नई दिल्ली, 13 जनवरी , 2012

आअ. 5 (अ) -यत , भारत के राष्ट्रपति ने , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 12 के अधीन जारी और तारीख 13 जनवरी , 2012 को भारत के राजपत्र मे प्रकाशित अधिसूचना द्वारा सिक्किम राज्य की विधान सभा के निर्वाचित सदस्यो से यह अपेक्षा की है कि वे मिक्किम राज्य से राज्य सभा के लिए एक सदस्य निर्वाचित कर दे -

अतः , अब , उक्त अधिनियम की धारा 39 की उप- धारा ( 1 ) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा

(अ) उक्त निर्वाचन के सबध मे

20 जनवरी , 2012 ( शुक्रवार ) (क) नाम निर्देशन करने की अंतिम तारीख

21 जनवरी , 2012 ( शनिवार ) (ख) नाम निर्देशनो की सवीक्षा की तारीख-

23 जनवरी , 2012 (सोमवार ) (ग ) अभ्यर्थिताए वापस लेने की अतिम तारीख-

30 जनवरी, 2012 ( सोमवार) (घ ) वह तारीख , जिसको यदि आवश्यक हुआ तो मतदान होगा-

3 फरवरी , 2012 ( शुक्रवार ) (ड ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा--

1 नियत करता है; ओर

(आ) 900 बजे पूर्वाह्न से 400 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ तो, निर्वाचन के लिए उक्त विनिर्दिष्ट तारीख को , मतदान होगा ।

O. N. 5 (E) -Whereas , the President of India has , by notification issued under Section 12 of the Representation of the PeopleAct, 1951 ( 43 of 1951 ) and published in the Gazette of India on 13th January, 2012 , been pleased to callupon the electedmembers of the Legislative Assembly of the State of Sıkkım to elect one member to the Council of States ,

Now, therefore, in pursuance of sub - section ( 1 ) of Section 39 and Section 56 of the said Act, the Election Commission ofIndia hereby

(A)   appoints with respect to the said election
      (a)    the 20th January , 2012 (Friday) , as the last date for making nominations;
      (b)    the 21st January , 2012 ( Saturday) , as the date for the scrutiny of the nominations;
      (c)    the 23rd January, 2012 (Monday) , as the last date for the withdrawal of candidatures ,
      (d)    the 30th January, 2012 (Monday) , as the date on which a poll shall , if necessary, be taken , and
      (e)    the 3rd February, 2012 (Friday), as the date before which the election shall be completed , and
(B)    fixes the hours from 9 00 AM to 400 P.M. , as the hours during which the poll shall, ifnecessary, be taken
      on the date specified above for the election .

आ.अ. 6 (अ). लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 22 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एवं उक्त अधिनियम की धारा 21 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा सिक्किम राज्य सरकार के परामर्श से 13 जनवरी , 2012 को भारत के राजपत्र मे प्रकाशित आयोग की अधिसूचना के अनुसरण में राज्य सभा के लिए होने वाले द्विवार्षिक निर्वाचन के संबंध में , ( i ) निम्नलिखित सारणी के स्तंभ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफ्रिसर के रूप में पदाभिहित करता है ; तथा

(ii) उक्त सारणी के स्तभ ( 2 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के कृत्यों के निष्पादन में सहायता करने के लिए , सहायक रिटर्निंग आफिसर के रूप में नियुक्त करता है :-

O.N 6(E) -In pursuance ofSection 21 , and in exercise of the powers conferred by sub- section ( 1 ) of Section 22, ofthe Representation of the People Act, 1951 ( 43 of 1951 ) , the Election Commission of India, in consultation with the Government of the State ofSikkim , hereby--

(1) designates the officer , specified in column ( 1) ofthe Table below, to be the Returning Officer, and (ii) appoints the officer, specified in column (2) of the said Table , to be the Assistant Returning Officer to assist the Returning Officer in the performance oflus functions ;

in respect of the biennial election to the Council of States , to be held in that state in pursuance of the Commission's Notification , published in the Gazette ofIndia on 13th January, 2012 :--
