances) Rules , 1990 , as applicable
2. The Merchant Shipping (Prevention ofCollision at Sea ) Regulation, 1975 , and
3. The Merchant Shipping (Life Saving Appliances) Rules 1982 or Merchant Shipping (Life Saving Appliances ) Rules, 1991 as applicable
The notification is issued in continuation of the earlier notification No GSR 579 (E) , dated 18th August, 2009.
