सा.का.नि. 50 (अ).- राष्ट्रपति , सविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय सिविल लेखा सेवा ( समूह 'ग ' ) भर्ती नियम , 2000 को , जहां तक उसका संबंध लेखाकार और ज्येष्ठ लेखकार से है , उन बातो के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , केन्द्रीय सिविल लेखा सेवा मे लेखाकार और ज्येष्ठ लेखाकार के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अथार्त.-
1 सक्षिप्त नाम और प्रारभ ( 1 ) इन नियमो का संक्षिप्त नाम केन्द्रीय सिविल लेखा सेवा (लेखाकार और ज्येष्ठ लेखाकार समूह ' ग' पद) भर्ती नियम , 2010 है ।
(2. ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएं - इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो ,
(क) " नियुक्ति प्राधिकारी " का वही अर्थ होगा जो केन्द्रीय सिविल सेवा (वर्गीकरण , नियंत्रण और अपील) नियम, 1965 में समनुदेशित है;

(ख) " काडर " से क्रमशः लेखाकार और ज्येष्ठ लेखाकार अभिप्रेत है । प्रत्येक मंत्रालय इन नियमी के उपाबंध मे यथाविनिर्दिष्ट पदो की कुल संख्या में समाविष्ट लेखाकार और ज्येष्ठ लेखाकार की अपनी-अपनी श्रेणियो मे लेखाकार और ज्येष्ठ लेखाकार का अपना स्वयं का पृथक और स्वतंत्र काडर होगा ;
(ग) "सरकार " से भारत सरकार अभिप्रेत है;
(घ) "आयोग" से कर्मचारी चयन आयोग या इन नियमों के अंतर्गत आने वाले कोई अन्य भर्ती करने वाले अभिकरण जिसको सरकार गठित करे , अभिप्रेत है;
(ङ) " महालेखा नियंत्रक " से वित्त मंत्रालय , व्यय विभाग का महालेखा नियंत्रक अभिप्रेत है और जिसके अंतर्गत इन नियमों के अधीन शक्तियों का प्रयोग करने के लिए महालेखा नियंत्रक द्वारा प्राधिकृत किए गए अपर महालेखा नियंत्रक या संयुक्त महालेखा नियंत्रक या उप महालेखा नियंत्रक या सहायक महालेखा नियंत्रक भी है;
(च) " मंत्रालय " से भारत सरकार का कोई मंत्रालय अभिप्रेत है और जिसके अंतर्गत इन नियमों से उपाबंध में विनिर्दिष्ट मंत्रालय के कोई विभाग या कोई कार्यालय भी हैं;
(छ) " अनुसूची" से इन नियमों में उपाबंध अनुसूची अभिप्रेत है ।
"सेवा " से केन्द्रीय सिविल लेखा सेवा ( समूह 'ग' ) अभिप्रेत है ।
(ज)
(झ) " संगठित लेखा सेवा ' जिसके अंतर्गत सरकार के लेखा और संपरीक्षा विभाग, रक्षा लेखा , रेल लेखा , डाक - तार लेखा की लेखा सेवाएं और दूर संचार लेखा भी है ।
3. पद - संख्या , वर्गीकरण तथा वेतन बैंड और ग्रेड- वेतन/वेतनमान उक्त पदों की संख्या उनका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन/वेतनमान वे होंगें , जो इन नियमों से उपाबध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति , आयु- सीमा , शैक्षिक अर्हताएं आदि : भर्ती की पद्धति , आयु- सीमा , शैक्षिक अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो इन नियमों से उपाबंद्ध अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।
5. प्रोन्नति का विनियमन :
( 1 ) लेखाकार और ज्येष्ठ लेखाकार के काडरों में प्रोन्नति , इस नियम के अधीन विहित रूप में महालेखा नियंत्रक द्वारा विनियमित की जाएगी ।

(2) (क) जहां प्रोन्नति ज्येष्ठता - सह- उपयुक्तता पर आधारित है , वहा प्रत्येक मंत्रालय प्रतिवर्ष , अनुसूची के स्तंभ 12 के अनुसार पोषक श्रेणी मे न्यूनतक अर्हक सेवा के साथ सभी पात्र अभ्यर्थियो के संबंध में विचार करने के लिए विभागीय प्रोन्नति समिति की बैठक आयोजित करेगा और प्रोन्नति के लिए उपयुक्त पाए गए अभ्यर्थियों की उनकी ज्येष्ठता के क्रम मे एक चयन सूची तैयार करेगा और उसे महालेखा नियंत्रक को भेजेगा ।
(ख) महालेखा नियंत्रक उक्त चयन सूचियों से नीचे उप पैरा( ग ) में अंतर्विष्ट उपबंधों के अनुसार अभ्यर्थियों की संयुक्त चयन सूची तैयार करेगा।
(ग) संयुक्त चयन सूची मंत्रालयों की चयन सूचियों से , ज्येष्ठता के क्रम में , नामों को विलय करके तैयार की जाएगीं । संयुक्त चयन सूची में सम्मिलित किए जाने वाले अभ्यर्थियों की संख्या महालेखा नियंत्रक द्वारा विहित की गई तारीख को मंत्रालयों में संबंधित काडगे मे उपलब्ध रिक्त पदों की कुल संख्या पर आधारित होगी ! संयुक्त चयन सूची से विभिन्न मंत्रालयो के अभ्यर्थियों की परस्पर ज्येष्ठता पोषक श्रेणी मे उनके द्वारा की गई सेवावधि के आधार पर और सरकार द्वारा , समय- समय पर ज्येष्ठता के अवधारण के लिए इस बाबत अधिकथित साधारण सिद्धांतो के अनुसार अवधारित की जाएगी::
परन्तु एक ही मंत्रालय के अभ्यार्थियों की परस्पर ज्येष्ठता सयुक्त चयन सूची में बनाए रखी जायेगी ।
महालेखा नियंत्रक , सम्मिलित चयन सूची से मत्रालयो को अभ्यर्थियों का आबंटन करेगा ।
(घ)
(3) (क) जहां प्रोन्नति , विभागीय प्रतियोगिता परीक्षा पर आधारित है , वहां प्रत्येक मंत्रालय महालेखा नियत्रक के निदेश के अनुसार उसे विभागीय प्रतियोगिता परीक्षा मे बैठने के लिए उपयुक्त पाए गए अभ्यर्थियो की एक सूची भेजेगा ।
(ख) महालेखा नियंत्रक , समय- समय पर विभागीय प्रतियोगिता परीक्षा संचालित करेगा और परीक्षा में उनकी योग्यता क्रम में अभ्यर्थियों की चयन सूची तैयार करेगा ।
(ग) जब तक कि महालेखा नियंत्रक द्वारा अन्यथा आदेश न किया गया हो , चयन सूची मे अभ्यर्थियों की संख्या , विभागीय प्रतियोगिता परीक्षा कोटा के अधीन उपलब्ध कुल रिक्तियों की संख्या तक निर्बंधित होगी ।
महालेखा नियंत्रक , चयन सूची से अभ्यार्थियों का मत्रालयो को आबंटन करेगा ।
(घ)
स्थानांतरण - ( 1 ) लेखाकार और ज्येष्ठ लेखाकार , भारत के किसी भाग में सेवा करने के लिए 6. दायी होंगे ।

(2) महालेखा नियंत्रक का यदि यह समाधान हो जाता है कि लोकांहत में ऐसा करना आवश्यक या समीचीन है तो वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके आदेश द्वारा किसी लेखाकार या ज्येष्ठ लेखाकार के अनुरोध पर उसी श्रेणी में एक मंत्रालय से दूसरे मंत्रालय में स्थानांतरण कर सकेगा ।
निरर्हता : वह व्यक्ति -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है,
या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगाः
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगा ।
8. शिथिल करने की शक्तिः जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बातत , आदेश द्वारा शिथिल कर सकेगी ।
9. व्यावृत्ति : इन नियमो की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियो , अन्य पिछड़े वर्गों भूतपूर्व सैनिकों और अन्य वशेिष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

सीधेभर्तीकिएजानेवालेव्यक्तियोकीदशामेदोवर्ष। परिवीक्षाकीअवधिकिसीभीदशामेंविस्तारितकीजासकेगीयदिनियुक्ति प्राधिकारीउपयुक्तसमझेकिन्तुपरिवीक्षाकेविस्तारकीकुलअवधिएकवर्ष सेअधिकनहींहोगीजहापदधारीकेविरूद्धकोईविभागीययाविधिक कार्यवाहियाकाआदेशकेलबितहोनेकेकारणआवश्यकहो।सीधेभर्तीकिए गएव्यक्तिकोमहालेखानियत्रकद्वारासचालितविभागीयपुष्टिकारीपरीक्षा विनिर्दिष्टशतोंऔरनिबंधनोंकेअनुसारऔरतीनवर्षकेभीतरउत्तीर्णकरना होगा।यदिवेउक्तपरीक्षाउत्तीर्णकरनेमेंअसफलरहतेहैंतोअवरश्रेणी लिपिककेनिम्नतरपदस्वीकारकरनेकाअवसरदियाजाएगा।फिरभी,यदि वेउक्तप्रस्तावकोअस्वीकारकरतेहैंतोवेसेवोन्मुक्तकिएजानेकेदायी

GS.R. 50(E). In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Civil Accounts Service( Group ' C' ) Recruitment Rules , 2000 , in so far as they relate to Accountant and Senior Accountant , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Accountant and Senior Accountant in the Central Civil Accounts Service , namely: -
1. Short title and Commencement.- ( 1 ) These rules may be called the Central Civil Accounts Service ( Accountant and Senior Accountant Group ' C ' posts ) Recruitment Rules, 2010.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions . In these rules unless the context otherwise
requires,
(a) "Appointing authority " shall have the same meaning as assigned to in the Central Civil Services (Classification , Control and Appeal ) Rules , 1965;
(b) " Cadre" means the cadre of Accountant and Senior Accountant respectively . Each Ministry shall have its own separate and independent cadres of Accountant and Senior Accountant comprising total number of posts as specified in the Annexure to these rules , in the respective grades of Accountant and Senior Accountant;
(c) " Government" means the Government of India;

(d) "Commission" means the Staff Selection Commission or any other recruiting agency for the cadres covered by these rules, which the Government may constitute ;
(e) " Controller General of Accounts" means the Controller General of Aecounts in the Department of Expenditure, Ministry of Finance and. includes Additional Controller General of Accounts or Joint Controller General of Accounts or Deputy Controller General of Accounts or Assistant Controller General of Accounts authorised by the Controller General of Accounts to exercise powers under these rules ;
(f) " Ministry" means a Ministry in the Government of India and includes Departments of the Ministry or an Office specified in the Annexure to these rules;
( g) "Schedule" means Schedule annexed to these rules ;
( h) " Service" means the Central Civil Accounts Service (Group ' C' ) ;
( i) "Organised Accounts Services " include the Accounts Services
Accounts , Post and Telegraph Accounts and Telecom Accounts in the in the Departments of Audit and Accounts , Defence Accounts , Railway Government.
3. Number of posts , classification and pay band and grade pay / pay scale. The number of posts , their classification and pay band and grade pay/ pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .
4. Method of recruitment, age limit, educational qualification , etc. The method of recruitment, age limit, educational qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the Schedule annexed to these rules .
5. Regulation of Promotion.- ( 1 ) Promotion in the cadres of Accountant and Senior Accountant shall be regulated by the Controller General of Accounts as prescribed under this rule.

(2) (a) Where promotion is based on seniority - cum- fitness , each Ministry shall hold a Departmental Promotion Committee meeting each year to consider all eligible candidates with minimum qualifying service in the feeder grade as per column 12 of Schedule and prepare a select list of the candidates found fit for promotion in order of their seniority and forward the same to the Controller General ofAccounts ;
(b) From the said select lists , the Controller General of Accounts shall prepare a combined select list of candidates in accordance with the provisions contained in sub - para (c ) below;
(c) The combined select list shall be prepared by merging names from the select lists of the ministries in order of seniority . The number of candidates to be included in the combined select list shall depend on the total number of vacancies available in respective cadres in the Ministries on a date specified by the Controller General of Accounts . The inter - se -seniority of the candidates from different Ministries in the combined select list shall be determined on the basis of length of service rendered by them in the feeder grade and in terms of general principles for determining seniority in this regard as laid down by the Government from time to time:
Provided that inter- se-seniority of the candidates from the same Ministry shall be retained in the combined select list;
(d) The Controller General of Accounts shall allocate candidates to the Ministries from the combined select list .
(3)(a) Where promotion is based on departmental competitive examination , each Ministry shall , in accordance with the directive of the Controller General of Accounts , forward to it a list of candidates considered fit to appear in the departmental competitive examination;
(b) The Controller General of Accounts shall conduct the departmental competitive examination from time to time and prepare a select list of candidates in order of their merit in the examination ;
(c) The number of candidates in the select list shall be restricted to the total number of vacancies available under the departmental competitive examination quota unless otherwise ordered by the Controller General of Accounts;

(d) The Controller General of Accounts shall allocate candidates from the select list to the Ministries .
6. Transfer . ( 1 ) The Accountant and Senior Accountant shall be liable to serve in any part of India .
(2) The Controller General of Accounts may, if satisfied that it is necessary or expedient in public interest so to do , by order , and for reasons . to be recorded in writing , transfer an Accountant and Senior Accountant on request by officer , from one Ministry to the other in the same grade,
7 . Disqualification.-- No person.-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or .
( b) who, having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage , and that there are other grounds for so doing , exempt any person from operation of this rule .
8. Power to relax . Where the Central Government is of the
opinion that it is expedient so to do , it may , by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
9. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , ex- Servicemen and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard .
