साका, नि 10 (अ) -वाणिज्यिक पोव परिवहन अधिनियम , 1958 ( 1958 का 44 ) की धारा 435 यू द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए, केन्द्रीय सरकार , एतद्वारा , निम्नलिखित नियम वाणिज्यिक पोत परिवहन ( भारतीय मात्स्यिकी नौकाओ का पजीकरण ) नियम , 1988 में और सशोधन करने के लिए बनाती है।
1. ( 1 ) इन नियमो को वाणिज्यिक पोत परिवहन ( भारतीय मात्स्यिकी नौकाओ का पजीकरण ) सशोधन नियम, 2012 कहा जाएगा।
(2 ) ये राजपत्र में प्रकाशित होने की तारीख से प्रवृत्त होगे।
2. वाणिज्यिक पोत परिवहन ( भारतीय मात्स्यिकी नौकाओ का पजीकरण ) नियम , 1988 , नियम, 3 , उप- नियम ( 2 ) के बाद निम्नलिखित उप-नियम जोडे जाएगे जो हैं;
" (3 ) अधिनियम की धारा 435 जी के अतर्गत विद्यमान भारतीय मात्स्यिकी नौका के पजीकरण के प्रमाण- पत्र की स्वीकृति के लिए हर आवेदन परिशोधित आरूप में होगा , यह प्रपत्र IV म विनिर्दिष्ट है जो प्रपत्र । मे बनाया जाएगा, किसी शुल्क का भुगतान नहीं किया जाएगा, और यह आवेदन उस भारतीय मात्स्यिकी नौका के पजीयन पत्तन के पजीकार को किया जाएगा ।
(4) उप- नियम (3 ) के अतर्गत हर आवेदन के साथ यह होगे ।
(ए) प्रपत्र IV मे भारतीय मात्स्यिकी नौका के विवरण,
(बी) वाणिज्यिक पोत परिवहन अधिनियम , 1958 की धारा 435 जी की उपधारा या समय - समय पर प्रवृत्त किसी अन्य कानून के अतर्गत पहले स्स्वीकृत पजीयन का मूल प्रमाण- पत्र "

पाद टिप्पणीः 7 अक्तूबर 1988 को माकानि 866 के राजकीय राजपत्र में प्रमुख नियम प्रकाशित कर दिए गए तथा उसके बाद इनमे साकानि 218. दिनाक 21 अप्रैल , 1994 , सा का नि 774 ( अ ) , दिनाक 28 दिसबर , 1998 , साकानि 448 ( अ ) , दिनाक 24 जून 2009 के अनुसार मशोधन किया गया ।

NOTIFICATION
New Delhi , the 13th January, 2012
GS.R. 10(E) . In exercise ofthe powers conferred by Section 435 U of the Merchant Shipping Act , 1958 (44 of 1958), the Central Government hereby makes the following rules further to amend the "Merchant Shipping (Registration of Indian Fishing Boats) Rules , 1988 , namely
1.(1) These rules may be called the Merchant Shipping ( Registration of Indian Fishing Boats ) Amendment Rules , 2012.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Merchant Shipping (Registration of Indian Fishing Boats) Rules , 1988 , in rule 3, after sub - rule (2) , the following sub - rules shall be inserted, namely:
" (3) Every application for the grant of certification ofregistry of an existing Indian fishing hoat under section 435G of the Act, in the revised format , as specified in ' Form IV' shall be made in Form I, without payment of any fee, to the Registrar of the port of Registry of that Indian fishing boat.
(4) Everyapplication under sub- rule (3 ) shall be accompanied by
(a)the particulars of the Indian fishing boat in Form IV:
(b) the original certificate of registry previously granted under sub - section (4) of Section 435G of the Merchant ShippingAct , 1958 or under any other law for the time heing in force."
