फा सं एएआई/पर्स/इडीपीए/ आर ईजी/2002.-भारतीय विमानपत्तन प्राधिकरण, भारतीय विमानपत्तन प्राधिकरण अधिनियम, 1994 ( 1994 की सख्या 55 ) की धारा 42 की उप- धारा (4 ) के साथ पठित उप- धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार के अनुमोदन से भारतीय विमानपत्तन प्राधिकरण ( उपदान ) विनियम , 2003 में निम्नलिखित सशोधन करता है , अर्थात्ः-
1. संक्षिप्त नाम और प्रारंभ इन विनियमो का संक्षिप्त नाम भारतीय विमानपत्तन प्राधिकरण (उपदान ) सशोधन विनियम, 2012 है ।
(2 ) ये 1 जनवरी , 2007 से प्रवृत्त मान जाएगे ।
2 भारतीय विमानपत्तन प्राधिकरण ( उपदान ) विनियम , 2003
मे
(क) विनियम 4 के स्थान पर निम्न विनियम रखा जाएगा
" 4. फायदाः-उपदान की रकम इस प्रकार होगी
(क ) सबंधित कर्मचारी द्वारा सेवा के प्रत्येक सपूरित वर्ष या छह मास से अधिक के भाग के लिए अधिकतम 10,00,000 रुपए तक के अधीन रहत हुए अतिम आहरित वेतन के 15 दिन के समतुल्य होगी । 15 दिन के वेतन की संगणना उसके द्वारा अंतिम आहरित वेतन के मासिक दर को छब्बीस ( 26 ) से भाग देकर भागफल में पन्द्रह का गुणा करके की जाएगी ।

( ख ) किसी कर्मचारी की सेवा में रहते हुए मृत्यु के मामले में उपदान की रकम निम्नलिखित सगणित मापमान पर अनुज्ञेय होगी :
निरतर सेवा की अवधि उपदान की रकम
। वर्ष तक
2 मास का वेतन
6मास का वेतन
। वर्ष से 'अधिक किंतु
5 वर्ष तक
12मास का वेतन
5 वर्ष से अधिक किंतु
20 वर्ष तक
20वर्ष से अधिक अर्हक सेवा के सपूरित आधे वर्ष के लिए आधे माम का वेतन जो अधिकतम वेतन का 33 गुना के अध्यधीन होगा , परतु उपदान की रकम किसी भी दशा में 10,00,000 रुपए से अधिक नहीं हागी " ।
(ख) विनियम 10 के स्थान पर, निम्न विनियम रखा जाएगा :-
"10. उपदान के सदाय के लिए अन्य शर्ते-किसी कर्मचारी को, उपदान क सदाय की शर्तें जिसके सबंध में , सीमा के संबंध मे कोई उपबंध इन विनियमो मे नही किया गया है , वहां पर केन्द्रीय सरकार द्वारा इस सबंध में समय - समय पर जारी निर्देश लागू होगे । "

1 सार्वजनिक उद्यम विभाग द्वारा जारी अनुदेशों के परिप्रेक्ष्य मेग्रेच्युटी की सीमा को पूर्व प्रभाव से अर्थात् 1 जनवरी , 2007 से संशोधित करके 3.5 लाख रुपए से 10.00 लाख रुपए किया जाता है ।

2. प्रमाणित किया जाता है कि पूर्व प्रभाव से ये संशोधन किए जाने से किसी भी व्यक्ति के कुप्रभावित होने की संभावना नहींहै ।

(B) for regulation 10, the following regulation shall be substituted, namely :---
No. AAI/PERS/EDPA/REG/2002.- In exercise of the powers conferred by sub - section (2 ) read with sub- section (4 ) of Section 42 of the Airports Authority of India Act, 1994 (No. 55 of 1994), the Airports Authority of India, with the approval of the Central Government, hereby amends the Airports Authority of India (Gratuity) Regulations , 2003 , namely :--
"10. Other Conditions for Payment ofGratuity.- The conditions for payment of gratuity to an employee in respect of ceiling on payment of gratuity for which no provision is made under these regulations , shall be governed by the instructions issued to this effect by the Central Government from time to time ." 1. Short title and commencement .-These regulations may be called the Airports Authority of India (Gratuity) Amendment Regulations , 2012 .

2. In the Airports Authority of India (Gratuity) Regulations 2003 ,-
Note: The principal regulations were published in the Gazette of India, Extraordinary, Part III, Section 4 vide No. AAI /Pers ./EDPA/REG/2002 , dated 29-8-2003 , which have not been amended so far, (A) for regulation 4 , the following regulations shall be substituted , namely :-

"4. Benefits .-Amount of Gratuity shall be
1. The ceiling of gratuity from Rs . 3.5 lakh to Rs . 10.00 lakh is revised with retrospective effect i.e. from 1st January, 2007 in the light of the instructions issued by the Department of PublicEnterprises .
(a) equal to 15 days ' Pay last drawn by the employee concerned for every completed year of service or part thereof in excess of six months subject to a maximum ofRs . 10,00,000/- . The 15 days' pay shall be calculated by dividing the month rate of pay last drawn by the employee by twenty six ( 26) and multiplying the quotient by fifteen
2 Itis certified that no person is likely to he affected adversely by these amendments being given retrospective effect.
(b) In case ofdeath of an employee while in service amount of gratuity shall be admissible on the scale, calculated as under ---
