का.आ. 158(अ) .-कोलकाता नगर में मेट्रो रेलवे के निर्माण और उससे संबंधित अन्य संकर्मों के निर्माण के प्रयोजन के लिए इसमें नीचे अनुसूची में उल्लिखित भूमि, भवन , गलियां, सड़कें, रास्ते या नाले अथवा उनको उपयोग में लाए जाने के अधिकार अपेक्षित हैं;
और केन्द्रीय सरकार का यह समाधान हो गया है कि इस अनुसूची में उल्लिखित भूमि, भवन , गलियां , सड़कें, रास्ते या नाले अथवा उनको उपयोग में लाए जाने के अधिकार लोक प्रयोजन के लिए अपेक्षित हैं;
अनुसूची में उल्लिखित क्षेत्र के रेखांक का, जो कि ड्रॉइंग सं. एम . आर सी/डब्ल्यू/सर्वे/ 1-2008 और एम आर सी/डब्ल्यू/सर्वे/ 2-2008 में दर्शाया गया है , सक्षम अधिकारी के कार्यालय में निरीक्षण किया जा सकता है;
अतः , केन्द्रीय सरकार , मैट्रो रेलवे ( संकर्म सन्निर्माण ) अधिनियम , 1978 ( 1978 का 33 ) की धारा 7 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , इस अनुसूची में यथा- उल्लिखित भूमि, भवन , गलियां, सड़कें, रास्ते या नाले अथवा उनके उपयोग के अधिकार का अधिग्रहण करने के, लिए अपने आशय की घोषणा करती है;
नीचे अनुसूची में उल्लिखित उक्त भूमि, भवन , गलियां, सड़कें, रास्ते या नालों अथवा उनको उपयोग में लाए जाने के अधिकार में कोई हितबद्ध व्यक्ति इस अधिसूचना के सार के प्रकाशन की तारीख से इक्कीस दिन के भीतर उक्त अधिग्रहण पर आक्षेप कर सकता है । आक्षेप यदि कोई हो तो , सक्षम प्राधिकारी , मैट्रो रेलवे , 39/1 , रासबिहारी एवेन्यू ( प्रथम तल ) , कोलकाता-700026 को लिखित में भेजा जा सकेगा तथा सक्षम प्राधिकारी को आक्षेपकर्ता को व्यैक्तिक रूप में या किसी विधि व्यावसायी द्वारा सुनवाई का अवसर देगा और ऐसे आक्षेप को सुनने के पश्चात्और जाँच करनें के पश्चात्, यदि कोई हो , जैसा भी सक्षम प्राधिकारी उचित संमझे , आदेश द्वारा आक्षेपों को या तो अनुज्ञात कर सकता है या अननुज्ञात कर सकेगा; :
उक्त अधिनियम की धारा 9 की उप- धारा ( 2 ) के अधीन सक्षम प्राधिकारी द्वारा दिया गया कोई भी आदेश अंतिम होगा ।

NewDelhi , the 25th January, 2012
S.O. 158 (E) . Whereas the land, buildings , streets , roads , passages or nallah or the right of users therein, mentioned in the Schedule , are required for the purpose of construction of Metro Railway and other works connected therewith in the city of KOLKAΤΑ ;
And whereas , the Central Government is satisfied that the said lands , buildings , streets , roads , passages or nallah or the right of users therein , as mentioned in the Schedule, are required for a public purpose ;
Theplanofthe area, mentioned in the Schedule , bearing drawings number MRC /W/ SURVEY/ 1-2008 and MRC/W/ SURVEY/ 2-2008 may be inspected in the office of the Competent Authority;
Now, therefore, in execise of the powers conferred by sub - section ( 1 ) of Section 7 of the Metro Railways (Construction of Works) Act, 1978 (33 of 1978 ) , the Central Government hereby declare its intention to acquire the lands, buildings , streets , roads , passages or nallah or the right of users therein, as mentioned in the Schedule;
Any person intersted in the said lands , buildings , streets , roads , passages or nallah or the right of users therein as mentioned in the Schedule may, within twenty one days from the date ofpublication ofthe substance of this Notification, object to such acquisition. The objections , if any, may be forwarded to the Competeny Authority, Metro Railway, 39/1 , Rash [भाग II- खण्ड 3 ( ii ) ]

Bihari Avenue, ( 1st floor ), Kolkata- 700026 in writing and shall set out the grounds thereof and the Competent Authority 'shall give the objector an opportunity ofbeing heard either in person or by a legal practitioner, and may, after hearing such objection and after making such enquiry, if any, as the Compétent Authority thinks necessary, by order, either allow or disallow the objections .
Any order made by the competent authority under sub -section ( 2) ofSection 9 of the said Act shall be final ;
