साका.नि 11 (अ) ---महापत्तन न्याम अधिनियम , 1963 ( 1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा विशाखापट्नम पत्तन न्यास वर्गाचारी ( अवकाश ) विनियम , 1992 म और मशोधन करते हुए , विशाखापट्ट्नम पत्तन के न्यासी बोर्ड द्वारा बनाए गए विशाखापटनम पत्तन् त्र्याम कर्मचारी ( अवकाश ) संशोधित विनियम , 2012 को अनुमोदित करती है जो इस अधिसूचना की अनुसूची में निर्धारित है ।
2 कथित सशोधित विनियम सरकारी राजपत्र में अधिसूचना की प्रकाशन की तारीख से प्रवृत्त होगे ।

अनुसूची
महापत्तन न्यास अधिनियम , 1963 की धारा 28 ( 1963 का 38 ) के द्वारा प्रदत्त अधिकारो का प्रयोग करते हुए विशाखापटनम पोर्ट का न्यासी मडल उक्त अधिनियम की धारा 124 के तहत केन्द्र सरकार से अनुमोदन की शर्त पर विशाखापटट्नम पोर्ट कर्मचारी ( छुट्टी ) विनियम 1992 मे आगे और मशोधन करता है अर्थात्
( 1 ) लघु शीर्ष और प्रारंभ-
( क ) इन विनियमो को विशाखापटनम पार्ट कर्मचारी ( छुट्टी ) सशोधन विनियम , 2012 कहा जाएगा ।
( ख ) ये विनियम सरकारी राजपत्र में प्रकाशित होने की तिथि से लागू होगे ।
(2) विनियम 32 के उप विनियम 5 के तहत पैरा को निम्नलिखित पैरा क साथ जोडा जाए
" अर्जित छुट्टी और अर्धवतन छुट्टी को मेवानिवृत्ति के समय नगदीकरण क लिए माना जाएगा बशर्ते कि कुल सीमा 300 दिन के हों । फिर भी पेशन के लिए तथा सवानिवृत्ति क अन्य लाभो बराबर पंशन को अर्धवतन छुट्टी की नगदीकरण क लिए देय समतुल्य नगद से कोई कटौती ही की जाएगी । "
(3) विनियम 40 के उप- विनियम ( 1 ) में " प्रसृति छुट्टी " शीर्ष के तहत " 135 " अक को " 180 " से प्रतिस्थापित किया जाए ।
(4) विनियम 40 के उप- विनियम ( 4 ) के खण्ड ( ख) म " एक वर्ष " शब्दो को " दो वर्ष " शब्दा से प्रतिस्थापित किया जाए ।
(5) विनियम 40 के उप-विनियम ( 7 ) मे " प्रति छुट्टी " शीर्ष के अतर्गत अक " 135 " को " 180 " अक म पतिस्थापित किया जाए ।
(6 ) विनियम 40 ( क ) में उल्लिखित विषयो को निलिखित के साथ प्रतिस्थापित किया जाए

" महिला कर्मचारी " जिनके 2 जीवित बच्चों से कम हैं , एक वर्ष के बच्चे को मान्य रूप से गोद लेने पर, मान्य रूप से गोद के लेने के तुरत बाद 135 दिनों की छुट्टी मजूर की जाएगी ।

NOTIFICATION
New Delhi , the 5th January, 2012
GS.R. 11 (E) . In exercise of the powers conferredby sub- section ( 1 ) of Section 124, read with sub - section ( 1 ) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963 ) , the Central Gnvernment hereby approves the Visakhapatnam PortEmployees (Leave) Amendment Regulations , 2012 made by the Board of Trustees for the Port of Visakhapatnam further to amend the Visakhapatnam Port Employees (Leave) Regulations , 1992 arid are set out in the Schedule annexed to this Notification .
2 The saidAmendment Regulations shall come into force on the date of publication of this Notification in the Official Gazette.

VISAKHAPATNAM PORT TRUST
SCHEDULE
In exercise ofthe power conferred by Section 28 of the Major Port Trusts Act , 1963 ( Act 38 of 1963 ) the Board of Trustees ofthe Port of Visakhapatnam hereby makes , the following Regulations further to amend the Visakhapatnam Port Employees ( Leave) Regulations , 1992 subject to the approval of the Central Government under Section 124 of the said Act (1) Short Title and Commencement.-
( a) These Regulations may be called the Visakhapatnam Port Employees ( Leave ) Amendment Regulations 2012
(b) They shall come into force with effect from date ofpublication in the Official Gazette
(2) The Para under the sub- Regulation 5 of Regulation 32 may be added with the following para:
"Earned leave and half pay leave shall be considered tor encashment at the time of retirement subject to overall limit of 300 days However , no reduction on account of Pension and Pension equivalent of other retirement benefits shall be made from the cash equivalent payable for encashment of half pay Icave ." (3) In sub- Requlation ( 1 ) of Regulation 40 under the title 'Maternity leave ' the figure " 135 " mav be substituted with the figure " 180"
(4) In Clause (b ) in sub - Regulation (4 ) ofRegulation 40 the words "One Year may be substituted with the words "Two Years "
(5) In sub -Regulation 7 , of Regulation 40 the figure " 135" may be substituted with the figure " 180 " (6) The contents mentioned in Regulation 40 (A) may be substituted with the following
'Female Emplovee , with fewer than two surviving children on valıd adoption of child below age of one year will be granted leave for a period of 135 days ummediately after the valid adoption "
