सा.का.नि. 62(अ).- केन्द्रीय सरकार , भारत- तिब्बत सीमा पुलिस बल अधिनियम , 1992 (1992 का 35 ) की धारा 156 की उपधारा (2) के खड (ख ) द्वारा प्रदत्त शक्तिया का प्रयोग करते हुए गृह मंत्रालय के अधीन भारत- तिब्बत सीमा पुलिस बल मे उप कमाडेट (राजभाषा) और सहायक कमाडेट (राजभाषा) के समूह ' क' पदो पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात-
1 संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमो का सक्षिप्त नाम भारत- तिब्बत सीमा पुलिस बल, उप कमाडेट (राजभाषा) और सहायक कमाडेट (राजभाषा ) समूह 'क' पद भर्ती नियम , 2011 है ।
(2) ये राजपत्र मे प्रकाशन की तारीख को प्रवृत्त होगे ।
2 लागू होना, ये नियम इन नियमो से उपाबद्ध अनुसूची के स्तभ ( 1 ) मे विनिर्दिष्ट पदो को लागू होगे ।
3 पदो की सख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान. उक्त पदा की सख्या उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होगे, जा उक्त अनुसूची के स्तभ (2) से स्तंभ (4 ) मे विनिर्दिष्ट है ।
4 भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताए, आदि.- उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताए और उससे सबधित अन्य बाते वे होगी जो उक्त अनुसूची के स्तभ (5) से स्तभ (13) मे विनिर्दिष्ट है ।

निरर्हता. वह व्यक्ति-
जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया (क)
है, या
जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह (ख)
किया है,
उक्त पद पर नियुक्ति का पात्र नही होगा
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस निगम के प्रवर्तन से छूट दे सकेगी ।
चिकित्सा दृष्टया योग्यता .- इन नियमो मे अन्तर्विष्ट किसी बात के होते हुए भी केवल 6. वे व्यक्ति जो केन्द्रीय संशस्त्र पुलिस बलो मे स्वास्थ्य देखभाल प्रणाली मे यथाविनिर्दिष्ट चिकित्सा प्रवर्ग शेप -1 मे है , प्रोन्नति और नियुक्ति के लिए पात्र होगे जिसमे इन नियमो के उपबंधो के अधीन प्रतिनियुक्ति या पुनर्नियोजन पर नियुक्ति सम्मिलित है ।
शिथिल करने की शक्ति. जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना 7 आवश्यक या समीचीन है, वहाँ वह उसके लिए जो कारण है उन्हे लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।
8 अधिवर्षिता.- ऐसे अधिकारी जो उप कमाडेट (राजभाषा) और सहायक कमाडेट (राजभाषा) का पद धारण किए हुए हैं, उस मास के जिसमे वे सत्तावन वर्ष की आयु प्राप्त करते है, अतिम दिन के अपराह्न मे सेवानिवृत होंगे ।
परन्तु वे अधिकारी जिनके जन्म की तारीख किसी मास की पहली तारीख है, सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अतिम दिन के अपराह्न मे सेवानिवृत होगे ।
9 व्यावृति.- इन नियमो की कोई बात, ऐसे आरक्षणो, आयु- सीमा में छूट ओर अन्य रियायतो पर प्रभाव नही डालेगी , जिनका केन्द्रीय सरकार द्वारा इस सबंध में समय - समय पर जारी किए गए आदेशो 'के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियो , अन्य पिछड़े वर्गों, भूतपूर्व सैनिको और अन्य विशेष प्रवर्ग , के व्यक्तियो के लिए उपबंध करना अपेक्षित है ।

भारत तिब्बत सीमा पुलिस बल के ऐसे सहायक कमाडेट (राजभाषा ) मे से , जिन्होने उस श्रेणी मे पाँच वर्ष नियमित सेवा की है जिसक न हो सकने पर समूह क और समूह 'ख अर्थात सहायक कभाडेट (राजभाषा) और सूबेदार मेजर (हिदी अनुवादक) / निरीक्षक (हिदी अनुवादक) के रैक में आठ वर्ष की सम्मिलित सेवा की हो जिसमे सहायक कमाडेट (राजभाषा) के रूप में न्यूनतम तीन वर्ष की नियमित सेवा हो और यथाविहित प्रोन्नति पूर्व पाठयकम या पाठयक्रमो को सफलतापूर्वक पूरा किया हो ।
टिप्पण 1.- जहां ऐसे कनिष्ठ व्यक्तियो के सबध मे, जिन्होने अपनी अर्हक या पात्रता सेवा पूरी कर ली है प्रोन्नति के लिए विचार किया जा रहा हो वहाँ उनसे ज्येष्ठ व्यक्तियो के सबध मे भी विचार किया जाएगा परतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमे से जो भी कम हो कम न हो और उन्होने अपने ऐसे कनिष्ठ व्यक्तियो सहित जिन्होने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है अगली उत्त्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2.- प्रोन्नति के लिए न्यूनतम अर्हक सेवा के प्रयोजन के
लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले. या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन सरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को, आयोग की सिफारिशो पर आधारित विस्तारित तत्स्थानी वेतन बैंड, और ग्रेड वेतन या वेतनमान मे की गई सेवा समझी जाएगी ।
प्रतिनियुक्ति द्वारा :
केन्द्रीय सरकार या राज्य सरकार के अन्य विभागो के ऐसे अधिकारियो की प्रतिनियुक्ति जो नियमित आधार पर समतुल्य या सदृश पद धारण किए हुए हैं या वेतन बैंड-3 , 15600-39100 रूपये + ग्रेड वेतन 5400 रूपये मे अन्य विभाग से केन्द्रीय सरकार या राज्य सरकार केऐसे अधिकारी जिन्होने उस श्रेणी मे पाँच वर्ष नियमित सेवा की है और जिनके पास हिदी से अग्रेजी और अग्रेजी से हिदी अनुवाद का न्यूनतम पाँच वर्ष का अनुभव है ।
टिप्पण 1.- प्रतिनियुक्ति की अवधि, जिसके अर्न्तगत केन्द्रीय सरकार के उसी या किसी अन्य सगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अतिम तारीख को 52 वर्ष से अधिक नहीं होगी ।
टिप्पण 2.- प्रोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नही होगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नही होगे ।
टिप्पण 3.- प्रतिनियुक्ति के आधार पर नियुक्ति के लिए न्यूनतम अर्हक सेवा की सगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा: 1 जनवरी, 2006 से पहले या. उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन सरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को सिवाय उस दशा के, जहाँ एक से अधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहाँ यह लाभ केवल उन पदों पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, आयोग की सिफारिशो पर आधारित विस्तारित वत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

भारत - तिब्बत सीमा पुलिस बल के ऐसे सूबेदार मेजर (हिदी अनुवादक) /निरीक्षक (हिदी अनुवादक) मे से जिन्होने उस श्रेणी मे तीन वर्ष की नियमित सेवा की है और जिन्होने यथाविहित प्रोन्नति पूर्व पाठयकम या पाठयकमो को सफलतापूर्वक पूरा किया हो ।
टिप्पण 1. जहा ऐसे कनिष्ठ व्यक्तियो के सबध मे, जिन्होने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहाँ उनसे ज्येष्ठ व्यक्तियो के सबध में भी विचार किया जाएगा परतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमे से जो भी कम हो कम न हो ओर उन्होने अपने ऐसे कनिष्ठ व्यक्तियो सहित जिन्होने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।
टिप्पण 2.- प्रोन्नति के लिए न्यूनतम अर्हक सेवा के पयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से पहले या उस

तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशो पर आधारित पुनरीक्षित वेतन सरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी वेतन बैड, और ग्रेड वेतन या वेतनमान मे की गई सेवा समझी जाएगी ।
प्रतिनियुक्तिद्वाराः
केन्द्रीय सरकार या राज्य सरकार के अन्य विभागो के ऐसे अधिकारियों की प्रतिनियुक्ति जो नियमित आधार पर समतुल्य या सदृश पद धारण किए हुए है या वेतन बैंड-2, 9300-34800 + ग्रेड वेतन 4800 रूपये मे केन्द्रीय या राज्य सरकार के अन्य विभागो से ऐसे अधिकारी जिन्होने उस श्रेणी मे न्यूनतम दो वर्ष नियमित सेवा की है और जिनके पास हिंदी से अग्रेजी और अग्रेजी से हिदी अनुवाद का न्यूनतम तीन वर्ष का अनुभव है ।
टिप्पण 1.- प्रतिनियुक्ति की अवधि, जिसके अर्न्तगत केन्द्रीय सरकार के उसी या किसी अन्य सगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अतिम तारीख को 52 वर्ष से अधिक नही होगी।
टिप्पण 2.- प्रोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नही होगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होगे ।

GS.R. 62 ( E ) . In exercise of the powers conferred by clause (b) of sub - section ( 2) of section 156 of the Indo - Tibetan Border Police Force Act , 1992 ( 35 of 1992 ) , the Central Government hereby makes the following tules regulating the method of recruitment to the posts of Deputy Commandant (Official Language ) and Assistant Commandant ( Official Language ) Group 'A ' posts in the Indo - Tibetan Border Police Force , under the Ministry of Home Affairs , namely ...
1. Short title and commencement .- ( 1 ) These rules may be called the Indo - Tibetan Border Police Force , Deputy Commandant ( Official Language ) - and Assistant Commandant ( Official Language ), Group ' A ' Posts , Recruitment Rules , 2011 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Application . These rules shall apply to the posts specified in column ( 1 ) of the Schedule annexed to these rules .

3. Number of posts , classification and pay band and grade pay or pay scale . The number of said posts , their classification and pay band and grade pay or pay scale attached thereto shall be as specified in columns ( 2 ) to ( 4 ) of the said Schedule
4. Method of recruitment , age limit and other qualifications , etc ..- The method of recruitment , age limit , qualifications and other matters relating thereto shall be as specified in columns ( 5 ) το ( 13 ) of the aforesaid Schedule .

5. Disqualification .- No person,-
( a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said posts :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
6. Medical Fitness.- Notwithstanding anything contained in these rules , only those persons who are in medical category SHAPE - I , as specified in Health Care System in Central Armed Police Forces , shall be eligible for promotion and appointment including appointment on deputation or re- employment under the provisions of these rules .
7. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .
8. Superannuation . Officers holding the post of Deputy Commandant (Official Language ) and Assistant Commandant (Official Language ) shall retire from the service on the afternoon of the last day of the month in which they attain the age of fifty- seven years :
Provided that an officer whose date of birth is on the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty- seven years .
9. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

By deputation of officers from other Central Government or State Government departments holding equivalent or analogous post on regular basis or the Officers of other Central Government or State Government departments in Pay Band -3 , Rs 15600-39100 and Grade Pay of Rs 5400/-having five years regular service in the grade and minimum five years experience in translation from Hindi to English and vice - versa
Note. 1- The period of deputation including the period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government s'all ordinarily not exceed three years The maximum age lumit for appointment by deputation shall be not exceeding 52 years as on the closing date of receipt of application
Note. 2- The departmental officers in the feeder categories who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation Sumilarly, deputationists shall not be eligible for consideration for appointment on promotion
Note 3. For the purpose of computing mınımum qualifying service for appointment on deputation basis , the service rendered on a regular basis by an officer prior to 1 January , 2006, the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation of the Comunission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation .
