का.आ. 91 (अ) .-केन्द्रीय सरकार, पर्यावरण ( सरक्षण ) अधिनियम , 1986 ( 1986 का 29 ) ( जिसे इसमे इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप- धारा ( 1 ) और उप- धारा ( 3 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , तमिलनाडु तटीय जोन प्रबध प्राधिकरण ( जिसे इसमे इसक पश्चात् प्राधिकरण कहा गया है ) इस आदेश के राजपत्र में प्रकाशन की तारीख से प्रभावी तीन वर्षों की अवधि के लिए प्राधिकरण का गठन करती है जिसमे निम्नलिखित व्यक्ति होगे , अर्थात्ः-
-अध्यक्ष 1 सरकार के सचिव , पर्यावरण और वन विभाग तमिलनाडु सरकार ।
-सदस्य 2. नगर और ग्राम योजना निदेशक , 807 , अन्ना सलाई , चैन्नई -2 ।

IL. प्राधिकरण को तमिलनाडु राज्य के क्षेत्रों मे समुद्र तटीय पर्यावरण की क्वालिटी को सरक्षित करने और सुधारने तथा पर्यावणीय प्रदूषण के निवारण, उपशमन और नियंत्रण के लिए नियत्रण करने के लिए तटीय विनियम जोन अधिसूचना 2011 को क्रियान्वित और प्रवर्तित करने की निम्नलिखित शक्ति होगी , अर्थात्
(1 ) तटीय जोन प्रबंध प्राधिकरण अनुमोदित तटीय जोन प्रबध योजना के अनुसरण मे और तटीय विनियम जोन अधिसूचना के अनुपालन में परियोजना का परीक्षण करेगा और पूर्ण आवेदन की प्राप्ति की तारीख से साठ दिन की अवधि के भीतर अपनी सिफारिशें करेगा:-
(क) यथास्थिति पर्यावरण और वन मंत्रालय या राज्य पर्यावरण समाघात अवधारण प्राधिकरण (जिसे इसमे इसके पश्चात् रापसअप्र कहा गया है ) पर्यावरण समाघात अवधारण अधिसूचना , 2006 को प्रभावित परियोजना के लिए करेगा;
(ख) पर्यावरण और वन मत्रालय पर्यावरण समाघात अवधारण अधिसूचना 2006 के अतर्गत नही आने वाली परियोजनाओं को किन्तु पर्यावरण विनियम जोन अधिसूचना के पैरा 4 के खड ( ii ) में विनिर्दिष्ट करते हो , करेगा ,
( ग ) उपर्युक्त ( क ) और ( ख ) के अतर्गत नही आने वाली परियोजनाओ के लिए सबधित राज्य प्राधिकरण को करेगा ।
(ii) राज्य सरकार, सघ राज्यक्षेत्र प्रशासन , स्थानीय प्राधिकरण या सबद्ध तटीय जोन प्रबध प्राधिकरण ऐसे अनुमोदित तटीय जोन प्रबध योजना के ढ़ाचे के भीतर यथास्थिति इस अधिसूचना के उपबंधो के अनुसरण मे इस अधिसूचना में सूचीबद्ध सभी विभागीय क्रियाकलापों कोविनियमित करने वाले इस अधिसूचना के अनुसरण में होंगे ।
(iii ) राज्य सरकार , या सघ राज्यक्षेत्र तटीय जोन प्रबंध प्राधिकरण के इस अधिसूचना के प्रवर्तन ओर मानीटिरी के लिए प्रारंभिक रूप से उत्तरदायी होगे और इस लक्ष्यं में, स्थानीय पांरपरिक तटीय समुदायो के कम से कम तीन प्रतिनिधि जिसके अतर्गत मछुआरा समुदाय भी है , संबद्ध जिला मजिस्ट्रेट की अध्यक्षता के अधीन जिला स्तर समितिया राज्य सरकार और सघ राज्यक्षेत्र गठित करेगी।
( 1v ) तमिलनाडु राज्य सरकार से प्राप्त तटीय विनियमन जोन और तटीय जोन प्रबध योजना के लिए वर्गीकरण में परिवर्तन या तपातरणों के लिए प्रस्तावो की परीक्षा करेगी और विशिष्ट सिफारिशों को राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण को भेजेगी ।
(v) ( क) उक्त अधिनियम और उसके अधीन बनाए गए नियमों या कोई अन्य विधि जो उक्त अधिनियम के उद्देश्यो से संबंधित है , के उपबंधों के अभिकथित उल्लघन के मामलों में जाच , और किसी विशिष्ट मामले में

आवश्यक पाए जाने पर, उक्त अधिनियम की धारा 5 के अधीन निदेश जहा तक ऐसे निदेश राष्ट्रीय तटीय जोन प्रबध प्राधिकरण या केन्द्रीय सरकार द्वारा उस विशिष्ट मामले में जारी किसी निदेश से असगत नही है जारी करना;
(ख) उक्त अधिनियम और उसके अधीन बनाए गए नियमो या कोई अन्य विधि जो उक्त अधिनियम के उद्देश्यों से सबंधित है , के उपबंधो के उल्लघन को अंतर्वलित करने वाले मामलो का पुनर्विलोकन, और आवश्यक पाए जाने पर ऐसे मामलो को टिप्पणी के साथ राष्ट्रीय तटीय जोन प्रबध प्राधिकरण के पुनर्विलोकन के लिए निर्दिष्ट करनाः
परतु पैरा 2 के उप- पैरा (v ) ( क ) और ( ii ) ( ख) के अधीन मामले या तो स्वत ही लिए जा सकेगे या किसी व्यष्टि , अथवा किसी प्रतिनिधि निकाय या किसी सगठन द्वारा किए गए परिवाद के आधार पर लिए जा सकेंगे ।
(vi) इस आदेश के पैरा ( 11 ) के उप-पेरा ( 1 ) और ( 1 ) के अधीन इसके द्वारा जारी किए गए निदेशों के अननुपालन की दशा मे उक्त अधिनियम की धारा 19 के अधीन परिवाद फाइल करना।
(vu ) इस आदेश के पैरा ( 2 ) के उप- पैरा ( 1 ) और ( ii ) से उद्भूत विवाद्यको से सबंधित तथ्यो को सत्यापित करने के लिए उक्त अधिनियम की धारा 10 के अधीन कार्रवाई करना।
III प्राधिकरण तटीय विनियमन जोन से सबंधित पर्यावरणीय विवाद्यको को निपटाएगा जो उसे तमिलनाडु की राज्य सरकार, राष्ट्रीय तटीय जोन प्रबंध प्राधिकरण या केन्द्रीय सरकार द्वारा निर्दिष्ट किए जा सकेगे ।
IV तटीय जोन प्रबध प्राधिकरणो की कार्यप्रणाली में पारदर्शिता बनाए रखने के लिए तटीय जोन प्रबध प्राधिकरण का यह उत्तर- दायित्व होगा कि वह एक समर्पित वेबसाइट का सृजन करे और उम पर कार्यसूची, कार्यवृत , किए गए विनिश्चय , अनापत्ति पत्र , उल्लघन , उल्लघनों पर कार्रवाई और न्यायालय मामले जिसके अंतर्गत माननीय न्यायालय के आदेश है तथा सबंधित राज्य सरकार या संघ राज्यक्षेत्र की अनुमोदित तटीय जोन प्रबंध योजना भी डालेगा।
V प्राधिकरण छह मास में कम से कम एक बार अपने क्रियाकलापों की रिपोर्ट राष्ट्रीय तटीय जोन प्रबध प्राधिकरण का भेजेगा।
VI प्राधिकरण की पूर्वगामी शक्तियां और कृत्य केन्द्रीय सरकार के पर्यवेक्षण और नियत्रण के अधीन होंगी।
VII प्राधिकरण का मुख्यालय चैन्नई में होगा।
VIII प्राधिकरण क विस्तार और अधिकारिना के भीतर विशिष्ट रूप से नहीं आने वाला कोई विषय सबंधित कानूनी प्राधिकारियों द्वारा निपटाया जाएगा।

New Delhi, the 18th January, 2012
S.O. 91 (E) .- In exercise of the powers conferredby sub - sections ( 1 ) and (3 ) of Section 3 of the Environment (Protection)Act, 1986 ( 29 of 1986) ( hereinafter referred to as the saidAct ), the Central Government hereby constitutes an authority to be known as the Tamil Nadu Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons , for a period of three years , with effect from the date of publication of this order in the Official Gazette namely

II TheAuthority shall have the power to implement and enforce the Coastal Regulation Zone Notification , 2011 for protecting and improving the quality of the coastal environment and preventing , abating and controlling environmental pollution in areas of the State of Tamil Nadu , namely

10 Dr K Thanasekaran, Director, Centre for Environment -Member Studies , Anna Umversity, Chennai - 25 ( 1) The Coastal Zone Management Authority shall examine the project proposals in accordance with the approved Coastal Zone Management Plan and in compliance with Coastal Regulation Zone notification and make recommendations within a period of sixty days from date of receipt of complete application
(a) The Ministry of Environment and Forests of State Environmental Impact Assessment Authority as the case may be, for the project attracting Environment ImpactAssessment notification , 2006 ,
(b) the Ministry of Environment and Forests for the projects not covered in the Environment Impact Assessment notification , 2006 but attracting clause (1) ofpara 4 of the Coastal Regulation Zone notification
(c) to the concerned State Authority for the projects not covered under (a ) and (b) above
(u) The State Government , Union Territory Administration , the local authority or the concerned Coastal Zone Management Authority within the framework of such approved Coastal Zone Management Plans as the case may be , in accordance with provisions of this notification shall regulate all developmental activities listed in this notification
(m) The State Government or the Union Territory Coastal Zone Management Authorities shall primarily be responsible for enforcing and monitoring of this notification and to assist in this task, the State Government and the Union Territory shall constitute District Level Committees under the Chairmanship of the District Magistrate concerned contaring at least three representatives of local traditional coastal cominunittes including from fisher folk 4

(iv) Examination of proposals for changes or modifications in classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan received from the Tamil Nadu State Government and making specific recommendations to the National Coastal Zone Management Authority therefore
(v) ( a) Inquiry into cases of alleged violation of the provisions of the said Act and the rules made thereunder or any other law which is relatable to the objects of the said Act and, if found necessary, in a specific case, issuing directions under section 5 of the said Act, insofar , as such directions are not inconsistent with any direction issued in that specific case by the National Coastal Zone Management Authority or by the Central Government ,
(b) Review of cases involving violations of the provisions of the said Act and the rules made thereunder, or under any other law which is relatable to the objects of the said Act , and if found necessary referring such cases , with comment , for review to the National Coastal Zone Management Authority
Provided that the cases under sub -paragraphs (v) (a) and ( u) (b) of paragraph II may either be takenup suo - moto or on the basis of complaint madeby an ımdıvıdual or a representative body or an organization,
(vi) Filing complaints , under Section 19 of the said Act in cases of non - compliance of the directions issued by it under sub - paragraphs (1) and (u) ofparagraph II of this Order

(vii) To take action under Section 10 of the saidAct to verify the facts concerning the issues arising from sub-paragraphs ( 1) and (1) ofparagraph II ofthe Order
III . The Authority shall deal with environmental issues relating to Coastal Regulation Zone which may be referred to it by the State Government of Tamil Nadu , the National Coastal Zone Management Authority of the Central Government
IV To maintain transparency in the working of the Coastal Zone Management Authorities , it shall be the responsibility ofthe Coastal Zone Management Authority to create a dedicated website and post the agenda, minutes , decisions taken, clearance letters , violations , action taken onthe violations and court matters including the Orders of the Hon'ble Court as also the approved Coastal Zone Management Plans of the respective State Government or Unionterntory
V TheAuthority shall furush report of its activities at least once in six months to the National Coastal Zone Management Authority
VI The foregoing powers and functions of the Authority shall be subject to the supervision and control ofthe Central Government.
VII The Authority shall have its headquarters at Chennai
VIII Any matter specifically not falling within the scope and jurisdiction of the Authority as so constituted shall be dealt with by the statutory authorities concerned.
