सा.का नि. 32(अ).-कपनी विधि बोर्ड , कपनी अधिनियम , 1956 ( 1956 का 1 ) की धारा 10ड की उप - धारा ( 5 ) और उप-धाग ( 6 ) द्वारा प्रदत्त र्शाक्तयो का प्रयोग करते हुए , कपनी विधि बार्ड विनियम , 1991 का और सशोधन करने के लिए निम्नलिखित नियम बनाता है, अर्थात्:-
1 ( 1 ) इन विनियमो का संक्षिप्त नाम कपनी विधि बार्ड ( सशोधन) विनियम , 2012 है ।
(2 ) ये राजपत्र मे प्रकाशन की तारीख से प्रवृत होगे ।
2 कपनी विधि बोर्ड विनियम , 1991 के नियम 30 के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्
" 30अभिलेखो का निरीक्षण और प्रमाणित प्रतियो की आपूर्ति (1 ) किसी लंबित मामले के अभिलेख का पक्षकारो या उनके प्राधिकृत प्रतिनिधियो को निरीक्षण और उनकी प्रमाणित प्रतियां की आपूर्ति का, लिखित मे आवेदन करने पर और मामले के दस्तावेजा के निरीक्षण के लिए पचास रुपए प्रतिदिन की और क्रमश आदेश या किसी अन्य दस्तावेज की प्रमाणित प्रतिया के लिए दस रुपए प्रति पृष्ठ की दर से फीस कासदाय करने पर , अधिकार होगा और अभिलेख का निरीक्षण मामले की प्रमाणित प्रति की आपूर्ति के लिए पूर्व अपेक्षा होगी ।
( 2 ) आवेदक आवेदन मे सुभिन्न रूप से किसी मामले के अभिलेख को विनिर्दिष्ट करेगा जिसके निरीक्षण या प्रमाणित प्रतियो की वाछा कीगई है और आवेदन या तो फाइलिंग पटल पर किया जा सकेगा या डाक द्वारा कपनी विधि बोर्ड की सबधित न्यायापीठ का अपक्षित फीस के माथ भेजा जा सकेगा ।
(3 ) काई व्यक्ति जो कार्यवाहियों में पक्षकार नहीं है , को तथापि निरीक्षण या किसी लुबित मामले के अभिलेखों की प्रमाणित प्रतिया सिवाय उम पक्षकार की सहमति के जिसने मामला फाइल किया है या न्यायपीठ के आदेशो के अधीन , अभिप्राप्त करने का अधिकार नही है ।
(4 ) अभिलेख का निरीक्षण उसकी सुनवाई के लिए नियत तारीख को न्यायापीठ के आदेश के बिना अनुज्ञात नहीं किया जाएगा ।
(5 ) किसी आवेदन की प्राप्ति के पश्चात् क्रमशः दो कार्य दिवसो के भीतर निरीक्षण अनुज्ञात किया जाएगा और प्रमाणित प्रतियो की आपूर्ति तीन कार्य दिवसो के भीतर की जाएगी ।"

टिप्पण.-मूल विनियम सा.का.नि 291 ( अ ) , तारीख 31 मई , 1991 द्वारा प्रकाशित किए गए थे और सा का नि. 682 ( अ ) , तारीख 15 सितम्बर , 2011 द्वारा अतिम संशोधन किए गए थे ।

NOTIFICATION
New Delhi, the 18th January, 2012
GS.R. 32(E) . In exercise of the powers conferred by sub - section (5) and sub - section (6 ) of Section 10E of the Companies Act , 1956 ( 1 of 1956 ) , the Company Law Board hereby makes the following regulations further to amend the Company LawBoard Regulations, 1991 , namely.-
1 ( 1 ) These regulations may be called the Company Law Board (Amendment) Regulations, 2012
(2) They shall come into force on the date of their publication in the Official Gazette
2. In the Company Law Board Regulations , 1991 , for regulation 30, the following shall be substituted, namely
"30. Inspection of record and supply of certified coples . ( 1 ) The record ofa pending case shall be open , as of right, to the inspection and supply of the certified copies thereof 10 the parties or their authorised representatives , on making an application in writing and on payment of a fee of fifty rupees per day for inspection ofdocuments of a case and tenrupees per page for supply of certified copies of order or any other document respectively and the inspection of record shall be pre - requirement for supply of certified copy of a case
(2) The applicant shall distinctly specify in the application , the record of a case for which inspection or certified copies are desired and the application may either be presented at the filing counter or may be sent by post at the address ofthe concerned Company Law Board Bench along with the requisite fees
(3) Aperson, who is not a party to the proceedings , has , however , no right to inspect or to obtain certified copies ofthe records ofa pending case except with the consent of the party who has filed the case or under the orders of the Bench
(4) The inspection of record shall not be permitted on the date fixed for its hearing without the order of the Bench
(5)After receipt of an application , the inspection shall be allowed within a period oftwo working days and certified copies shall be supplied within a period of three working days respectively "
