दक्षिण एशियाई विश्वविद्यालय ( कठिनाइयों का निराकरण ) आदेश , 2012
का.आ.. 136(अ).- दक्षिण एशियाई विश्वविद्यालय अधिनियम, 2008 (2009 का 8) दक्षिण एशियाई विश्वविद्यालय की स्थापना के लिए दक्षिण एशियाई क्षेत्रीय सहयोग संगठन (सार्क) के सदस्य राज्यों की संबंधित सरकारों की ओर से 4 अप्रैल , 2007 को हस्ताक्षरित करार को प्रभावी करने के लिए अधिनियमित किया गया था और उक्त अधिनियम को अधिसूचना सं० का0आ0285(अ) , तारीख 23 जनवरी , 2009 द्वारा 23 जनवरी, 2009 से प्रवृत्त किया गया है ;
और उक्त करार को उक्त अधिनियम की अनुसूची में उसकी धारा 3 के उपबंधों के अधीन करार को भारत में विधि का बल देते हुए उपवर्णित किया गया है और उक्त करार, अनुच्छेद 1 के पैरा 4 के खंड (च) में, उक्त विश्वविद्यालय की विधिक हैसियत पूर्वोक्त विश्वविद्यालय के प्रचालन के लिए नियम, विनियम और उपविधियां बनाने की शक्ति को सम्मिलित करने के लिए उपबंध करता है ;
और पूर्वोक्त अधिनियम के उपबंध दक्षिण एशियाई विश्वविद्यालय द्वारा परिनियम, विनियम और उपविधियां विरचित किए जाने के लिए उपबंध करते हैं ;
और पूर्वोक्त अधिनियम की धारा 20 की उपधारा (2) दक्षिण एशियाई क्षेत्रीय सहयोग संगठन की अन्तर- सरकारी अभिचालन समिति द्वारा विश्वविद्यालय के प्रचालन के लिए प्रथम परिनियम बनाने के लिए भी उपबंध करती है ; i

और उक्त अधिनियम, उसके संपूर्ण उपबंधों में, विश्वविद्यालयों सहित सभी उच्चतर शैक्षिक संस्थाओं की दशा में अनुसरित सामान्य प्रक्रिया के अनुसार " परिनियम " शब्द के प्रतिनिर्देश करता है और "करार " नियमों शब्द के प्रतिनिर्देश करता है ;
और दक्षिण एशियाई क्षेत्रीय सहयोग संगठन की अन्तर- सरकारी अभिचालन समिति ने, अपनी पांचवें और छठे अधिवेशन में उक्त विश्वविद्यालय के प्रचालन के करार के अनुरूप "परिनियम" के बजाए " नियम " की नाम पद्धति का प्रयोग करने के लिए सहमति दी है ;
और सभी दक्षिण एशियाई क्षेत्रीय सहयोग संगठन के सदस्य राज्यों की सरकारों द्वारा अप्रैल, 2007 में हस्ताक्षरित दक्षिण एशियाई विश्वविद्यालय की स्थापना के करार ने उक्त विश्वविद्यालय को विश्वविद्यालय के प्रचालन के लिए नियम, विनियम और उपविधियां बनाने के लिए प्राधिकृत किया है ;
और दी गई परिस्थितियों में , उक्त अधिनियम के उपबंधों को उक्त करार के अनुरूप प्रभावी करने में कठिनाइयां उत्पन्न हुई हैं और इसलिए उक्त विश्वविद्यालय के प्रचालन में महसूस की गई कठिनाइयों को दूर करना आवश्यक हो गया है ;
अतः, अब, केंद्रीय सरकार, दक्षिण एशियाई क्षेत्रीय सहयोग संगठन अधिनियम, 2008 (2009 का 8) की धारा 32 की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ऐसी कठिनाई को दूर करने के लिए, निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इस आदेश का संक्षिप्त नाम दक्षिण एशियाई विश्वविद्यालय ( कठिनाइयों का दूर किया जाना) आदेश, 2012 है ।
(2) यह राजपत्र में उसके प्रकाशन की तारीख को प्रवृत्त होगा ।
2. दक्षिण एशियाई विश्वविद्यालय अधिनियम, 2008 में, " परिनियम " शब्दों के स्थान पर, जहां कहीं वह आता है, " नियम" शब्द रखा जाएगा ।

ORDER
New Delhi , the 20th January, 2012
The South Asian University (Removal of Difficulties ) Order, 2012
S.O. 136( E) .- Whereas , the South Asian University Act , 2008 (8 of 2009 ) , was enacted to give effect to the Agreement for the establishment of the South Asian University , signed on behalf of the respective Governments of the Member States of the South Asian Association for Regional Cooperation ( SAARC ) on the 4th day of April , 2007 and the said Act has been brought into force with effect from 23rd day of January , 2009 by notification No. S.O. 285 ( E ), dated the 23 January, 2009;
And Whereas , the said Agreement has been set out in the Schedule to the said Act giving the Agreement the force of law in India under the provisions of section 3 thereof and the said Agreement , in clause ( f ) of para 4 of Article 1 , provides for the legal capacity of the said University to include power to make rules, regulations and bye -laws for the operation of the University aforesaid;
And Whereas, the provisions of the aforesaid Act provides for framing of Statutes , Regulations and bye -laws by the South Asian University;
And Whereas, sub- section (2 ) of section 20 of the aforesaid Act provides for making of the First Statutes for the operation of the University by the Inter - Governmental Steering Committee of the SAARC;
And Whereas , the said Act , throughout its provisions , refers to the word "Statutes " as per the usual practice followed in case of all the Higher Educational institutions including Universities and the said Agreement refers to the word " rules ";

And Whereas , the Inter- Governmental Steering Committee of the SAARC , in its Fifth and Sixth meeting , agreed to use the nomenclature " Rules " instead of " Statutes " in conformity with the Agreement for the operation of the said University;
And Whereas , the Agreement for the establishment of the South Asian University signed by the Governments of all SAARC Member States in April , 2007 authorised the said University to make rules , regulations and bye-laws for the operation of the University ;
And Whereas , in the given circumstances , difficulties have arisen in giving effect to the provisions of the said Act in consonance with the said Agreement and , therefore it has become necessary to remove the difficulties felt in the operation of the said University;
Now therefore, in exercise of the powers conferred by sub-section (1) of section 32 of the South Asian University Act , 2008 (8 of 2009), the Central Government hereby makes the following order , to remove such difficulty, namely : -
1. ( 1 ) This Order may be called the South Asian University ( Removal of Difficulties ) Order , 2012.
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the South Asian University Act, 2008 , for the word " Statutes", wherever it occurs , the word " Rules" , shall be substituted.
