सा.का नि 56(अ)-अखिल भारतीय सेवाए अधिनियम , 1951 ( 1951 का 61 ) की धारा 3 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियो का प्रयोग करते हुए , केन्द्रीय सरकार राज्य सरकारो के परामर्श से अखिल भारतीय सेवा ( मृत्यु-सह-सेवानिवृत्ति लाभ) नियमावली , 1958 मे आगे और सशोधन करने के लिए एतद्वारा निम्नलिखित नियमो को बनाती है , अर्थात :--
1 ( 1 ) ये नियम अखिल भारतीय सेवा ( मृत्यु-सह- सेवानिवृत्ति लाभ ) सशोधन नियमावली , 2012 कहलाएगे ।
( u ) ये नियम शासकीय राजपत्र मे इनके प्रकाशन की तारीख
को प्रवृत होगे ।
2 अखिल भारतीय सेवा ( मृत्यु- सह- सेवानिवृत्ति लाभ ) नियमावली , 1958 में नियम 16 मे , उप - नियम ( 3 ) हतु निम्नलिखित प्रतिस्थापित किया जाएगा , अर्थात्-
' ( 3) केन्द्रीय सरकार , सबधित राज्य सरकार के परामर्श से , सेवा के किसी सदस्य को कम से कम तीन माह पूर्व लिखित नोटिस मे अथवा ऐसे नोटिस के बदले में तीन माह का वेतन और भत्तो 'को दिए जाने के पश्चात्, लोकहित मे सेवानिवृत्त होने की अपेक्षा कर सकती है,-
( 1 ) समीक्षा के पश्चात् जब ऐसा सदस्य 15 वर्ष की अर्हक सेवा पूरी करता है , अथवा
( 11 ) समीक्षा के पश्चात् जब ऐसा सदस्य 25 वर्ष की अर्हक सेवा पूरी करता है अथवा 50 वर्ष की आयु , जैसा भी मामला हा , का प्राप्त करता है ; अथवा

( m ) यदि किसी ऐसे अन्य समय , जैसा कि केन्द्र सरकार , ऐसे सदस्य के मामले मे उचित समझती है , ममीक्षा के पश्चात्ऊपर ( 1 ) अथवा ( 1 ) मे सदर्भित समीक्षा नही की गई हो ।
सपष्टीकरण उप-नियम ( 3 ) के प्रयोजनो से , " समीक्षा " से तात्पर्य , सेवा मे और आगे प्रतिधारण हेतु ऐसे सदस्य की उपयुक्तता अथवा अन्यथा के सबंध मे सेवा के सदस्य के सम्पूर्ण सेवा रिकॉर्ड की समीक्षा ऐसी सेवा , प्रथमतः , अर्हक मेवा के 15 वर्ष के पूर्ण होने के पश्चात् और द्वितीयतः , उनके अर्हक सेवा के 25 वर्ष पूर्ण होने अथवा उनके 50 वर्ष की सेवा प्राप्ति , जैसा भी मामला हो , के पश्चात् अथवा समीक्षा यदि ऐसे सदस्य के सबध में केन्द्र सरकार द्वारा उपयुक्त समझे गए रूप में किसी अन्य समय की गई समीक्षा के पश्चात् इस उप -नियम के खड ( 1 ) अथवा ( 11 ) मे सदर्भित समीक्षा निष्कर्ष पर नही पहुंचती है के प्रत्येक सदस्य के लिए सचालित किए जाने से है । '

6 GS.R. 56 (E) . În exercise of the powers conferred by sub - section ( 1 ) of Section 3 of the All India Services Act, 1951 ( 61 of 1951 ) , the Central Government, after consultation with State Governments , hereby makes the following rules further to amend the All India Services (Death- cum-Retirement Benefits) Rules , 1958 , namely

8 1 (1) These rules may be called the All India Services (Death- cum-Retirement Benefits ) Amendment Rules, 2012
10 (u) They shall come into force on the date oftheir publication in the Official Gazette

12 2in the All India Services (Death- cum-Retirement Benefits) Rules , 1958 , in rule 16 , for sub- rule (3 ) , the following shall be substituted , namely

16 '(3) The Central Government may, in consultation with the State Government concerned, require a Member ofthe Service to retire from Service in public interest, after giving such Member at least three month's previous notice in writing or three month's pay and allowances in lieu of such notice,-

18 0 after the review when such Member completes 15 years of qualifying Service , or
19

21 (u) after the review when such Member completes 25 years of qualifying Service or attains the age of 50 years , as the case may be , or

24 (m) if the review referred to in ( 1) or ( 11) above has not been conducted, after the review at any other time as the Central Government deems fit in respect of such Member

32 Explanation :-For the purposes of sub - rule (3), " review" means the review of the entire service record of theMember of the Service regarding suitability or otherwise ofsuch Member for further retention in the Service , to be conducted regularly ofeach Member ofsuch Service, firstly, afterhis completion of 15 years of qualifying Service , and secondly, after his completion of 25 years of qualifying Service or on his attaining the age of 50 years , as the case may be , or if the review referred to in clauses (1) or ( n) of thus sub - rule has not been conducted in respect of such Member, such review may be conducted at any other time as the Central Government deems fit '
