सा.का.नि. 46 (अ).- केन्द्रीय सरकार, खान और खनिज ( विकास और विनियमन) अधिनियम, 1957 ( 1957 का 67) की धारा 9 की उप- धारा (3) द्वारा प्रदत्तं शक्तियो का प्रयोग करते हुए , उक्त अधिनियम की द्वितीय अनुसूची में आगे निम्नलिखित सशोधन करती है, अर्थात्:-
2. उक्त अनुसूची की मद 11 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद और प्रविष्टियां रखी जाएंगी, अर्थात्:-
11. कोयला:
अ. पश्चिम बंगाल राज्य को छोड़कर सभी राज्यों और संघ राज्यक्षेत्रों में उत्पादित कोयला ।
(1 ) कोयला पर स्वामिस्व:
स्वामिस्व की दरें, जो स्वामिस्व की विनिर्दिष्ट और मूल्यानुसार दरों का संयोजन होगा, जो निम्नानुसार होंगी:
आरं ( स्वामिस्व रूपए प्रति टन) = ए + बीपी
जहां 'पी " (मूल्य) से आरओएम (खान से निकला) कोयला और लिग्नाइट का प्राथमिक पिटहैड मूल्य अभिप्रेत होगा जैसे कि करों, उद्ग्रहण तथा अन्य प्रभारों को छोड़कर बीजक में प्रदर्शित किया गया है "ए " ( नियत घटक) और "बी " ( भिन्न- भिन्न या मूल्य अनुसार घटक) के मूल्यनिम्नानुसार होंगेः

अर्थात् 180 रूपए + जहां "पी " (मूल्य) से आरओएम (खान से निकला) कोयला और लिग्नाइट का प्राथमिक पिटहैड मूल्य अभिप्रेत होगा , जैसे कि करों , उद्ग्रहण तथा अन्य प्रभारों को छोड़कर बीजक में प्रदर्शित किया गया है, का 5 प्रतिशत ।
ए = 130.00 रूपए
बी = 5 प्रतिशत
अर्थात् 130 रूपए + जहां 'पी " ( मूल्य) से आरओएम (खान से निकला) कोयला और लिग्नाइट का प्राथमिक पिटहैड मूल्य अभिप्रेत होगा , जैसे कि करों , उद्ग्रहण तथा अन्य प्रभारों को छोड़कर बीजक में प्रदर्शित किया गया है , का 5 प्रतिशत ।
6701 एवं उससे अधिक जीसीवी (कि.कैलो . /कि.ग्रा. ) वाला गैर-कोककारी कोयला
6401-6700 जीसीवी (कि.कैलो. /कि.ग्रां.) वाला गैर-कोककारी कोयला
6101-6400 जीसीवी (कि.कैलो. /कि.ग्रा .) वाला गैर-कोककारी कोयला

ए = 90.00 रूपए
बी 5 प्रतिशत .

अर्थात् 70 रूपए + जहां "पी " (मूल्य) से आरओएम (खान से निकला) कोयला और लिग्नाइट कां प्राथमिक पिटहैड मूल्य अभिप्रेत होगा, जैसे कि करों, उग्रहण तथा अन्य प्रभारों को छोड़कर बीजक में प्रदर्शित किया गया है, का 5 प्रतिशत।
4001-4300 जीसीवी (कि. कैलो. /कि.ग्रा .) वाला गैर-कोककारी कोयला ए = 55.00 रुपए बी = 5 प्रतिशत अर्थात् 55 रूपए + जहां 'पी " (मूल्य) से आरओएम (खान से निकला) कोयला और लिग्नाइट का प्राथमिक पिटहैड मूल्य अभिप्रेत होगा, जैसे कि करों, उद्ग्रहण तथा अन्य प्रभारों को छोड़कर बीजक में प्रदर्शित किया गया है, का 5 प्रतिशत ।

3100 एवं उससे कम जीसीवी वाला गैर- कोककारी
बी = मूल्य का 5 प्रतिशत
अर्थात् 45 रूपए + विद्यमान वास्तविक बीजक मूल्य (कर और अन्य उग्रहण को छोड़कर) का 5 प्रतिशत
(2) लिग्नाइट पर स्वामिस्व :
ए = 45.00 रूपए
बी = 2 प्रतिशत
अर्थात 45 रूपए + आरओएम ( खान से निकला) कोयला और लिग्नाइट का प्राथमिकता पिटहैड मूल्य, जैसा कि करों, उद्ग्रहण तथा अन्य प्रभारों को छोड़कर बीजक में प्रदर्शित किया गया है, का 2 प्रतिशत
(3) मिडलिंग्स पर स्वामिस्व:

बी = मूल्य का 5 प्रतिशत
सकल ऊष्मा मान 3100 अर्थात 45 + मौजूदा वास्तविक बीजक मूल्य (करों और अन्य उद्ग्रहणों को छोड़कर)
का 5 प्रतिशत
स्वामिस्व ऐसे मिडलिंग्स या अस्वीकार्य पर प्रभारित नहीं होगी जबकि स्वामिस्व के दोहरे प्रभारण से बचने के लिए उसकी घुलाई के पूर्व कच्चे कोयले पर प्रभारित किया गया है ।
4. उपकर के उद्ग्रहण के प्रति स्वामिस्व का समायोजन :
पश्चिम बंगाल से भिन्न राज्यों के लिए कोयला धारक भूमि के विनिर्दिष्ट उपकर या अन्य करों के उस उद्ग्रहण को अनुज्ञात स्वामिस्व का स्थानीय उपकरों या ऐसे करों के लिए समायोजन किया जाएगा जिससे कि समस्त राजस्व को फार्मूला आधारित उत्पादन तक सीमित किया जा सके ।

स्पष्टीकरण:- कोयला के श्रेणीकरण के प्रयोजन के लिए, कोयले की प्रत्येक श्रेणी का विनिर्देश कोलियरी नियन्त्रण नियमावली, 2004 के नियम 3 के अधीन यथा विहित होगा ।

GS.R. 46(E ) . In exercise of the powers conferredby sub - section (3 ) of section 9 of the Mines and Minerals ( Development and Regulation ) Act , 1957 ( 67 of 1957 ) the Central Government hereby makes the following further amendment in the Second Schedule to the said Act, namely: -

The royalty shall not be charged on such middlings or rejects wherein royalty has been charged on raw coal prior to its washing in order to avoid double charging of royalty.
(4) Adjustment of royalty against levying of cess :
For States other than West Bengal that levy cess or other taxes specific to coal bearing lands , the royalty allowed shall be adjusted for the local cesses or such taxes so as to limit the overall revenue to the formula based yield .
