सा.का.नि. 53(अ).- राष्ट्रपति , सविधान के अनुच्छेद 309 के परतुक द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए और केन्द्रीय सिविल लेखा सेवा ( स्टाफ कार ड्राइवर) ( समूह ' ग' भर्ती नियम , 2001 को जहां तक उनका सबंध स्टाफ कार ड्राइवर से है , उन बातो के सिवाए अधिक्रात करते हुए, जिन्हे ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , केन्द्रीय सिविल लेखा सेवा में स्टाफ कार ड्राइवर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात.-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का सक्षिप्त नाम केंद्रीय सिविल लेखा मेवा (स्टाफ कार ड्राइवर , समूह " ग " पद) भर्ती नियम , 2010 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगे ।
2. परिभाषाएं - इन नियमों में जब तक कि सदर्भ से अन्यथा अपेक्षित न हो , -
( क) " नियुक्ति प्राधिकारी " का वही अर्थ होगा जो केन्द्रीय सिविल सेवा ( वर्गीकरण, नियंत्रण और अपील) नियम , 1965 में समनुदेशित है ,

(ख) "काडर" से स्टाफ कार ड्राइवर का काडर अभिप्रेत हैं । प्रत्येक मत्रालय के पास स्टाफ कार ड्राइवर का स्वयं पृथक और स्वतत्र काडर होगा जो स्टाफ कारं ड्राइवर की अपनी-अपनी श्रेणी में इन नियमों के उपाबध मे यथाविनिर्दिष्ट पदों की कुल सख्या से समाविष्ट होगा ,
(ग) " सरकार " से भारत सरकार अभिप्रेत है;
(घ) " आयोग " से कर्मचारी चयन आयोग या इन नियमों के अंतर्गत काडरों के लिए अन्य भर्ती अभिकरण अभिप्रेत है , जिसको सरकार गठन कर सकेगी ,
(ङ) " महालेखा नियंत्रक " से व्यय विभाग, वित्त मंत्रालय में महालेखा नियंत्रक अभिप्रेत. है , जिसमें इन नियमों के अधीन शक्तियों का प्रयोग करने के लिए महालेखा नियंत्रक द्वारा प्राधिकृत है जिसमें अपर महालेखा नियंत्रक या संयुक्त महालेखा नियत्रक या उप महालेखा नियंत्रक या सहायक महालेखा नियंत्रक सम्मिलित हैं ।
(च) " मंत्रालय " से भारत सरकार का मंत्रालय अभिप्रेत है और इसमें इन नियमों के उपाबंध में विनिर्दिष्ट मंत्रालय के विभाग या कार्यालय सम्मिलित हैं;
(छ) "अनुसूची" से इन नियमों से उपाबद्ध अनुसूची अभिप्रेत हैं;
(ज) "सेवा " से केन्द्रीय सिविल लेखा सेवा ( समूह ' ग' ) अभिप्रेत है;
(झ ) " संगठित लेखा सेवा " में सरकार के लेखा और संपरीक्षा विभागों , रक्षा लेखाओं, रेल लेखाओं , डाक और टेलीग्राफ लेखा में लेखा सेवा और टेलीकाम लेखा सम्मिलित है ।
3 . पद-संख्या, वर्गीकरण और वेतनमान : उक्त पदों की सख्या , उनका वर्गीकरण और उनके वेतनमान वह / वे होंगे , जो इन नियमों से उपबद्ध अनुसूची के स्तभ 2 से स्तभ 4 में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति, आयु - सीमा और अन्य अर्हताएं आदिं : उक्त पदों पर भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त/ उक्त अनुसूची के स्तभ 5 से स्तभ 14 में विनिर्दिष्ट हैं ।
5. स्थानांतरण - ( 1 ) स्टाफ कार ड्राइवर भारत के किसी भाग में सेवा करने के लिए दायी होगा। (2) महालेखा नियंत्रक का यदि समाधान हो जाता है कि लोकहित मे ऐसा करना आवश्यक या समाचीन है तो वह आदेश द्वारा और कारण लेखबद्ध करके अधिकारी द्वारा अनुरोध किए जाने पर उसी श्रेणी में एक मंत्रालय से दूसरे में स्थानांतरणं कर दिया जाएगा ।

6.. निरर्हता -
(क
) जिसने ऐसे व्यक्ति जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नही होगा;
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
7. शिथिल करने की शक्ति जहा केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
8. व्यावृत्ति : इन नियमों की कोई बात ऐसे आरक्षण, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस सबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिको और अन्य पिछड़े वर्गों के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

GS.R. 53 (E ). In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Civil Accounts Service ( Staff Car Driver) Group C posts Recruitment Rules , 2001 in so far as they relate to Staff Car Driver , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Staff Car Driver in the Central Civil Accounts Service , namely: -
1. Short title and Commencement.- ( 1 ) These rules may
be called the Central Civil Accounts Service ( Staff Car Driver, Group ' C ' posts) Recruitment Rules , 2010 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions . In these rules , unless the context otherwise requires , [PART 11-SEC. 3(i) ] THE GAZETTE OF INDIA EXTRAORDINARY

(a) "Appointing authority " shall have the same meaning as assigned to in the Central Civil Services ( Classification , Control and Appeal ) Rules , 1965;
(b). " Cadre " means the cadre of Staff Car Driver . Each Ministry shall have its own separate and independent cadre of Staff Car Driver comprising total number of posts as specified in the Annexure to these rules , in the respective grade of Staff Car Driver ;
(c) "Government " means the Government of India;
(d) " Commission " means the Staff Selection Commission or any other recruiting agency for the cadres covered by these rules, which the Government may constitute;
(e) "Controller General of Accounts " means the Controller General of Accounts in the Department of Expenditure , Ministry of Finance and includes Additional Controller General of Accounts or Joint Controller General of Accounts: or Deputy Controller General of Accounts or Assistant Controller General of Accounts authorised by the Controller General of Accounts to exercise powers under these rules ;
(f) " Ministry " means a Ministry in the Government of India and includes Departments of the Ministry or an Office specified in the Annexure to these rules ; -
(g) " Schedule " means Schedule annexed to these rules ;
(h) " Service " means the Central . Civil Accounts Service (Group ' C ' ) ;
( i) "Organised Accounts Services " include the Accounts Services in the Departments of Audit and Accounts , Defence Accounts , Railway Accounts , Post and Telegraph Accounts and Telecom Accounts in the Government .
3. Number of posts , classification and pay band and grade pay/ pay scale. The number of posts , their classification and pay band and grade pay/pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

4. Method of recruitment , age limit , educational qualification etc. The method of recruitment , age limit , educational qualification and other matters relating thereto shall be as specified in columns 5 to 14 of the Schedule annexed to these rules .
5. Transfer . ( 1 ) Staff Car Driver shall be liable to serve in any part of India.
(2) The Controller General of Accounts may , if satisfied that it is necessary or expedient in public interest so to do , by order , and for reasons to be recorded in writing , transfer a Staff Car Driver on request by officer , from one Ministry to the other in the same grade.
6. Disqualification.- No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living, has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post :
Provided that the Central Government may if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage , and that there are other grounds for so doing , exempt any person from operation of this rule .
7. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
8. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , ex- Servicemen and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.
