साकानि 28 (अ) ओषधि और प्रसाधन सामग्री नियम, 1945 का और सशोधन करने के लिए औषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 की अपक्षानुसार कतिपय नियमो का प्रारूप , भारत सरकार के स्वास्थ्य और परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना सख्याक सा का नि 911 ( अ ) , तारीख 12 नवम्बर , 2010 द्वारा भारत के राजपत्र , असाधारण , भाग II , खड 3 उप- खड ( 1 ) तारीख 12 नवम्बर , 2010 मे प्रकाशित किया गया था , जिसम उन सभी व्यक्तियो से जिनके उससे प्रभावित होने की सभावना थी उस तारीख से, जिसको उम राजपत्र की प्रतिया जिसमे यह अधिसूचना प्रकाशित की गई थी , जनता को उपलब्ध करा दी गई थी , पैतालीस दिन की अवधि समाप्त होने के पूर्व आक्षेप और सुझाव मागे गए थे;
और उक्त राजपत्र की प्रतिया जनता को 15 नवम्बर , 2010 को उपलब्ध करा दी गई थी;
और केन्द्रीय सरकार द्वारा उक्त नियमा पर जनता से प्राप्त आक्षेपो और सुझावों पर विचार कर लिया गया है ,
अत , अब , केन्द्रीय सरकार, ओषधि और प्रसाधन सामग्री अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदन्न शक्तियो का प्रयोग करते हुए , ओषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात्, ओषधि और प्रसाधन सामग्री नियम 1945 का और सशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1 ( 1 ) इन नियमो का संक्षिप्त नाम ओषधि और प्रमाधन सामग्री ( प्रथम सशोधन ) नियम , 2012 है ।

होगे । ( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त
2 ओषधि और प्रसाधन सामग्री नियम , 1945 के नियम 97 मे , उप-नियम ( 3 ) के पश्चात् निम्नलिखित अत स्थापित किया जाएगा , अर्थात्
" ( 3क ) खाद्य उत्पादन पशुओं के उपचार के लिए किसी ओषधि के आधान पर ऐसी जाति के लिए ओषधि की निर्वतन अवधि को अंकित किया जाएगा जिस पर इसका उपयोग किया जाना आशयित है .
परन्तु यदि विनिर्दिष्ट अवधि का अनुसमर्थन नहीं किया गया है तो निर्वर्तन अवधि अडो या दुग्ध के लिए सात दिन, कुक्कुट और स्तनधारिया , वसा और मासवशिष्ट सहित मास के लिए अट्ठाइस दिन , मछली के मास के लिए पाच सौ डिग्री दिन से कम नही होगी ।
स्पष्टीकरण. इस नियम के प्रयोजन के लिए यह सुनिश्चित करने के लिए कि खाद्य पदार्थों मे अधिकथित अधिकतम अवशेष की मात्रा से अधिक अवशेष अतर्विष्ट नही हे , निर्वर्तन अवधि उपयोग की सामान्य परिस्थितियो के अधीन पशुओ के लिए पशु चिकित्सा ओषधि के अतिम सप्रयोग और ऐसे पशुओ से खाद्य पदार्थ के उत्पादन क बीच अतराल की अर्वाध है । " ।

NOTIFICATION
New Delhi, the 17th January, 2012
GS.R. 28 (E).-Whereas a draft ofcertain rules further to amend the Drugs and Cosmetics Rules , 1945 , was published, as required by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940 ) , vide notification of the Government of India, Ministry of Health and Family Welfare(Department ofHealth) , number GS.R. 911 (E) , dated 12th November. 2010 , in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (1 ) , dated the 12th November, 2010, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty five days from the date on which the copies of the Official Gazette in which this notification is published are made available to the public ,
And whereas copies of the Gazette were made
available tothe public on the 15th day of November, 2010;
And whereas, objections and suggestions received from the public on the said rules have been consideredby the Central Government,
Now, therefore , in exercise of the powers conferred by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , the Central Government, after consultation with the Drugs Technical Advisory Board , hereby makes

the following rules further to amend the Drugs and Cosmetics Rules , 1945, namely:-
1 ( 1) These rules may be called the Drugs and Cosmetics ( 1stAmendment) Rules , 2012
(2)They shall come into force on the date of their publication in the Official Gazette
2 In the Drugs and Cosmetics Rules , 1945, in rule 97 , after sub - rule ( 3 ) the following shall be inserted , namely
"(3A) The container of a medicine for treatment offood producing animals shall be labelled with thewithdrawal period ofthe drug for the species. on which it is intended to be used
Provided that if the specific withdrawal period has not been validated, the withdrawal period shall not be less than seven days for eggs or milk, twenty eight days for meat from poultry and mammals including fat and offal , five hundred degree days for fish meal
Explanation . For the purpose of this rule , the withdrawal period is the period of interval between the last administration of a veterinary medicine to anımals under the normal conditions of use and the production of food stuff from such animals to ensure that food stuffs do not contain residues in quantities in excess of the maximum residue limits laid down "
